(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: This is a large waterfront parcel on Goose Creek, the applicant is maintaining the maximum setbacks to Goose Creek. However, the proposed location is in a "side yard". The house faces the right-of-way located off of Main Bayview. If the pool were moved to the east(rear yard) the setbacks to the wetlands would be reduced significantly. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: the proposed placement of the pool is the best location to maintain setbacks to wetlands and retain privacy to the homeowner. (3) The amount of relief requested is not substantial because: The variance is a "technical" request. The setbacks to the property lines are conforming.
