SCTM No. 1000-53-6-10. The proposed side yard setbacks are EXEMPT from LWRP review pursuant to §,268-3. Definitions.MINOR ACTIONS item"F". The proposal to increase the permissible lot coverage over 20 percent is recommended as INCONSISTENT with the LWRP. Policy 1. "Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development." The expansion of an existing structure over the permitted 20% lot coverage is inconsistent with the above policy as it does not support a pattern of development consistent with the Southold Town Code. Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minitruze losses of human life and structures from flooding and erosion hazards are recommended:specifically" -4. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. I 3. Move existing development and structures as fa i away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a lolcation on the coast or in coastal waters. The residential structure does not functionally require a location on the coast and is not water dependent. I Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Name of Owner: Ahmuty ZBA File # REASONS FOR APPEAL (additional sheets may used with preparer's si nature : AREA VARIANCE REASONS.- (1) EASONS.(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: Rear decks are common on Bay Shore Road and the proposed deck which is 12' x 28.5' is in keeping with the character of this bay front community. The proposed deck is adjacent to the existing house which is at 9.8' from the north property line and 11.7' from the south property line. The existing side yard setbacks will be maintained. The deck remains at the same level as the rear sliding door, 3 steps above grade. This neighborhood, due to the non-conforming size of the lots, has an extensive record of variances. In the last ten years the following variances were granted: 53-6-11: #6631 dated 3/21/13 Additions & alterations granted side yard 2.3, combined yards 7.2, front yard 25.7 & #6562 dated 5/3/12 "as built" addition 5' setback 53-6-23: #6556 dated 7/19/12 Demolition & reconstruction front yard 32.5, side yard 6.5, combined yard 14.5 and 26% lot coverage. 53-6-5: #6532 dated 1/19/12 Deck Addition (30' to bulkhead) side yard 7.3, lot coverage 23.8% 53-6-8 dated 9/23/10 #6409 accessory garage side yard 8' and lot coverage 26% The proposed request is reasonable and consistent with the appeals granted in this neighborhood. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Mr. Ahmuty has become less mobile' due to Parkinson's t Disease. He needs a hard surface for mobility. The uneven surface of the grass is no longer safe for Mr. Ahmuty. Even if Mr. Ahmuty's physical disability did not require this accommodation, (3) The amount'of relief requested is not substantial because: The lot size is preexisting non-conforming, and the proposed lot coverage is the minimal necessary for an above grade deck. The existing wood deck along the southerly property line is being removed and replaced with pavers on grade to reduce the potential lot coverage. Because the rear deck can not be"on grade" the variance requested is the minimal variance practical. (4), The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The property is protected by a bulkhead and a beach area landward of the mean high water. The proposed accessory structure (deck) will have no greater impact than the grass's impact on physical or environmental conditions of the neighborhood.
