A regular meeting of the Southold Town Board of Appeals
was held at 7:30 P.M. (E.D.S.T,), Thursday, September 23,
1976, at the Town Office, Main Road, Southold, New York.
There were present: Messrs: Robert W. Gillispie, Jr.,
Chairman; Robert Bergen; Fred Hulse, Jr., Charles Grigonis, Jr.
Also present: Sam Campbell, S~ffolk Weekly Times; Sherley
Katz, Long Island Traveler-Mattituck Watchman.
On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that the condition of the action upon Appeal No.
2148, John and Erma Gabusi, be AMENDED to read:
The proposed building shall be no closer than 10' from
the westerly side yard, no closer than 77' from Peconic
Bay Boulevard, and no closer than 56' from the easterly
side yard.

The Chairman opened the hearing by reading the application
for a variance, ~egal notice of hearing, affidavits attesting
to its publication in the official newspapers, and notice to the
applicant. The Chairman also read statement from the Town Clerk
that notification by certified mail had been made to: Eenry L.
Ferguson Museum, Inc.; Louis & George Montzoures; Angelo Poutis.
Fee paid - $15.00.
THE CHAIRMAN: The application is accompanied by a sketch
showing the proposed division. One parcel will have .49 acres
and the other parcel will have .34 acres. Presumably, it's-the
only way this parcel could be divided.
Is there anyone present who wishes to speak for the

After investigation and inspection the Board finds that
the-applicant requests permission to divide property with existing
buildings, West Street and Equestrian.Avenue, Fishers Island, New
York~ 'The~findings of the Board are that this will not change
the character Of the area. The~e is no change in the exteri6r
appearan'ce and the structural aspect of the building, it is merely
a division ~of existing property.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the:hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.

the Zoning Ordinance, Article III, Section 100-30 and Bulk
Schedule for permission to divide property with insufficient
width and area. Location of property: east side Depot Lane,
Cutchogue, New York, bounded on the north by Zaneski; east by
Zaneski; south by Sacred Heart Church and Cemetary; west by
Depot Lane.
The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavits ~ttestinq
to its publication in the official newspapers, and notice to-the
applicant. The Chairman also read statement from the-T~ Clerk
that notification by certified mail had been made to: ~acred
Heart Cemetery; Paul and Bertha Orlowski. Fee paid - $15.00.
THE CHAIRMAN: Is there anyone present who wishes to
speak 'for this application? Mr. Isaacs, do you have anything
to add?
CLIFTON ISAACS: This was two lots to begin with. The
lot that I have my house on now, the other lot was the same
size, but I acquired that later, and now it's all one. It was
two different lots.
THE CHAIRMAN: You acquired the other lot by inheritance?
CLIFTON ISAACS: Right, from my father-in~l~w. He had a
160' lot~ He wanted to divide, it up into two lots~in case her
(indicating to his w~f~ younger sister wanted to build there.
She never did, and we wanted to get the lot if she didn't want
it and we did acquire the lot later. We built ~u~ house on the
other one.
THE CHAIRMAN: How long had he owned the lot?

CLIFTON ISAACS: We built our hause in 1958.
THE CHAIRMAN: And he owned the lot before that, or rather,
the two lots.
CLIFTON ISAACS: Yes.
THE CHAIRMAN: So when you built, he cut off half and gave
it to you and retained the other half?
CLIFTON ISAACS: With the option that we could get the
other half if her sister didn't want it, and we did get it.
THE CHAIRMAN: But actually, for these past 19 years or
so ... when did he die?
JOSEPHINE ISAACS: About three years ago.
THE CHAIRMAN: So about three years ago you acquired the
southern half and now you want to build on the southern half
and do you want to sell...?
CLIFTON ISAACS: No, we're going to keep it.
THE CHAIRMAN: You're going to keep it in your own name?
CLIFTON ISAACS: Yes. I want the lots separated back like
they were. There were two lots to begin with, I don't know how
but they were made into one big lot.
THE CHAIRMAN: For zoning purposes, when you own a piece
and you acquire the piece next to it, it all becomes one piece,
legally. You want to separate them out again.
CLIFTON ISAACS: In other words, it wouldn't be legal to
build a house there now. I couldn't sell it anyhow because it's
not 100' front. That 100' deal went in right after I built my
house.
THE CHAIRMAN: The original was 100' by 125' in 1957.
Does anyone wish to speak against this application?
(There was no response.)
After investigation and inspection the Board finds that
the applicant requests permission to divide property with in-
sufficient width and area, east side Depot Lane, Cutchogue, New
York. The findings of the Board are that this is a reasonable
request. The area directly across from this property consists
of undersized lots and several of the adjoining lots to the
north are also undersized. It will not harm the character of
the area.

The Board finds that strict application of the Ordinance

upon application of William and Alysse Johnston, 8 Larkspur
Drive, West Islip, New York for a variance in acCordance with
the Zoning Ordinance, Article III, Section 100-30 and Bulk
Schedule for permission to relocate building with insufficient
setback. Location of property: Haywaters Road Extension;
Lot ~17, Peconic Bay Properties.
The Chairman opened the hearing by reading the applica-
tion for a variance, legal notice 0f hearing, ~ffida~its

attesting to its publication in the official newspapers, and
notice to the applicant. The Chairman also read statement from
the Town Clerk that notification by certified mail had been made
to: John J. O'Neill. Fee paid $15.00.
THE CHAIRMAN: In trying to understand this, when I went
over it with the Town Attorney this afternoon, I came across the
statement here that the guest house will remain on Lot 917, yet
I think that what the applicant wants, I know he wants, is for
it to remain on Lot ~18.
ROBERT BERGEN: Is Lot 918 the lot that the house is on
now?
WILLIAM WICKHAM, ESQ: Yes. We beg your pardon, we would
like to correct that. We want the guest house to remain on
Lot #18 and the main house moved over to Lot ~i7.
(The Chairman corrected the application.)
THE CHAIRMAN: The application is accompanied by a survey
from Van Tuyl, dated March 31, 1976, indicating that the appli-
cant owns Lots ~17 and 18 of~the original filed map and that
Haywaters Road progresses through the two lots. The applicant
has build a residence which~p~o .be half on the 1931 filed
map line and half on some-la~ thai'Was ~"found". Some of the
other lines on this map will require careful evaluation. The
survey indicates considerable accretion of sand southwest of the
original 1931 line.
Is there anyone present who wishes to speak for this
application?
WILLIAM WICKHAM, ESQ.: I think the best way to approach
this is a briefing on what has transpired. Incidentally, the
house has been erected and we have a C.O. on it.
THE ~HAIRMAN: How long has the house been erected?
WILLIAM JOHNSTON: It was started in 1972.
THE CHAIRMAN: Does it get flooded?
WILLIAM JOHNSTON: No, it's very high. It's about the
highest spot on the point there.
WILLIAM WICKHAM~ ESQ.: What Mr. Johnston intended to do,
originally, before the Trustees, was to put a retaining wall
part way Up from the hi~hwater mark.~ When we went before the
Board of Trustees, those hearings sort of deteriorated and it

became a question of the title to the land, the accreted land.
~nd just as soon as it became a title matter, we asked that it
be tabled because then it became a matter for the Supreme Court,
not for the Board of Trustees. Then we had a hurricane which
took quite a swipe ...
THE CHAIRMAN: Which one?
WILLIAM WICKHAM, ESQ.: Belle. It took quite a swipe of
the west side here, from the Bay. That prec±pitated further
thinking on the matter and we felt that the best solution would
be to move the main house to Johnston's Lot #17. That is our
proposal.
(Mr. Wickham and the Board then discussed the present
location of the buildings and the proposed location of
the main house.)
Another reason for the locations is the fact that our
cesspools are right in this area (on map) and there was some
difficulty, although we did get approval from the Board of
Health for them, and we didn't want to disturb them in any
way. It would be quite easy to move the main part of the house
over here. We have a water line coming out from the upland and
there's no problem in connecting that.
THE CHAIRMAN: Are there bathroom facilities in the guest
house?
WILLIAM WICKHAM, ESQ.: That's all. The main facilities
are, of course, in the residence itself.
THE CHAIRMAN: Part of this is to solve the question of
titles?
WILLIAM WICKHAM, ESQ.: The question of solving title and
also the question of getting away from any further inroads of
inundation.
ROBERT BERGEN: And they won't let him bulkhead it?
WILLIAM WICKHAM, ESQ.: That's right.
THE CHAIRMAN: Why would part of this building extend over
the old line if you're going to clear the title?
WILLIAM WICKHAM, ESQ.: We don't mean it to, it really cuts
close to it. We feel that we own that accretion but we're stayihg
on this side of the line.
THE CHAIRMAN: Why would you locate the building directly
on the roadline? Would there be any objection to taking it off

the roadline? Don't some of the other residents have the right
to use the road?
WILLIAM WICKHAM, ESQ.: This road is not a public road.
It is true that the residents do have the righ% to use it. They
haven't used it, of course there's not much room for them to get
around here with the bulkhead and all, and we felt it couldn't be
used by vehicles, the only thing it could bemused for is walking.
We also have another thought for the future and that is to, and
this will take a little time, would be to try to relocate the road
in this area. That would have to be done simply by consent of the
residents. The public does not come into that part of the picture
at all, s~mply the residents on Fishermans Beach.

WILLIAM WICKHAM, ESQ.: There's still a question ...
THE CHAIRMAN: Wouldn't you want to move this off the line
a few feet too?
WILLIAM JOHNSTON: That wouldn't bother us.
THE CHAIRMAN: This is lower than the area that you're
moving to, it looks two or three feet lower, but that won't
affect you because the building's going to be on piles, correct?
WILLIAM JOHNSTON: Well, we were thinking of putting a
cement block foundation in but it would have to be high enough
to get the right slope.
THE CHAIRMAN: Does anybody have block foundations down
there?
JOHN O'NEILL: t do. It's never been flooded.
THE CHAIRMAN: Where are you located? Are you high~k than
this location?
JOHN 0'NEILL: Than Lot $177 Yes. I have 48" of crawl
space under my house which can be used for storage and we've
never had water in it.
THE CHAIRMAN: What keeps it out?
JOHN O'NEILL: The water has never been that high. It
just doesn't get there. During the hurricane, the bay side
came up within 15' of the house.

THE CHAIRMAN: But that was a very moderate hurricane.
JOHN O'NEILL: But I'm not speaking of that one, I'm talking
about the Others that came across.
WILLIAM WICKHAM, ESQ.: You mentioned about the house
being close to the road. We did it for two reasons. One is
that we want to be as close to our pools as we could. Secondly,
there is a precedent down there because there are two houses
close to the road.
THE CHAIRMAN: I think we'd like to see it at least 10'
off the road.
WILLIAM WICKHAM, ESQ.: The main part of ~he house? These
are steps coming down here, do you object to that?
THE CHAIRMAN: No~ as long as the house is 10' off. Does
that bother you?
WILLIAM JOHNSTON: Here is the house itself (on map) and
if we come ... it's hitting on this corner, right on the front
beach here, and if we come 10' down this way, we have to go
much closer to O'Neill's.
(The Board and Mr. Johnston discussed the proposed
located of the main house.)
THE CHAIRMAN: Can you change the road?
FRED HULSE, JR.: The only place you can change it is on
this piece of property. It can't be changed on anybody else's.
WILLIAM WICKHAM: Well, we own the property. We own
everything in here as far as that goes, it's just a question of
straightening it, but there's a limited time now, and we'd like
to get the building moved.
THE CHAIRMAN: Of course, these maps don't show the way it
is. Belle carved something out here, andthe highwater mark is
much closer now. Mr. O'Neill, do you have any objection to
locating this house on the road like that?
JOHN O"NEILL: No, I don't. I think that's the best living
arramgement for both the Johnstons and myself. Having been down
there, I guess you realize that it's rural, almost isolated. I
know the area going back to 1940, and it's been there ... I doubt
if the road is 12' wide all the way down, and each propertY owner
assumes the responsibility. There are no disputes abou~ the road.

FRED HULSE, JR.: Although this shows right on the roadline
here, the traveled road is, I think, over here somewhere. And
I don't see why the neighbors would be concerned. They've all
got waterfront, they're not going to drive down in your yard to
get to i~.
THE CHAIRMAN: The original thinking down here was that
there were to be plots on the southerly side and there would be
access to the inner harbor on the northerly side. Then they
started to build houses on the inner harbor on the northerly
side.
WILLIAM WICYJ/AM~ ESQ.: The original thought on Fishermans
Beach was a horribl~'mess and it's caused nothin~ but difficulty
with title and everything else. .When they filed the map, the
filed map is alright, but then some joker put in proposed fill
lines and nothing was ever done, there's just no title here or
anything else. It's just made a mess. The title company will
not insure it. It's just a line as far as I'm concerned. There
are a few houses along here, there are some lots that are just
for boating, but this proposed fill line has caused more diffi-
culty than anything else.
THE CHAIRMAN: Anyone else wish to speak? Anyone wish to
speak against this application?

units on Lots ~17 and 18, which are hereby combined
in this action.
2. Neither the guest house or the relocated main house

THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
RICHARD WILTON: I guess I should say something for it
in the way of explanation of what we're doing. My plan here
takes the 73-site plan which was previously approved by every-
body and by overlaying the colored section (on map) it fills in
the lands that we have not occupied before. It completely meets
all the regulations of the Town ordinances.
THE CHAIRMAN: This was the resolution of the Plan~ing
Board on September 20, 1976:

THE CHAIRMAN: This hasn't been to the Planning Commission
yet, has it.
RICHARD WILTON: No. Does it have to?
THE CHAIRMAN: Yes. Let me see the action from Section I.
(The Chairman reviewed the action.)
How many sites will there be?
RICHARD WILTON: 124. That's all I can get in there with
the present ordinance.
THE CHAIRMAN: I think that figure for 162 campsites came
from the original thinking of the Planning Commission.
RICHARD WILTON: 162 is what we're entitled to based on
the "M-l" catagory and the number of acres.
On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that the Southold Town Board of Appeals RESERVE
DECISION upon application of Eastern Long Island Kampgrounds, Inc.,
Appeal No. 2185. The Board indicated that, in general, they
looked favorably upon the application.
Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse,
Grigonis.
Three (3) Sign Renewals were reviewed and approved as
submitted.

Article III, Section 100-30 and Bulk Schedule and requirements
of' "M-l" and "B" zones for permission to reduce setback on
buildings, Appeal No. 2107, 2186-2194; also for permission to
locate parking in front yard area, Appeal No. 2195-2202. Loca-
