An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because:The existing gazebo, shed, shower, hot tub and second story deck are all connected to the existing approved permitted deck and form a cohesive collective. The 3'-0"x 21'-0" deck addition at the northwest corner of the existing deck matches the rear deck and its elements. The deck at the midpoint of the steps to the bulkhead conforms generally to the existing slope contours and the deck at the bulkhead is only 1'-0 W above grade and conforms to the horizontal line of the top of the bulkhead. All of the above items are in keeping with the character of the as-built environment. 2. The benefit sought by the applicant CANNOT be-achieved by some method feasible for the applicant to pursue, other than an area variance, because: No.The structures are all as-built and are either built on or connected to an approved permitted deck. They are all integral to the function of the approved deck. To be in compliance with zoning they would not be integral to the function of the primary deck. The 3'-0" x 21'-0" addition to the existing rear deck was constructed at the same time as the rear deck however, the corrected survey was not submitted and it is integral to the rear deck. The deck at the midpoint to the bulkhead steps and the deck at the bulkhead are integral to the bulkhead steps. 3. The amount of relief requested is not substantial because: All of the structures are integral to the main approved permitted structures of both the existing pool deck and steps to the bulkhead. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because:The as-built gazebo and shed are connected to the existing deck. The shower is a shower head on an existing gable wall to the main dwelling over the existing deck. The hot tub is integral with the existing deck. The 2nd story deck and steps are connected to both the existing dwelling and existing deck. They all form part of a collective built around the existing dwelling and deck and keeping within the physical and environmental condition. The 3'-0" x 21'-0"as-built addition to the northwest side of the existing deck was built at the same time as the existing deck and does not change the physical or environmental character of the neighborhood. The decks to the bulkhead steps are in keeping with the slope and the top of the bulkhead. l i DAVID J.JAMNUZZi - NOTARY PUBLIC,STATE CF NEW YORK Registration No.02JAGO52585 Qualified in Suffolk County Commission Expires February 93,y al N i 20-3 5.
