Dear Ms. Moore:
The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, July 11, 2022:
WHEREAS, this standard subdivision proposes to subdivide a 5.18-acre parcel into two
lots where Lot 1 equals 2.60 acres and Lot 2 equals 3.24 acres and is improved with a
single-family residence in the Agricultural Conservation and Residential 80 Zoning
Districts.; and
WHEREAS, on January 20, 2022 the applicant submitted a Sketch Plan application and
fee; and
WHEREAS, at their work session on March 28, 2022, the Planning Board found the
Sketch Plan Application incomplete; and
WHEREAS, on April 19, 2022 the applicant submitted a revised Sketch Plan
application, including the information needed to make the application complete; and

WHEREAS, the Southold Town Planning Board has determined that the following
provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the
interest of the public health, safety and general welfare because this subdivision is not
clustered, no new road is proposed, and the acreage of Lot land 2 are both conforming
to the zoning district and therefore are eligible for a waiver:
a. Yield Plan;
b. Primary & Secondary Conservation Area Plan; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action,
nor does it meet any of the criteria on the Type II list of actions; and
WHEREAS, on June 27, 2022, at their work session, the Planning Board reviewed the
submission and found the Sketch Plat application was complete and ready for a
determination pursuant to Town Code §240 Subdivision of land; therefore be it
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is an Unlisted Action under SEQRA as described above; and be it further
RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of
certain provisions, hereby waives the following provisions of subdivision:
a. §240-10 (8): Yield Plan;
b. §240-10 (C): Primary & Secondary Conservation Area Plan; and be it
further
RESOLVED, that the Southold Town Planning Board grants a Conditional Sketch Plat
Approval upon the map entitled, "Subdivision Sketch Plan of Subdivision for 15105
Oregon Road LLC", prepared by Nathan Taft Corwin III, Land Surveyor, dated August
20, 2021 and last revised December 30, 2021, with the following conditions:
1. Add the zoning division line to the Preliminary Plat.
2. Correct the acreage referenced for the flag of proposed Lot 1. It should be
0.37.
The next step to continue towards approval is to meet all conditions stated
above, and to submit a complete Preliminary Plat Application and Fee.
Note that specifics regarding map changes, content of the Covenants and
Restrictions, other legal documents and submission requirements needed for
subdivision approval will be provided to the applicant by the Planning Board
during the Preliminary Plat Application review stage, and upon completion of the
environmental review and receipt of comments from other involved agencies. The

applicant is advised that design changes may be required prior to Final Plat
Approval.
Sketch Plan Approval shall expire six months from the date the Planning Board
adopted its resolution of approval unless extended by further resolution of the
Planning Board.

Recommend that the Planning Board waive the requirement for a yield plan. A total of 2
lots are proposed in the AC/R-80 zone on 5.81 acres of buildable lands.
The current design of the subdivision does not fully support the purpose.
§ 280-12 Purpose.
The purpose of the Agricultural-Conservation (A-C) District and the Low-Density Residential R-
80, R-120, R-200 and R-400 Districts is to reasonably control and, to the extent possible,
prevent the unnecessary loss of those currently open lands within the Town containing large
and contiguous areas of prime agricultural soils which are the basis for a significant portion of
the Town's economy and those areas with sensitive environmental features, including aquifer
recharge areas and bluffs. In addition, these areas provide the open rural environment so highly
valued by year-round residents and those persons who support the Town of Southold's
recreation, resort and second-home economy. The economic, social and aesthetic benefits
which can be obtained for all citizens by.limiting loss of such areas are well documented and
have inspired a host of governmental programs designed, with varying degrees of success, to
achieve this result. For its part, the Town is expending large sums of money to protect existing
farm acreage. At the same time, the Town has an obligation to exercise its authority to
reasonably regulate the subdivision and development of this land to further the same purposes
while honoring the legitimate interests of farmers and other farmland owners.
Recommend the application as COMPLETE. ERSAP information was submitted.

Aquifer

Dear Chairman and Board:
We would respectfully request that the subdivision lots be approved as proposed on January
20,2022. The proposed lot sizes maintain code conforming homes with adequate distances between their
wells and sanitary systems. The proposed lot sizes enable both lots to include vines and agricultural open
space. The vines between the two lots can be located in a contiguous rows for ease of cultivation.
Proposed Lot 1 with 2.6 acres includes the"pole"as the common access for the two parcels and
will include 1 acre of agricultural open space. The vines will be planted,managed and grapes sold for
wine production. The proposed acreage allows for the contiguous cultivation of both Proposed Lot 1 and
lot 2 .
Proposed Lot 2 is developed and the balance of the parcel will be planted with vines. The
developed portion of the property is 200' x 150' (less than one acre)with the balance of the parcel will be
Agricultural Open Space. For the Board's information 1 acre of vines produces 2 tons of grapes. 1 ton
of grapes can produce 150 gallons of wine.
The surveyor can provide the actual acreage of the Agricultural Open Space calculations once the
building envelope is finalized. The two parcels will have continuous acreage of grapes. The areas
outside of the building envelopes will be the easement for the purposes of maintaining agricultural
production and to prevent the degradation of loss of aesthetic open space and agricultural value of said
premises. The standard agricultural covenants would be recorded in the easement area.
This plan will maintain the agricultural use of the premises in perpetuity. The development of
only two homes on 5.8 acres enables several acres to be dedicated to agriculture without expenditure of
public funds from the Development Rights program.

Dear Mark:
Please include this letter to supplement the ERSAP regarding soil Series,
The most common type of agricultural soil on the North Fork is called Haven, which is primarily
sandy loam. The next most common is Riverhead, which is similar to Haven but contains
somewhat more sand and gravel and is seen more on slopes. These names are often appended by
A,B, or C, which indicate increasing degree of slope. Any of these designations are suitable for
most agricultural purposes on the North Fork.
As to the subject property:the northern part of the Nassi property has slightly higher slope than
the southern. Most of the south part(Nassi S),would be designated Haven A, while much of the
north part(Nassi N)would be either Haven or Riverhead A or B.
Attached please find the soil test results recently done by Waypoint Analytical in Roanoke
Virginia. Waypoint(formerly known as A&L Eastern Labs) is used by many local farmers and
known for their clear and trusted results.
Howard Dickerson provided the following samples to plant grapevines on the property and he
needed to know the current status of the soil regarding its suitability for grapevines. The 2
samples from Nassi are sub-labeled Nassi N and Nassi S, indicating that they come from the
north and south halves of the property at the NW corner of Bridge Lane and Oregon Road in
Cutchogue,NY.
Howard Dickerson added a few explanations.
1. Soil pH. Long Island soils tend to run somewhat acidic. We have no underlying limestone to
balance the acidity as many inland areas have. This made it a good place to grow potatoes which
do well in soil pH of about 5, whereas most vegetables and grapes do better with pH above 6 -
achieved by adding pulverized limestone.
2. High phosphorus and low boron are typical of past potato growing, as potatoes liked high
phosphorus levels and selectively used up the small amounts of Boron in the soil,which is then
supplemented in the fertilizer for future crops.
3. High Iron and copper in is common in our soils and groundwater- it is a legacy of the glaciers
-and most of our water wells need periodic treatments to remove the excess rust that reduces
their efficiency.
4. Low sodium is a plus as it indicates very little salt spray or build-up from past use of high
salt-containing fertilizers
5. Otherwise,these soils are unremarkable and easily recognizable as coming from a North Fork
farm field.

The Planning Board reviewed the proposed planting of grape vines on the property as
described in an email from Patricia Moore on April 20, 2022. Pursuant to Chapter § 240-
6. General application procedure. "No construction, improvement, grading or clearing of
land or other disturbance of existing conditions shall be commenced or undertaken on
land for which an application has been filed pursuant to this chapter until final approval
of the application has been granted, except as expressly provided herein."
The planting of vines, which involves trellis infrastructure is considered an improvement
and should not be undertaken until after the subdivision process is completed. Any
improvements made prior to subdivision approval are at your own risk. Work on the
house on Lot 1 may continue, however landscaping, irrigation systems, accessory
structures and other improvements must also wait until after the subdivision is
approved. All improvements beyond the house foundation on Lot 1 are at risk of having
to be removed to make way for buffers, setbacks or to meet other requirements of the
Planning Board in their review process of this subdivision.

I represent the owner of the above referenced parcel. The owner wishes to create an agricultural

The parcel is 253,280 square feet which could yield 3 lots. The applicant is only asking for 2
homes;the existing home under construction and an additional home on a separate lot. We can discuss

V: Discussion
Recommend that the Planning Board waive the requirement for a yield plan. A total of 2
lots are proposed in the AC/R-80 zone on 5.81 acres of buildable lands.
The current design of the subdivision does not fully support the purpose.
§ 280-12 Purpose.
The purpose of the Agricultural-Conservation (A-C) District and the Low-Density Residential R-
80, R-120, R-200 and R-400 Districts is to reasonably control and, to the extent possible,
prevent the unnecessary loss of those currently open lands within the Town containing large
and contiguous areas of prime agricultural soils which are the basis for a significant portion of
the Town's economy and those areas with sensitive environmental features, including aquifer
recharge areas and bluffs. In addition, these areas provide the open rural environment so highly
valued by year-round residents and those persons who support the Town of Southold's
recreation, resort and second-home economy. The economic, social and aesthetic benefits
which can be obtained for all citizens by limiting loss of such areas are well documented and
have inspired a host of governmental programs designed, with varying degrees of success, to
achieve this result. For its part, the Town is expending large sums of money to protect existing
farm acreage. At the same time, the Town has an obligation to exercise its authority to
reasonably regulate the subdivision and development of this land to further the same purposes
while honoring the legitimate interests of farmers and other farmland owners.
Recommend the application as INCOMPLETE. An ERSAP plan was not submitted.
Due to the location of the parcel on Oregon Road, the probable occurrence of prime
agricultural soils (agricultural lands), availability of community water, Southold Town
Farm and Farmland Protection Strategy, groundwater quality, and wildlife use of the
parcel an ERSAP and potential clustering of lots is recommended.
Town Code allows the Planning Board, at its discretion, to mandate cluster development
of a parcel of seven acres or less in size in order to preserve the natural and scenic
qualities, of o en lands, The Planning Board shall consider the ERSAP in making such a
determination and may require cluster development upon a finding that natural and
scenic qualities of the parcel, including, but not limited to, the following should be
preserved:

a. Water resources: wetlands, aquifer and aquifer recharge areas, municipal water
supply watershed areas, flood-prone areas as shown on Federal Emergency
Management Agency maps, New York State protected areas, or areas legally
protected by the County of Suffolk, the Town of Southold, private trusts or other
entities or agencies.
b. Agricultural lands: active farmland within a New York State certified Agricultural
District, lands within 2,000 feet of a New York State certified Agricultural District,
or soils classified in Groups 1 to 4 of the New York State Soil Classification
System or areas legally protected by the County of Suffolk, the Town of
Southold, private trusts or other entities or agencies.
c. Community water and/or sewer: sites where community sewer, community water,
or community water and sewer are available or planned.
d. Designated open space areas: lands contiguous to publicly owned or designated
open space areas, privately owned designated natural areas, or areas identified
in the Southold Town Farm and Farmland Protection Strategy.
e. Scenic view sheds and special features: sites bordering designated state, county
or Town scenic roads, or special features identified in the Town's Comprehensive
Plan.
The following information shall be included on the ERSAPa
• Topography, the contour lines of which shall be at five-foot intervals, determined
by photogrammetry (although ten-foot intervals are permissible beyond the
parcel boundaries, interpolated from published U.S. Geological Service USGS
maps). Slopes equal to or greater than 15% shall be clearly indicated.
• Sole source aquifers and/or aquifer recharge areas.
• Areas legally protected by the County of Suffolk, the Town of Southold, private
trusts, qualified conservation organizations or other entities or agencies as
shown on the Town of Southold Protected Lands Map, including all abutting
parcels.
• Vegetative types described by plant community, relative age and condition on the
property according to:
• General cover type, including cultivated land, permanent grass land, old field,
hedgerow, woodland and wetland.
• Soil series, types and phases, as mapped by the U.S. Department of Agriculture,
Natural Resources Conservation Service in the Suffolk County Soil Survey, and
accompanying data published for each soil relating to its suitability for agriculture
and construction (and, in unsewered areas, for septic suitability).
• Scenic viewsheds and special features:
• Sites bordering designated state, County or Town scenic byways and corridors
special features identified in the Town's Comprehensive Plan and all subsequent
updates.
• A viewshed analysis showing the location and extent of views into the property
from public lands, roads and from public parks, public forests, and state game
lands.

• Locations and dimensions of all existing public and private streets, roads,
buildings, utilities and other man-made improvements.
• Locations of all archeological and historically significant sites or structures of
national, state or local significance on the tract or on any abutting tract.
• All easements and other encumbrances affecting the parcel filed with the Suffolk
County Clerk's Office.
• Location and delineation of any active agriculture operation, active farmland
within a New York State certified Agricultural District, lands within 2,000 feet of a
New York State certified Agricultural District, or soils classified and mapped as
Suffolk County and State Prime Farmland Mapping Units, of the New York State
Soil Classification System or areas legally protected by the County of Suffolk, the
Town of Southold, private trusts or other entities or agencies.
• Areas identified in the Southold Town Farm and Farmland Protection Strategy
2000 and in the most current version of the Southold Town Farmland Inventory.
• Location of community water and/or sewer; whether available or planned.
• Critical environmental areas: lands within or contiguous to a critical
environmental area designated pursuant to Article 8 of the Environmental
Conservation Law.
• Areas with endangered and threatened vegetation.

ERSAP issues:
• Topography-the parcel is 5.8 acres and flat.The subdivision map shows the elevations and the
contour lines based on N.A.V.D 1988 DATUM. There are no slopes greater than 15%. At the
road,the actual elevation of the property is 63 and at the northerly end of the parcel, measuring
1129 feet to the north, the actual elevations are 70/72 and shown on the map. The contours of
the parcel and elevations are consistent. There is a slight rise of the property which is generally
found on farmed parcels along the north side of Oregon Road. This parcel was actively farmed
in the last 10 years and the soils are most productive on the northerly end of the parcel. The
land closest to Oregon Road has slightly lower elevations which is attributable to typical farming
practices.
+ Sole Source Aquifer and/or aquifer recharge area. This parcel is within a sole source aquifer
(Groundwater Management Zone 4). The parcel yield is over 2 acres per lot(5.8 acres).
+ The Proposed Subdivision design is consistent with the Southold Town Comprehensive Plan:
The applicant wishes to reduce the size of the improved lots and create an agricultural open
space parcel which can be planted, managed, and maintained as an agricultural parcel. The
agricultural parcel would for agricultural use, in perpetuity.
As is stated in the Comprehensive Plan:Agriculture plays an integral part in the economy, land use, and
character of Southold Town.Approximately 30 percent of its 33,350 acres are in farmland,with
agriculture and related businesses represented in the top five economic engines of the Town's economy.
The goals of the agriculture chapter are therefore intended to keep farming and farmland as well
represented and robust in the future as they are currently.To this end,the goals seek to:
Retain and advance the industry of agriculture.
Protect prime agricultural soils from depletion, removal, and excessive erosion.
Promote best management practices for the use of agricultural pesticides and herbicides to protect
groundwater and surface water resources.
Promote improved agricultural yields through nuisance wildlife management.
Promote best management practices to prevent the movement of crop disease and pests from one
location to another.
Protect public safety by ensuring there is adequate parking and traffic control on private property at
retail agricultural operations.
• Areas Legally Protected by the Town, County,Trust or privately:The parcels shown as
protected through Development Rights purchases are the following parcels:
The proposed agricultural lot will meet the principal goals relating to land preservation in Southold
Town: • Protect farmland,with an overall goal of retaining at least 8,000 acres in agriculture. At no cost
to the Town residents,the subdivision design would preserve 5 acres for agricultural use.
• Vegetative Types:the parcel was last farmed 10 years ago and is showing early succession
plants such as native cedars and invasive Russian olive. The parcel will be returned to active
agricultural use. The proposed residential homes will be landscaped with native and drought
tolerant species and limit the use of fertilizers which could interfere with the agricultural use.
• There are no woodlands or wetlands on the parcel. The parcel was owned by the Bokina family,
cleared over the generations, and used for farming.
• Soil Series(Suffolk County Soil Survey-the top 4" layer of soil—"Haven-Riverhead", According to
the test hole in the center of the parcel at 8' below grade is Brown Silty Sand (SM)and below
elevation 60'the soil is described as"Pale Brown Fine to Coarse Sand". These conditions are
suitable for cultivation of vines.See Suffolk County Soil Map.
• Scenic Viewshed and Special Features: Oregon Road has high scenic values. The predominant
uses on Oregon Road are agriculture (active farms) and single-family dwellings. Many of the
homes on Oregon Road support the agricultural use of the property. Farmers would develop
their homestead along Oregon Road. The waterfront,which the farmers considered unsuitable
for agricultural use,was developed in the last century. To the north of the subject parcel are
minor subdivision (5 lots or less) approved in the last 30 years. The Baxter Subdivision and
Rayburn Subdivision.
• Roads: Oregon Road is a public road. The homes along Long Island Sound are served by private
common driveways/right of ways which are generally 15'to 20' in width and maintained by the
private landowners. The proposed lot will have access to Oregon Road (flag lot).
The existing dwelling under construction was placed on the property approximately 250'from Oregon
Road and while the architectural design is very modern,the house is one story and about 20' in height.
The land along Oregon Road would be planted with Vines which maintains the agricultural viewshed.
The vines will block the view of the house. Oregon Road is at elevation 62 and the house is at elevation
63,from most passenger vehicles,the public will see vines and not see into the parcel. On the east,
there is a 20' private common driveway serving the Baxter Subdivision,the owner plans to plant several
vines between the house and the adjacent property. From the private driveway the neighbors will see
vines.There are two separate private driveways serving the homes along the Long Island Sound. A
separate 16' private common driveaway serves the lots to the east along the Long Island Sound in the
"Minor Subdivision of Robin A. Raeburn & Mary Elizabeth Murphy" approved in 1987. These
subdivisions were approved more than 20 years ago,the homes are screened with mature private
landscape buffers and the two right of ways are delineated with post and rail fencing.
