WHEREAS, this proposed site plan, to be known as North Fork Bank, is for a new 20,895 sq. ft. two-story addition to an existing office building on a 7.46 acre parcel on State Road 25 in Mattituck; and WHEREAS, North Fork Bancorp, Inc. is the owner of the property known and designated as "North Fork Bank", SCTM # 1000-122-6-20 &22; and WHEREAS, a formal application for approval of this site plan was submitted on June 3, 2002; and WHEREAS, the Southold Town Planning Board, on November 6, 2002, determined that this action is classified as Type II and not subject to review under the State Environmental Quality Review Act (Article 8), Part 617; and WHEREAS, the Zoning Board of Appeals granted a variance to construct a 64 foot addition to an existing nonconforming building on January 23, 2003, Application No. 5265; and WHEREAS, the site plan, dated 12/31/02 and last revised 2/13/03, was certified by the Building Inspector on March 8, 2003; and North Fork Bank - Paqe Two - 3/11/03 WHEREAS, the Town Engineer has reviewed the drainage calculations and the Planning Board has accepted his recommendation for approval; and WHEREAS, on November 19, 2002, the ArchitectUral Review Committee reviewed and approved the proposed site plan application; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the Mattituck Fire District, in a letter dated February 18, 2003, requested a fixed ladder, with a minimum height of 20 feet from the ground, be installed on the new addition allowing access to the roof and the applicant, in a letter dated February 26, 2003, has agreed to amend the drawings to provide such access; and WHEREAS, the applicant has offered a Declaration of Covenants and Restrictions, dated January 10, 2003, making provisions for additional parking up to 401 total spaces in the event the Planning Board determines in the future that the additional spaces are necessary to accommodate the usage of the premises; and WHEREAS, a certified copy of the Declaration of Covenants and Restrictions pertaining to the future parking was recorded in the Suffolk County Clerk's Office on February 10, 2003, at liber D00012234 and page number 619, and must be so noted on the deed for lot 22.1; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the surveys, dated December 31,2002 and last revised February 13, 2003, and authorize the Chairman to endorse the final surveys, subject to a one year review from the date of the building permit. No. 5265—NORTH FORK BANK and SUFFOLK COUNTY DEVELOPMENT AGENCY Property Location: 9025 and 8885 Main Road, Mattituck 1000-122-6-22.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: Applicant's property consists of a combined area of 7.467 with 512.54 ft. of frontage facing the Main Road (NYS Route 25) in Mattituck. To the north is the Long Island Railroad; to the west and east, existing residences, and the Main Road to the south. The property is improved with Bank Office Facilities and is situated in the B General Business Zone District. BASIS OF APPLICATION: Building Department's October 22, 2002 Notice of Disapproval, based on elevation plan prepared by East End Drafting and Design dated 9-28-02 and sanitary site plan dated 7-18-02 (before revisions furnished to the Zoning Board of Appeals in January.) The reasons stated in the Notice of Disapproval is that the proposed additions and alterations are to an existing nonconforming building, and the proposed total linear frontage following the proposed construction will be 360+- linear feet. The zoning code limits the frontage of a single structure to not more than 60 linear feet of frontage on one (1) street. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence 'were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Variances are requested under Section 100- 103C based on the October 22, 2002 Notice of Disapproval for a 60 ft. wide extension. Later, the sanitary design map was modified by Joseph Fischetti, P.E. to show 385' linear frontage (total) for a 60 ft. wide extension. Later, by letter dated January 6, 2003, the applicant's request was modified for an increase from the original proposal of 60 ft. extension to a proposed 64 ft. extension, resulting in a change of the total linear footage to 388'4", instead of 385 I.f. No. 5265 - North Fork Bank 1000-122-6-22.1 at Mattituck REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the vadance will not produce an undesirable change in the neighborhood or a detriment to nearby properties. The building has existed for many years with a nonconforming building frontage at least 300 ff. wide. This 64' extension is in line with the existing building, and the existing setbacks are at least 300 feet from the front lot line facing the Main Road and meets or exceeds the side yard and rear yard setbacks of the Code. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is utilized for business, parking and related purposes, and these areas have been established for many years by the bank, as well as former retail businesses. 3. The requested variance is substantial, however, the westerly yard area will be screened with additional landscaping, and all other yard areas will comply with the code. 4. No evidence has been submitted to suggest that this variance will have an adverse impact on physical or environmental conditions in the neighborhood. Additional landscaping is a condition of this approval, and all other yard setbacks will remain the same, as existed for many years. 5. Grant of the requested relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Odando, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, with revisions confirmed in a letter from Joseph Fischetti, P.E. dated January 6, 2003, SUBJECT TO THE FOLLOWING CONDITION: A landscaped area consisting of a minimum 8-12' high evergreens, staggered, shall be maintained within the west yard area, along the proposed 122 ft. addition, for a total length of 170 feet. Town of Southold Planning Board Town Hall Building Main Road Southold NY 11971 December 19; 2002 Dear Sirs, I am the property owner of the parcel at the end of Hobson Drive in Mattituck where: Bank is planning to build an extensioa~at is before the Planning Board for approval at this time. Along with other residents I was at the December 16t~ Meeting on this issue. I asked a question at this meeting regarding the additional parking needed to facihtate this extension and the affect it may have on the neighbors. I questioned the Board if any construction concerning the additional parking would be extended west of the now existing parking lot. I was instructed by the Chairman to consult the Engineer involved in the project who was also at this meeting. We left the meeting and immediately met in the hallway with Mr~ Joseph Fischetti the Engineer, Mr. Gregory Silkis from North Fork Bank and Mr. George Huges another resident on Hobson Drive. Things at this meeting were not very clear~ so M order to clear up any questions it was agreed at this meeting to have the areas marked out on the west side of the Bank where the parking lot work would be done so we could see/f any, the effect it would have on the three existing residentially used homes. This (partial survey of three marking sticks) was completed on the Wednesday after the Friday meeting as planned. After this mark out I think it was news to all onthe block that if the plans are approved as they are, that there will be approximately 26 feet more blacktop added to the westerly direction of the existing lot as it stands now in the most northerly end of the parking lot. This blacktop would be installed where there presently is grass and trees. The area in question is directly abutting 655 Hobson Drive. Approximately ten existing trees and or shrubs will have to be cut down. This will greatly affect the most northerly property at the end of Hobson Drive, the parcel that I presently own. It is on this particular issue I am appealing to the board. The new parking lot curb if constructed will be about Ten feet from the existing patio to my home. This means that even with the curb being four feet off the property line when a; car parks head in at the curb as proposed, with three feet of automobile hanging over the curb the front of the car will be seven feet from a chair on this patio. Not the best thing to happen to your property when previously no cars parked there at all, and if they did it was in a parallel fashion at a distance 26 feet further away. Please note I have no back yard and cannot even relocate where one could sit. My back yard borders the railroad tracks, literally. The original structure may even have predated the railroad. Gentlemen, I am appealing to the Board and I am appealing to the Bank. Please see it in Four mercF if at all possible to at least keep the curb on the easterlF side of the utili02 poles that come to the propertF from main road. You can be sure that none of the residents on Hobson Drive are jumping for joy over the proposed extension of a two-story building being 100' closer to our homes with windows on it when the previous structure had none. The fact that people are looking down at all that you do all day long is a big change from the way it was before, Progress is progress. It is just that you feel that your privacy is a bit violated but what can you do? Having no rear yards on. the last two properties on Hobson Drive we have no choice but to comment on the newly proposed structure and hope for the best. Knowing North Fork Bank and the reputation they have had in the past with the neighbors as was told to me by particular neighbors like Bill Wyche and Mable Miles I am sure the Bank will make it as painless as they possibly can. Please be it known that North Fork Bank has always been an excellent neighbor. This feeling goes way back because most of these residents when I moved in were original families to this area and hved here prior to any building even existing next door. The property at the bank is immaculate and is meticulously maintained. My family and friends have referred it to as North Fork Park. The employees and patrons are clean and respectful to their neighboring residents on Hobson Drive and have never been a problem. I have o~xmed this property since 1994 and in four years intend to retire on Hobson Drive so I am very concerned. Please correct me if I am ~wong because this is not my forte. I understand that the property where the proposed parking lot extension is to happen does belong to the Bank. I understand that the Bank is on Business Property and that the three homes that border this property are also on business property. I am told that we the three residential parcels are non-conforming because this is business property. The Bank is the conforming parcel. I am not sure how this all happened (the B zoning of residential houses in an area where homes existed before any business) because this house at the end of the block was built over 80 years before Bohack ever appeared to Matfituck in the 60's. This home in at the end of Hobson Drive was the original of the three. It was owned by Andy Hobson an old farmer. He actually farmed where the bank now stands before Penny and Wilsberg sold it to build a shopping center years before it became a bank. He also farmed the Graft property to the west of this home that also was not his. The remains of an old barn in the woods still exist and was shown to me by Mr. Hobson's 80 year old daughter. It was said to me that all his relatives thought he was rich. That was till the nearby property was sold off and they found out differently. He was obviously confused about what he owned and what he didn't which is evident by where he chose to locate the house on the property. Which now has become after a hundred years of never being an issue, my sudden dilemma. I will be meeting with the bank, I hope, when Greg Siliris their representative gets back to me. The site plan sent to me by your office did not include the drainage calculations for the proposed construction. Joe Fischetti Jr. is the project engineer and his office supplied me with two (2) copies of the site plan with drainage calculations. I will return one copy with this report for your reference. If this document is not currently on file with the Planning Board, please let me know. Drainage structures have been provided to service the new addition as well as all new parking areas. The drainage calculations on the enclosed site plan meet the minimum requirements of the Town Code. The paved parking areas proposed on the site plan should maintain a four (4') foot minimum separation from adjacent property line. This is noted in Section 100-214 (B) with regard to Landscaped parking areas. The site plan indicates that a majority of the proposed new parking spaces would encroach much closer than four (4') feet and violate this requirement. I would also look at the southeast corner of the proposed addition. This corner appears to be approximately 50' from the property line. If you provide for and add up the total distance of items between the building and property line you would need 52'. These items would include a 4' landscaping strip, 20' parking, 24' travel lane and 4' of sidewalk. As you travel further north the problem becomes less severe but I would recommend that you look at this issue further. Will any additional safeguards be installed at or near the corner to protect the building from normal traffic patterns? It also appears that a travel lane this close to the building might not be considered an appropriate fire lane for access of emergency vehicles.
