BOUNDARY LINE AGREEMENT

This Agreement is made this day of August 2021 and between LOUIS
GIANCONTIERI and DONNA GIANCONTIERI residing at 171 Sterling Street,
Greenport, NY 11944 ("Owner") and JOHN A. CITERA and LAURIE MCNEIL residing
at 173 Sterling Street, Greenport,NY 11944("Neighbor")
A. Owner is the owner of real property commonly known as 171 Sterling Street, City
of Greenport, County of Suffolk. State of New York, more particularly described
in a deed dated 5/7/2013 recorded on 5/21/2013 in Liber 12730 Page 335
("Owner's Property"), which property is shown on the attached survey map dated
5-2-3013 made by Kulhanek& Plan, Land Surveyors,P.C., (the"Survey'

B. Neighbor is the owner of real property commonly known as known as 173 Sterling
Street, City of Greenport,NY, County of Suffolk,New York, more particularly
described in a deed dated 0-11-RoIC13 recorded on $12511993 in Liber 11641

There is a€enee driveway that extends 7 inches East over the Owners Westerly
line lying within the boundaries of Owner's Property.
C. The parties wish to establish the common boundary line between Owner's Property
and Neighbor's Property.
NOW THEREFORE, in consideration of the premises and mutual promises made in this
Agreement, and the sum of One Dollar($1.00) and other good and valuable consideration by
each of the parties to the other in hand paid, the receipt and sufficiency of which is hereby
acknowledged, the parties covenant and agree as follows:
1. The Neighbor hereby conveys, releases and quit claims unto the Owner and
Owner's successors and assigns forever all of Neighbor's right, title and interest in and to:
The driveway lying 7 inches East of the Owner's Westerly boundary line, which boundary line
runs between tax map # 1001-3.4-16 and 1001-3.4-17 shown on the survey.
2. Owner hereby conveys, releases and quit claims unto the Neighbor and Neighbor's
successors and assigns forever all of Owner's right, title and interest in and to:
The driveway lying 7 inches East of the Owner's Westerly boundary line, which boundary line
runs between lots 1001-3.4-16 and 1001-3.4-17 as shown on the survey.
3. The placement of the driveway upon Owner's Property does not and shall never
ripen into nor become a right to use any portion of the Owner's Property by the Neighbor, but is
and shall continue to be only a use by sufferance of that portion of the Owner's Property.

4. The parties agree that this Agreement will inure to the benefit of the mortgagees,
current or future, of their respective Properties.
IT IS MUTUALLY COVENANTED AND AGREED by the parties that this Agreement
shall run with the land and inure to the benefit of and be binding upon the parties, their heirs,
distributees, legal representatives, successors and assigns.
