AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on January 19, 2022 and
in consideration of application fee in the sum of$250 00 paid by John & Margaret Krepp and subject to the
Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits
the following:

TERMS AND CONDITIONS
The Permittee John & Margaret Krepp residing at 1235 Island View Lane, Greenport,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

The'Board of Town.T'r'ustees16ok,the following"action during its'regular.'meetin_g.held on
-Wednesday;-January'•19, 2022 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of JOHN & MARGARET KREPP applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated October 28, 2021,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the existing dwelling and
proposed second story addition be found Consistent with the Local Waterfront Revitalization
Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the existing shed be found Inconsistent
with the LWRP, and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program
policy to the greatest extent possible through the imposition of the following Best Management
Practice requirements: the issuance of a permit for the structure; and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 19, 2022, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding'area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirement imposed above, the Board of Trustees deems.fhe action'to be Consistent with the.
Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town"Code,
and,
RESOLVED, that the Board of Trustees APPROVES the-application of JOHN &MARGARET
KREPP to construct a new 28'x27.5' second-story over existing 38.4'x27.3' dwelling; for the
existing-12.3'x19.9' deck attached to the seaward side, of dwelling;.install a drywall in front-yard'

structure is landward of a substantial man-made structure f'

The reta'i'ning wall was there before the Krepps
purchased the' house in July, of 1979. I have pictures of the",
premisesbefore the: 1977 date that show that -the structure
was there. I was unable to locate a survey, show(hq the
structure before that date. I would also ask that you would'
look on the current survey and see that Mr. and :Mrs. krepp
have tried to keep the natural vegetation by the water while
most of his ne i gboas in the area have filled i,t i n. We
share your, concern for , our wetlands and wish to do all that-
we can to protect them. We feel this deck addition will in
no way adversely',;affect the environment. -

WHEREAS, a public hearing was held on April 30, 1991 -and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded;
WAS, the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are -
familiar with the premises in question, its present zoning, and
tale surrounding areas; and
WHEREAS, the Board made the following findings of facts
I. By this application, appellant seeks a variance under
Aztiele ,XXIII, Section 100-239.4E for a proposed open deck -
addition of a size 20 feet wide by 12 feet deep, plus a step and
P];atform, to be set back approximately 29 feet to the retaining
wall, as shown on the sketch submitted for consideration.
2. The premises in question is identified on the ,Suffolk
C94nty Tax Maps as District 1000, Section 57, Block 2, Lot 18,
contains a total lot -area of approximately 9,900 sq. ft. and-road
frontage •of SO -feet.
' 3. The dwelling which exists .is presently set back approxi-'
ma�ely 55 feet from the retaining wall structure and approxi-
mately 47 feet to the front property line.

Patricia Moore, Esq. on behalf of JOHN & MARGARET KREPP requests a Wetland Permit to construct a
new 28'x27.5' second-story over existing 38.4'x27.3' dwelling; for the existing 12.3'x19.9' deck attached to the
seaward side of dwelling; install a drywell in front yard for roof runoff; and for the existing 8.3'x10.2' shed.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the existing shed is INCONSISTENT with
LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The as-built structure was constructed without Board of Trustee review or permit.
The proposed existing dwelling and new second story addition is recommended as CONSISTENT with the
LWRP.
It is recommended that a vegetated, non-turf buffer be established to help protect the quality of the water
body.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

PROPERTY FACTS/DESCRIPTION: The-subject property is an irregularly shaped lotconsisting of two prev,•iously ,
merged parcels and located in an R-40_Zoning District. The certified.survey, dated June 18,2021; shows the prior
lots'entitled Parcel_A 8i Parcel B, and indicates that a total upland.buildable area,is 20,881 sq.-ft. -The lot measures
100.00 feet•along the northerly property line fronting a right,of way,-Measures-399;93:,along the westerly side,
measures-64.58 feet fronting the Cove at Conkling Point along the southerly property line and measures 302.00 feet
along the easterly property line. The`portion of the parcel(Parcel B) is improved with a one-story frame house with
an attached wood deck and an accessory shed in the front yard as shown on survey prepared by Howard W. Young,

BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-

RELIEF REQUESTED: The,applicant requests variances to construct a second-floor addition to the existing house
and to legalize and maintain an accessory wood shed with the following non-conforming setbacks,a 1. A side yard
setback of 6.7 feet for the proposed second story addition from the southerly property line where a 15-foot minimum
setback is required; 2. A combined side yard setback of 24 feet, where 3.5 feet is the minimum required by code;-3.
An as-built accessory shed located in the front yard of a waterfront parcel at 5.2 feet from Island View Lane where
the code requires an accessory shed in the front yard of a waterfront parcel to meet the principal,front,yard setback
of 35 feet,and 4. The as built shed is setback 2.3, feet from the'side yard where a 10-foot minimum side yard setback,
is required by code. .
ADDITIONAL INFORMATION: As per testimony from the property owner,the proposed additions to the house
are a second-floor addition located above the existing house at more than the first-floor. setbacks or less
nonconforming than what already exists.A letter of support was received from a neighbor.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The•Zoning Board of Appeals held a public hearing on.this application on December,2;294 at which time written
and oral,evidence were presented. Based upon all:testimony,,documentation, personal inspection of the property
and.surrounding neigl;borhool,and other evidence,the Zoning 13oard_finds'thefollowmg facts.to be true,and
relevant and makes the following findings;
1. Town Law §267-b(3)(b)(1).. Grant of the,variances will not produce an undesirable change in the character of
the neighborhood gr.a•detriment to nearby properties. The proposed construction is a secotld-floor.additlon above,
an existing residence where the proposed addition is set back a greater distance-than the first-floor footprint of•the-
existing house. The number of bedrooms will not increase. The dwelling will�be redesigned to move two bedrooms
to the,second floor. The legalization of the existing shed is in keeping with other sheds in the neighborhood onahe
waterfront parcels along Island View Lane which typically are located close to the side property lines.and close to
the road, as are the existing sheds on properties both to the north and south of the subject lot. Additionally, the
property on the opposite of the road is undeveloped and the location of sheds close to the road has no adverse visual
impact.
2. Town L--aw-- 267-b(-3)(h)(2): The benefit-sought-by the-applicant for-additions-and-alterations-cannot-beaehiaved_
by some method, feasible for the applicant to pursue, other than area variances. Due to the shape of the property,-
and the setbacks of.the existing residence, any additions to the dwelling would require variance relief. The benefit
sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area -
variances for the as built shed because there is insufficient room in both the front yard and tear yard for a shed to
meet the code required front yard or rear yard setbacks and moving the shed to a 10-foot side yard setback would
locate the shed in front of the house which is not practical or typical of the locations for sheds in'this neighborhood.
3. Town Law §267-bQ)(b)(3). The variances granted herein are mathematically substantial as follows:
a) the side yard setback for the additions to the dwelling represents a 55% relief from the code.
b)the combined side yard setback for the second story addition represents a 31.4% relief from the code.
c)the as built shed side yard setback represents a 77% relief from the code.
d)the as built shed front yard setback represents an 88% relief from the code

However, the existing first floor is currently setback 2.7 feet from the southerly side yard and the second-floor
improvements are proposed to be set back farther than the side yards,of the existing first floor of the dwelling.
The existing first floor currently has a combined side yard setback of 16 feet which is less than what is proposed
for the second-floor addition. Also, the shed located in the front yard is setback from a private Right of Way
cutting through the property and many of the neighboring,waterfront properties have accessory sheds in front•
yards with similarly non-conforming front and side yard setbacks.
4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this
board.
5. Town Law §267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or cong"ptive knowledge of the
.limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and,•adequate.to enable the
applicant to enjoy the benefit of a second-floor addition and accessory shed while preserving and protecting the �
character of the neighborhood and the health, safety,and welfare of the community.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other-ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated' as to its s_igni_ficant_
beneficial and adverse effects upon the coastal area(which includes-all of Southold Town)

affect the achievement of the LWRP policy standards and conditions contained in the consistency
