("Gentleman's Ridge") and Mini Cedars LLC ("Mini Cedars"), both New York limited liability
companies, both with offices at c/o Rivkin Radler LLP. RXR Plaza, Uniondale,N.Y. 11556,
Attn. John Panagopoulos, Esq., ( Gentleman's Ridge and Mini Cedars collectively hereinafter
1000 are referred to as the "DECLARANTS")

a� WHEREAS, the Gentleman's Ridge, is the owner of the following property commonly known as
825 Stephensons Road, Orient, N.Y., 11957, with a tax map designation of District 1000, Section
17, Block 1, Lot 11.5, more particularly described on Schedule "A" annexed hereto ( the
PREMISES"), and
WHEREAS, the DECLARANTS are seeking to provide access to an adjoining lot as an easement
in the form of a right of above ground ingress and egress from a private road with a non-exclusive
Right of Way and for the purpose of providing underground utilities to said adjoining lot,
commonly known as 905 Stephensons Road, Orient, N.Y. 11957, with a tax map designation of
District 1000, Section 17,Block 1,Lot 2.2(the"ADJOINING LOT"),more particularly described
in Schedule B, attached hereto.
WHEREAS, Mini Cedars is the owner of the ADJOINING LOT.
NOW, THEREFORE,
DESCRIBED EASEMENT FOR THE PURPOSE INGRESS AND EGRESS TO ADJOINING
LOT
Commencing at an iron pipe marking the southeast corner said adjoining lot, thence S 53 degrees,
3 minutes, 36 seconds east, a distance of 49.07 feet, more or less, to a point on the westerly side
of a private road.
THENCE, in a general northerly direction along said westerly side of said private road a distance
of 65.73 feet, more or less, to a point.
THENCE, N 59 degrees, 54 minutes, 56 seconds west a distance of 5.05 feet, more or less to a,
point on-the easterly property line of said adjoining lot.
UTILITY EASEMENT FOR ADJOINING LOT
For the benefit of and to service the ADJOINING LOT, a utility easement on the PREMISES shall
be granted for the purpose of trenching and installing inground utilities from pole #216-A.
Subsequent to installing the inground utilities, the easement area affected thereby shall be restored
to its previous condition , at the sole cost and expense of the owner of the ADJOINING LOT.
The DECLARANTS hereby acknowledge that the above described right of way/utility easement
are granted in consideration of Mini Cedars relinquishing any claim of right, title, interest or use
of that portion of the right of way that remains unimproved on the property of the PREMISES, as

described in Liber 11705, page 573, commencing at the intersection of the private road and
unimproved right of way as it makes a turn generally to the east and runs through a portion of the
existing swimming pool and the residence, as shown on the attached survey, prepared by Young
& Young for Francisco Pineda, annexed hereto as Schedule "C".
This DECLARATION shall run with the land and be binding on the heirs and assigns of both the
PREMISES and ADJOINING PARCEL.
It is herein intended that the above described easements will provide the ADJOINING LOT with
the right of easement for above ground ingress and egress from said private road and the right to
an easement to install and maintain underground utilities including electric power, telephone and
cable to serve the ADJOINING LOT.
