RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#10078 to construct a 785sq.ft. @grade stone patio with steps (12sq.ft.) and ramp (31sq.ft.) in lieu of the previously permitted 519sq.ft. @grade stone patio; construct three (3) boardwalks; 78.4sq.ft., 221.6sq.ft. & 162.1 sq.ft. with 35.4sq.ft. steps; construct steps to patio (21.5sq.ft.); entirety of rear & side yards to be sand (+/-6,563.9sq.ft) in lieu of previously permitted 10' wide sand non-turf buffer along landward side of existing bulkhead; and as depicted on the site plan prepared by Anthony M. Portillo, RA, dated August 2, 2023, and stamped approved on September 13, 2023. Any other activity within 100' of the wetland boundary requires a permit from this office. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes. The subject dwelling is at the dead end of a private Right Of Way on a parcel that is located 371.47 feet from Peconic Bay boulevard and is not be visible from a public road. Many smaller homes and seasonal cottages on the waterfront side of the street have been improved and enlarged over the years, similar to what the applicant proposes. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Since the location of the existing house is non-conforming, any addition and/or alteration will require the need for area variance relief. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 46%relief from the code for the eastern side yard setback and 18% relief from the code for the northern side yard setback. However, the existing eastern side yard setback is non-conforming and the existing house is situated at an angle to the property line. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code,and the applicant will install an IA sanitary system.
