HomeMy WebLinkAboutLP-11/23/2021 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, November 23, 2021 at 7:00 p.m. This Regular Meeting was held via the Zoom online platform. The public had access to view and listen to the meeting as it was happening via Zoom. If no access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. The public is not allowed to attend, view, or listen to Executive Session. Committee Minutes and Administration  Acceptance of LPC meeting minutes from October 26, 2021 MOTION made by Sam McCullough, seconded by Anne Murray, to accept the 10/26/2021 LPC meeting minutes. Motion carried: 4/0 (LPC members Eric Keil and Kimberly Krupski not present at time of vote)  Next Regular LPC Meeting Date The next regular meeting is scheduled for Tuesday, December 7, 2021 and will be held via the Zoom online platform.  2022 LPC Chair and Deputy Chair recommendation to Town Board HOLD – to be discussed at 12/7/2021 LPC regular meeting Inquiries for Uses or Structures on Preserved Property  SCTM #1000-102.-2-16.3 Santa’s Christmas Tree Farm (Polar Tree Farm, LLC) Request for parking within TPDR Melissa advised LPC that the agenda item was postponed as the request was still under review by the Town’s legal counsel. Stephen Kiely, Esq. attended the meeting and asked to speak. He noted that as per David Behm of NYS Agricultural and Markets, Christmas trees have historically been sold as u-pick. He re-iterated that the parking area proposed within the development rights area will be used 8-14 days during the season and that the LPC can put a timeframe on the use. He said that the main reason for the parking area was to avoid traffic and potential accidents and that Figure 4.7 of the Comprehensive Plan Transportation Chapter shows this area as a high crash location. General Land Preservation None Land Preservation Applications & Potential Applications  EXECUTIVE SESSION MOTION made by Sam McCullough, seconded by Anne Murray, to enter into EXECUTIVE SESSION Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof Motion carried: 6/0 The LPC members entered into EXECUTIVE SESSION at 7:14 p.m. Attendees dismissed. Meeting locked.  Land Preservation Coordinator Melissa Spiro gave updates on inquiries, new applications, appraisals and current applications. MOTION made by Eric Keil, seconded by Sam McCullough, to exit Executive Session. Motion carried: 6/0 EXECUTIVE SESSION PAUSED at 8:09 p.m. MOTION made by Sam McCullough, seconded by Doris McGreevy, to recommend to the Town Board to commission an appraisal for the value of a proposed development rights easement for the project design with an attached building envelope of at least 2 acres for the LPC application presented and discussed while in Executive Session. (Motion No. (2021-7) Motion carried: 6/0 MOTION made by Eric Keil, seconded by Sam McCullough, to re-enter into EXECUTIVE SESSION Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof Motion carried: 6/0 The LPC members re-entered into EXECUTIVE SESSION at 8:10 p.m. Meeting re-locked.
