Dear Ms. Morrow,
I received your correspondence and site plan for the proposed "The Enclaves" project in Southold and
have reviewed same.With regards to these plans, I have the following concerns:
■ The proposed location is a heavily traveled portion of State Route 25 and I am concerned with
the volume of traffic that a 40-unit hotel and a restaurant would add to this stretch of roadway.
■ Your plans do not show the Seven-Eleven convenience store that is directly across Rt. 25 from
the entrance and exit of the site,which generates a significant amount of traffic and can be
difficult entering and exiting Rt. 25 from their lot.
■ The proposed special events,such as weddings,would have an impact on this portion of Rt. 25
also with extra traffic and limousines/buses attempting to enter and exit the site.Weddings and
live music also traditionally bring noise complaints from neighbors to our department and I
would not anticipate this being any different.
■ The one sector car that patrols Southold,which extends from Peconic Lane, Peconic to the west
and Chapel Lane,Greenport to the east,would see extra activity with a hotel that is filled to
capacity,and a busy restaurant, even if it is just with service calls.
■ I would also expect that visitors to this hotel would also prefer to use beaches in the area,
especially within walking distance.The public access beaches at the end of Town Harbor Lane
and the Wharf House are already over-crowded and have spilled over to adjoining private
property beachfronts.

The Suffolk County Water Authority(SCWA)appreciates the opportunity to comment on the
FEIS for the captioned project.
Our agency would like to reiterate the comments made in our November 5,2019 correspondence
.as they relate to water conservation and reducing irrigation usage by using smart irrigation control
systems and more importantly to this project,utilizing an on-site irrigation well for all irrigation needs.
Additionally, as the revised DEIS of October 2019 indicated,monitoring wells would be
installed,both upstream and downstream of the proposed on site STP. SCWA supports the use of
monitoring wells.

The Suffolk County Water Authority(SCWA)would like to thank you for the opportunity to
comment on the DEIS for the captioned project.
In August 2017 SCWA relayed concerns about the amount of potable water to be used for
irrigation purposes and recommended that an irrigation well be used for all irrigation needs. SCWA also
recommended the use of smart irrigation control systems and the use of drought tolerant plants to
promote conservation.
The DEIS as submitted indicates that the proposed development will utilize an existing irrigation
well if viable, or install a new irrigation well if needed. The document also conveys the applicant's
desire to use smart irrigation controls and drought tolerant plants.
Our agency is pleased that the applicant is following through on SCWA's recommendations and
request that the project use low flow plumbing fixtures to further our conservation efforts.
The proposed action also includes the construction of an on-site STP to accommodate all sanitary
waste,with groundwater monitoring wells installed both upstream and downstream of the effluent
disposal system. SCWA strongly supports these monitoring efforts.

The Suffolk County Department of Health Services (SCDHS; "Department") has received your
letter dated October 7, 2019 concerning the above referenced Draft Environmental Impact Statement.
Based on a review of the subject coordination, the Department offers the following comments.
However, the Department wishes to reserve its right to provide more detailed information within the
comment period(s) established for this action. These comments should not be construed as an implicit
SCDHS approval or rejection of the project. All applications are reviewed thoroughly with respect to

A. Article VI Application Status:
The Department has not received a commercial wastewater application for the above referenced
project, as required by Article VI of the Suffolk County Sanitary Code. The project sponsor should
submit an application that meets Article VI density requirements to our agency's Office of Wastewater
Management at the earliest possible date so that a complete technical assessment of this proposal can
be undertaken.

B. SCDHS Jurisdiction
The SCDHS maintains jurisdiction over the final density and use, and the design of the sewage
disposal and water supply systems. The applicant, therefore, should not undertake the project without
Health Department approval. Density, design and flow specifications, location, subsurface soil
conditions, and complete site plan details are essential to the review of this project. These
considerations are reviewed completely at the time of SCDHS application.

In response to a Notice and Demand issued by this Department for the discontinuance of conditions
conducive to lead poisoning, a final inspection was performed on 6/14/2019 at the above referenced
location. The required corrections in the notice have been satisfactorily abated and all dust wipe
clearance testing has passed.
Please also be aware that the federal Residential Lead-Based Paint Hazard Reduction Act, 42 U.S.C.
4852d, requires sellers and landlords of most residential housing built before 1978 to disclose all available
records and reports concerning lead-based paint and/or lead-based paint hazards to purchasers and tenants
at the time of sale or lease or upon lease renewal. This disclosure must occur even if hazard reduction or
abatement has been completed.
Failure to disclose these test results is a violation of the U.S. Department of Housing and Urban
Development and the U.S. Environmental Protection Agency regulations at 24 CFR Part 35 and 40 CFR
Part 745 respectively, and can result in a fine of up to $11,000 per violation. If you wish to find out more

RE: Special Exception Review—The Enclaves Hotel & Restaurant Draft Scope for
Draft Environmental Impact Statement (SEAR).
The Planning Board, as an involved agency for the action, has reviewed the Draft
Scope of Work (Scope) dated February 20, 2018 and provides the following comments.
1. Remove references to the Southold Comprehensive Plan 2020. This plan is a
draft and has not yet been adopted by the Town Board, and is not yet an
official plan of the Town.
2. Page 6. Ecological Resources: Require wildlife surveys to be conducted in
appropriate seasons.
3. Page 7. Impacts on Transportation: Include an assessment on truck
management and routing, including awareness of area speed limits, school
zones, vehicle noise and Jake braking and movements through the Southold
hamlet and area neighborhoods. Trucks involved in construction,
maintenance and operations (deliveries) to the site should be included.
Discuss if large vehicles (limousines and buses) would access and park on-
site and how the action accommodates for interior circulation and parking of
such vehicles.

Include an assessment of on-street parking on the north and south sides of
NYS Route 25 in the parking analysis and the potential impact to the adjacent
properties. Include an assessment if the 74 seat restaurant, the proposed 25
and 2 handicapped parking spaces are sufficient for employee and customer
parking. Consider safety of pedestrians crossing NYS Route 25 if patrons of
the restaurant are expected to park on the south side of NYS Route 25.
4. Page 11. Land Use Zoning and Plans: Add Long Island North Shore Heritage
Area Management Plan.
It is our understanding that the applicant is proposing an On-site Biological Engineered
Single Sludge Treatment System (FEAF 4/13/17). We will reserve our concerns
regarding impacts to groundwater and surface waters until more information on the
system is provided.

Thank you for requesting the comments of the Division for Historic Preservation of the Office of
Parks, Recreation and Historic Preservation (OPRHP). We have reviewed the submitted
materials in accordance with the New York State Historic Preservation Act of 1980 (section
14.09 of the New York Parks, Recreation and Historic Preservation Law). These comments are
those of the Division for Historic Preservation and relate only to Historic/Cultural resources.
They do not include potential environmental impacts to New York State Parkland that may be
involved in or near your project. Such impacts must be considered as part of the environmental
review of the project pursuant to the State Environmental Quality Review Act (New York
Environmental Conservation Law Article 8) and its implementing regulations (6NYCRR Part
617)
We note that 56655 Mains Road (aka Lester Albertson House) is eligible for listing on the State
and National Registers of Historic Places. Attached please find a copy of our Resource
Evaluation for your use. We have reviewed the proposed plans provided for The Enclaves.
Based upon this review, we understand that the historic house will be retained and developed
into a restaurant.
In accordance with the State Historic Preservation Act, we review projects in accordance with
the Secretary of the Interior's Standards for Rehabilitation. We use these Standards to
determine if a proposed project is appropriate for an historic property. These Standards are
guidelines issued by the National Park Service that guide the decision-making about proposed
work or changes to historic properties. The basic concepts are: retain existing historic
materials, repair damaged historic materials and replace any materials deteriorated beyond
repair (in-kind where possible). Our comments will always be based upon our review of the
project in accordance with these Standards. As such, we offer the following comments and
request some additional information:
1. Please provide Clear color photographs illustrating all areas to be affected by interior and
exterior work. Photos of the general project area should be accompanied by detail images

where work is proposed, particularly when a potentially historic feature is planned for
replacement or alteration. All photographs should be labeled and keyed to a site or building
plan indicating the location and direction of each image. If submitting a large number of
photos, we recommend combining them into a single document (Word or PDF format)
before uploading.
2. Please provide further details on the proposed front door on the South Elevation. This is the
historic entrance and should be retained and repaired rather than replaced.
3. We note that many changes are proposed for the East Elevation. Please consider the
following:
a. The first story window at the rear of the main building, before the ell, should retain its
historic appearance, location and size.
b. The proposed addition connecting the ell off the main building to the detached one
story structure should have a roof line that is differentiated from the historic ell.
Perhaps it could be constructed just below the eaves of the original ell roofline
c. Please reconsider the proposed change in roofline to the currently detached one
story structure. It provides a false sense of history. We would prefer the roofline to
remain unchanged.
4. On the proposed West Elevation, we have the same comments regarding the proposed
rooflines. We also notice that the ell porch is proposed to be enclosed with glass. We have
no concerns with the proposed infill but would like additional information on the impact to the
existing historic windows and door.
5. On the interior, please consider making a few changes as possible. The historic interior of
this building has very good integrity and we would like to retain as much of this as possible.
Once we have the requesting interior photos, we will have a better idea of our specific
concerns. Please carefully consider items such as the historic staircase, interior trim, doors,
windows and retaining the general layout of the house.
6. We have no archeological concerns or architectural concerns with the proposed new
construction. As such, we have no further comments regarding the new building's
construction.
At this point, please consider our comments regarding the proposed rehabilitation of the historic
house and provide additional details regarding the proposed rehabilitation.

Summary Statement:
As noted in a July, 1995 evaluation (which identifies the house at an outdated street address): "The Albertson House
meets National Register Criterion C as an intact example of early-mid nineteenth century vernacular architecture in the
Town of Southold. The house, which is documented on the 1858 map of the area, is a side-gable, five-bay, center-
entrance type with two-over-two sash windows and Italianate details including bracketed, overhanging eaves; round-
arched attic windows; and a bay window on the west side. A one-story gabled wing extends from the rear. The front
entrance consists of a single door with sidelights and a wide surround decorated by a rope (or egg and dart) molding. . .
More recent alterations include a Colonial Revival entry porch and wide exposure shingles. The house overall has
retained a high level of integrity and remains an important example of its period and type in Southold. The siting close to
the road is typical for houses of this period."
Photos more recently submitted show baseboard trim, wood paneling below windows, paneled doors with 19th-C
hardware and low ceilings which support an early-19th century construction date. The form of the house with the roof
ridge parallel to the road suggests that the original architectural style was Federal. The house was updated in the
Italianate style with new 2x2 windows, the bay window and an Italianate newel post on the interior staircase. Colonial
Revival features include arched doorway surrounds on the interior, possibly the narrow plank wood flooring, and the
porch posts.

National Grid has entered into a administrative consent order with the NYSDEC to evaluate
environmental conditions at a number of non-MPG gas sites in NYC and U. Site Location: The
Southold acetylene gas facility site is located at 370 Hobart Road, Southold, Suffolk County.
Site Features: The Site, which encompasses approximately 0.21 acres, is privately owned and
includes a two-story family house and single bay garage. The rest of the property is covered
with grasses, shrubs and several trees. The property is bounded by privately owned properties f
in a residential community. Immediately to the south of the Site is a palustrine wetland with
standing water impounded by a culvert which connects to Town Creek, an irregularly flooded

estuarine wetland. Current Zoning/Use(s): The property is zoned residential and has been
residential since at least 1947. Historical Use(s) and Source(s) of Contamination: The {

acetylene manufacturing facility, which was operated by the Southold Lighting Company (SLC)
from 1906 to 1921, produced acetylene gas for the surrounding community. Long Island
Lighting Company (LILCO) purchased the property from SLC in 1922. Historic records indicate
the acetylene plant had ceased operations by the end of 1922. Site Geology/Hydrogeology:
Depth to groundwater at the site is approximately 6 feet below grade. The apparent
groundwater flow direction is south/southeast. The field work associated with the approved
Site Characterization (SC) work plan was completed in mid 2008. A supplemental investigation
was completed in September 2009. The SC report was approved in September 2011. The
Department issued a release letter to National Grid on October 26, 2011.

Site Environmental Assessment
Nature and Extent of Contamination: The findings of the Site Characterization (SC) that was
conducted at the site revealed that a number of organic and inorganic compounds are present
at the site in surface soil and subsurface soil at levels that exceed the Residential SCOs.
Certain polycyclic aromatic hydrocarbons (PAHs), arsenic, chromium, and mercury were
present at levels above Residential SCOs in a limited number of surface and subsurface soil
samples. These exceedances are located in areas of fill material and appear not to be related
to the former acetylene gas production/storage operations. Areas of spent lime have been
determined to exist in the shallow sub-surface soils throughout the site. The spent lime is the
waste product associated with the acetylene production process. The lime is considered non-
hazardous. Groundwater contained relatively few detections of any contaminants. The pH of
the groundwater below the property is elevated (10.92) due to the spent waste lime that has
been historical disposed of on the site. Volatile organic compounds (VOCs) were detected in
indoor air and, to a lesser degree, in subslab soil vapor, at elevated levels. VOC levels in
indoor air were generally higher than the levels in sub-slab soil vapor, indicating that soil vapor
intrusion is not occurring. Soil vapor outside the house contained several VOCs. It appears the
source of the VOCs is not related to historic acetylene gas production operations. Some
contaminants of potential concern (COPCs) exceeded the Protection of Ecology SCOs.
However, the NYSDEC Decision Key (to determine the need for further ecological
investigation) concluded that a Fish and Wildlife Impact Assessment is unnecessary, because

Your notification for SEQR Coordination was received and reviewed by our agency.
Please be advised that our agency,the Suffolk County Water Authority,has no objection to the
Zoning Board of Appeals for the Town of Southold assuming Lead Agency status for the project
captioned above.
In SCWA's review of this project as submitted, our agency found-no appreciable impacts on
groundwater qqLliiy that would affect our operations. However, in keeping with the SCWA's mission of
protecting and conserving the Town of Southold's water supply and consistent with the SCWA's Water
Supply Plan and recently adopted East End Water Wise Club plan, SCWA recommends including limits
on the amount of fertilizer dependent vegetation maintained on site and also encourages the use of low
flow plumbing fixtures, if it is not already a requirement by the Town.
It is my understanding through staff that obtaining accurate water usage for this project was
somewhat challenging. That being said,the final anticipated water demand provided is quite high,
particularly if the irrigation demand of 150 gpm is accurate.
The applicant's consultant had indicated to Heather Lanza that an irrigation well could be
installed to reduce the impact on SCWA. SCWA would strongly encourage that the applicant be
required to do so.
SCWA welcomes the opportunity to meet with the applicant to discuss these concerns.

goes,Potable water stays at the 7,500 gpd.As for irrigation water it looks like 150 gallons per minute would be more

Note: Water usage calculations (even without irrigation) should be more than waste water calculations. That is not the
case in the data provided. Applicants typically make the number the same (without irrigation)which is always wrong
but the health department and others never correct them.

We received your paper submissions for The Enclaves Hotel. We are now using an all-online system,
CRIS, to process Environmental Consultation reviews. Please submit all projects directly into CRIS,
and share this information with all others in your office. You will find a link to the system and a link
to a tutorial on our website --www.nysparks.com/shpo/online-tools/.
While you can submit projects to CRIS as a guest, registering will save time in the future if you are
going to be working with the system on a long term basis. See information at the end regarding
registration. Several tips:
• For an existing project, find the "Submit" tab at the top and choose "I would like to submit
information to SHPO for an existing project:" Sign in with your email and the project number.
• For new proiects, begin by using the "Submit" tab on the landing page and choosing
"Consultation Project."
• Please include contact information for anyone who should receive communication about
findings, and that includes staff at any permitting or funding agency. For SEQRA submissions, it
is important to include a contact for the municipality, such as the chair of the planning board

for the above referenced project pursuant to the State Environmental Quality Review
Act (SEQRA) of the Environmental Conservation Law and its implementing regulations
(6NYCRR Part 617).
This-Department has no objection to the Town of Southold assuming lead agency status
for this action.
Please advise the applicant that this project will require coverage under NYSDEC's
State Pollution Discharge Elimination (SPDES) General Permit (GP-0-15-0001) as well
as NYSDEC's General Permit for Stormwater Discharges from Construction Activity
(GP-0-15-002). If the applicant needs more information regarding these SPDES
