TERMS AND CONDITIONS
The Permittee Lefkara Holdings LLC residing at 1070 The Strand East Marion,New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation perfonned pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Pennittee
assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Pen-nit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work
shall cause unreasonable obstruction to free navigation,the said Pennittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety (90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights, title,
or interest in real or personal property held or vested in a person not a party to the penmit.

The Board of:Town.Trustees.took the following action during its Regular meeting .held
on Wednesday, February 16, 2022, regarding the above matter:
WHEREAS; Jeffrey Patanjo, on behalf of LEFKARA HOLDINGS, LLC c/o NEOFITOS
STEFANIDES applied to the Southold Town Trustees for a permit under the provisions
of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of '
Southold,.and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas,'
application dated November 10, 2021, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory.
Council and to the Local.Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS,the LWRP Coordinator issued a recommendation that the application be
found Inconsistent with the Local Waterfront Revitalization Program policy standards,.
and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization
Program.policy to the greatest extent possible through the imposition of the following
Best Management Practice requirements: addition of terracing and 10' wide non turf
buffer;
WHEREAS, a Public Hearing was held by the Town.Trustees with respect to said
application on January 19, 2022 and February 16, 2022, at which time all interested
persons were.given an opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered.a,ll the testimony and documentation submitted
concerning this,application, and,
WHEREAS, the structure complies with the standards.set forth in Chapter 275.and
Chapter 111 of-the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of'the-people of the town,
NOW THEREFORE.BE IT,
RESOLVED, that the Board of Trustees have found the application to:be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve.the application;of LEFKARA
HOLDINGS, LLC c/o NEOFITOS STEFANIDES for the removal of the existing
temporary sandbags along bottom of eroded bluff and replacement with 681f rock
revetment and 101f revetment return consisting of naturalstone boulders from upland

Permit to construct and complete project will expire two years from the date the,permit
.is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

The owners of record of property at: 1070 THE STRAND, EAST MARION

in applying for a Coastal Erosion Permit for an erosion protection structure does hereby agree to a 30-
Year Maintenance program for a structure as described: 681f rock revetment and 101f revetment return
consisting of natural stone boulders from upland sources: stabilization fabric to be placed under proposed
boulder revetment: install 2"x12" un-treated timber terrace boards for every 10' along eroded portions of
bluff: install 40cy of clean sand fill from upland source to re-nourish bluff landward of proposed revetment:
re-vegetate.all disturbed bluff areas with Cape American beach grass plugs 12" on center; as shown on
the attached licensed survey and/or site plan for the approved structure.
It is my/our understanding that we are to maintain this structure with materials designed to endure 30
years and/or equivalent to the original approved structure. Any maintenance which involves more than
50% of the length of this structure requires approval of the Board of Trustees. We further understand that
failure to maintain the structure could result in a requirement to post a bond and/or have the repairs
ordered as a lien against the property upon a finding by the Board of Trustees that said lack of
maintenance would risk life, property or important natural resource features.

held on Wednesday, January 19, 2022:

LLC, c/o NEOFITOS STEFANIDES requests a Wetland Permit and a Coastal Erosion
Permit to install 68 linear feet of rock revetment at toe of existing eroded bluff to replace
existing temporary sand bags; install 60 cubic yards of clean sand fill and Cape
American beach grass on entire bluff to protect property against additional storm

S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE:
WHEREAS, the Southold Town Board of Trustees are familiar with this project having
visited the site on January 11, 2022, and having considered the survey of property by
Nathan Taft Corwin III Land Surveyor last dated June 5, 2017, and having considered
the plans for this proposed project submitted by Jeffrey Patanjo dated October 25, 2021
at the Trustee's January 13, 2022 work session, and
WHEREAS, on January 19, 2022 the Southold Town Board of Trustees declared itself
Lead Agency pursuant to S.E.Q.R.A., and
WHEREAS, on January 19, 2022 the Southold Town Board of Trustees classified the
application as an unlisted action under S.E.Q.R.A., and
WHEREAS, in reviewing project plans submitted by Jeffrey Patanjo dated October 25,
2021 it has been determined by the Board of Trustees that all potentially significant
environmental concerns have been addressed as noted herein:
o Vegetative, non-structural measures are not capable of stabilizing the erosion of
the bluff alone.
0 Protection of the toe of bluff using hardened structures including rock revetment
is necessary.
No existing rocks or boulders are to be utilized, moved, or relocated on the
beach.
As time progresses, continued soil loss at the toe of the bluff may lead to habitat
degradation and bluff instability.
• A site inspection by the Southold Town Board of Trustees recognized erosion on
this property and the need for a bluff stabilization/erosion control plan.
THEREFORE, according to the foregoing, the Southold Town Board of Trustees
Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to
SEQRA for the aforementioned project.

replacement with 68 LF rock revetment and 10 LF revetment return consisting of natural stone boulders
from upland sources. Stabilization fabric to be placed under proposed boulder revetment. Install 2"x12"
un-treated timber terrace boards for every 10' along eroded portions of bluff. Install 40 CY of clean sand
fill from upland source to re-nourish bluff landward of proposed revetment. Re-vegetate all disturbed

Last night the Board of Trustees held their work session and reviewed the above mentioned files. They requested I
email you with a request to submit revised plans to be received by next Wednesday morning for all three properties in
order to be further discussed during the public hearings.The requested information would be the same for each except
for the last bullet:
• A proposed 10'wide non-turf buffer along the landward edge of the top of the bluff.
• To scale drawings of the slope of toe armoring and show a less steep slope as it currently looks too much like a
wall to the Board.
• Some of the plans show terracing. If terracing is proposed on any of the bluffs please submit a terracing&
planting plan for each and revise said project description(s).
• Please add on the plans and project description the proposed source of the boulders to be used for said
projects.
• Specifically for the two outer properties, modify the proposed rock revetment to show a sort of inward angled
revetment at each outer"end" of the revetment in order to help alleviate the amount of erosion the proposed
may cause the abutting properties.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT
with the LWRP.
1. Some time after 2019 the landowner cleared their property to the bluff most likely
accelerating erosion of the bluff.
2. A long line of sand bags occurs along the shoreline and the stretch of shoreline should have
a coastal management plan developed for a consistent method of erosion control
3. Due to the severe angle of the bluff slope, it is probable that Cape American beach grass
will not "hold the slope" and prevent erosion.
In the event the action is approved:
4. Prohibit the use of naturally occurring rocks or boulders on the beach in construction.
5. The impact of accelerating erosion on the two unarmored flanking properties should be
assessed.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
