The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances'comouinity character, preserves open space, makes efficient use of infrastructure, makes heneficial use of a coastal location, and minimizes adverse effects of development. The proposed front yard setback to the sand easement is 15.7 feet. It is was reported that the seaward limit of the property is landward of the"sand easement". Although it is recognized that the proposed construction more than the code permitted 2.5 stories is proposed to render the structure flood zone complaint, it is unsupported. Structure on lots adjacent to the Peconic Bay are vulnerable to wind and wave exposure during storms including hurricanes. Inundation of the parcel is expected in all categories of a Hurricane(SLOSH). Structure in these locations should be minimized and not exceed the bulk schedule requirements. Development that does not reinforce the traditional land use pattern of the Town of Southold conflicts with this policy. Policy 4.1. Minimize losses of human life and'structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended:specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The subject parcel is located within the FEMA flood zone VE el 8 (velocity hazard)and the remainder area is located within the flood zone AE el 6 (see Figure 1. below). Both flood zones pose a high flood risk. The VE flood zone is an area inundated by 1% annual chance flooding with velocity hazard(wave action). AE mapped properties have a 1 percent annual chance of flooding and a 26 percent chance of flooding over the life of a 30 year mortgage. The effect of potential flooding and the function on the tank and drywells is unknown. The depth to groundwater has not been provided. It appears that the size of the single-family residence dictates the location and setbacks of the tank and drywells. Chapter 275 Wetlands and Shorelines of the Southold Town Code requires the following setbacks to protect environmental quality. 1. Septic tank 75 feet 2. Sanitary leaching pools 100 feet To protect life and property during storm events from wind and flooding, it is recommended to minimize and locate structures as far from the Peconic Bay to the greatest extent practicable. The humidity and temperature effects associated with open soil conditions would create a bad interior environment and have a detrimental impact on the structures' energy efficiency.
