SCTM#1000-57-2-26 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under,consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without tirthdr steps under SEQRA. SUFFOLK COUNTY'ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 1-4-14 thru A 14-25,and the Suffolk County Department of Planning issued its reply dated August 10, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency- review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.The LWRP Coordinator issued a recommendation dated November 18,2021.Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, if is recommended that the proposed action is INCONSISTENT with LWRP policy stands and therefore is INCONSISTENT with the LWRP. The LWRP Coordinator made the following comments in his report:- Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of coastal location, and minimizes adverse effects of development. Policy 4.1 Minimizes losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures sway from flooding and erosion hazards. The proposed reconstruction is not supported by these policies due to: 1. Increase in structure over the permitted 20 percent lot coverage on a nonconforming parcel within the FEMA Flood Zone AE EL 6 ft. is unsupported. Structure within these areas suffer damage and loss over time from storm events; including hurricanes and should be minimized. Approval of the proposal is not consistent with Policy 1 and 4.2 in that it would set precedent in the area to expand structure in special flood hazard areas. Homes located in special flood hazard areas have a 25 percent chance of suffering flood damage during a normal 30-year loan according to FEMA. Chapter 275 Wetlands And Shoreline requires a 100 ft. setback to protect the natural feature. There is ability to relocate the Structures landward. 3. The proposal for 4 bedrooms and 5.5a OWTS?baths should be assessed to the current sanitary system on-site. What is the timing of install of the I/A OWTS? In the event the action is approved,SLOSH(Sea,Lake,and Overland Surges from Hurricanes NOAA National Storm Surge Hazard Maps)mapping indicates that the entire parcel would be affected by a Category 1 Hurricane and build out should be designed accordingly. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the,consistency of the proposed action. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 25,496 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 75.00 feet and is adjacent to Island View Lane,the westerly property line measures 256.17 feet to the line if the property then runs 11.02 feet west and takes a southwest dip of 60.73 feet then curves 27.44 feet southeast, troves 31.13 feet easterly to the edge of the marsh and 39.18 feet west,the southerly line measures 75feet and is located in the salt marsh and the easterly property line measures 370.00 feet. The subject parcel is improved with a one-story frame residence with an enclosed porch on the easterly side of the dwelling. There is a wood deck in the rear of the residence with a hot tub located on the deck. A wire fence is on both sides-of the property and also in,the front yard where there is located a 7:7 ft. by 12.1 feet shed in the northwest corner near Island View Lane as shown on the survey map prepared by John T. Metzger, LS and last revised January-7,2021. BASIS OF APPLICATION: Request for Variances from Article III, Sections 280-124;and the Building Inspector's May 17,2021 Notice of Disapproval based on an application for a permit to demolish and reconstruct a single-family dwelling with attached deck and to install an accessory in-ground swimming pool; 1) located less than the code minimum required combined side yard setback of 15 feet on two sides; 2).located less than the code minimum required combined side yard'setback of 35 feet; 5)more than the code permitted maximum lot,coverage of 20%;,4) the proposed swimming pool located in-other than the code,required rear yard, located at: 525,Island View Lane, (Adj. to Shelter Island Sound) Greenport,NY. SCTM#1000-57-2-26. RELIEF REQUESTED: The applicant requests permit to demolish an existing dwelling, construct a new dwelling with decks and install an in-ground swimming pool The proposed construction,on this nonconforming 25,496 square foot parcel in the Residential R-40 Zoning District,is not permitted pursuant to Article XXIII,Section 280,124 which states: lots measuring between-20,000 and 39,999 square feet in total size require a minimum side yard setback of_15 feet with a combined side yard setback of 35 feet. Section 280-124 further states lot coverage to be a maximum of 20%. In addition, the accessory.pool construction is not permitted pursuant to Article III, Section 280-15, which states: "Accessory buildings and structures or other accessory uses shall be located in the required rear yard. In the case of a waterfront parcel, accessory building and structures may be located in the front yard, provided that such buildings and structures meet the front yard principal setback requirements as set forth by this Code and the side yard setback requirements for accessory buildings." The plans for the proposed new dwelling show 1. a side yard setback of 8 feet 9 inches; 2. a side yard of 10 feet; 3. a combined side yard setback of 18 feet 9 inches; 4. proposed lot coverage of 26%; 5. proposed swimming pool in a side yard location, all as shown on the Site Plan prepared by Keith David Greenwald, Architect and dated July 19, 2021. Page 3,December 16,2021 97562,Cordoves/Culizio SCTM No. 1000-57-2-26 ADDITIONAL INFORMATION: During the Public Hearing on December 2, 2021, the Board was informed that work had been done to this dwelling without the benefit of building permits; which included the enclosed sunroom, the rear wood deck and the hot tub. The Certificate of Occupancy was issued to a wood frame one-family dwelling (seasonal occupancy) with a sunroom and accessory shed. Board of Trustees approval would be required for this rebuild. The Board was informed by the Homeowner Association's attorney, in a letter dated December 1, 2021, that there is a waterfront boundary line discrepancy between the applicant's survey and their survey and asked that this hearing remain open until the matter is resolved. In addition,the applicant's representative submitted a Notice of Incomplete Application from the New York State Department of Conservation which lists many of their requirements. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Currently the existing dwelling is quite small and the new rebuild will be more than 3,600 square feet. This property is burdened with wetlands and is within a FEMA Flood Zone. The neighborhood homes are mostly refurbished seasonal summer cottages. The applicant's proposal is for a very large dwelling with an in-ground swimming pool with decking in the side yard which is not allowed by Town Code. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can build a smaller dwelling moved landward and can construct a swimming pool and deck in a conforming location. A demolition gives the applicant a blank slate that allows him to design and build a dwelling and pool in conformance with the Town Code on the available buildable area of his lot. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial. The single side yard setback represents 41% relief from the code, the combined side yard setback represents 46% relief from the code, the excess in lot coverage represents 30% relief from the code, and the proposed location of the swimming pool represents 100% relief from the code. Since a demolition and reconstruction of the dwelling is proposed, and the existing foundation will not be used to build upon since the new dwelling must be elevated to be FEMA compliant, the applicant has the opportunity to design plans for a new home and pool that would be conforming or, less nonconforming. 4. Town Law§267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant requires five variances to build a new home and construct a swimming pool as applied for on a 75-foot-wide lot that could accommodate a much more code conforming dwelling of similar size. While other variances have been granted for dwellings in the area, they were typically for additions and alterations to enlarge pre-existing non-conforming seasonal cottages and not for new construction 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of a new dwelling with decks and in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available to me,it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed reconstruction is not supported by these policies due to: I. The increase in structure over the permitted 20 percent lot coverage on a nonconforming parcel , within the FEMA Flood Zone AE EL 6' is unsupported. Structure within these areas suffer damage and loss over time from storm events;including hurricanes and should be minimized. Approval of the proposal is not consistent with Policy 1 and 4.2 in that it would set precedent in the area to expand structure in special flood hazard areas. Homes located in special flood hazard areas have a 26 percent chance of suffering flood damage during a normal 30-year loan according to FEMA. 2. The reconstructed structure is proposed 22.1 feet from a jurisdictional wetland. Chapter 275 Wetlands and Shoreline requires a 100' setback to protect the natural feature.There is ability to relocate the structures landward. 3. The proposal for 4 bedrooms and 5.5 baths should be assessed to the current sanitary system on- site. What is the timing of install of the I/A OWTS? In the event the action is approved, SLOSH(Sea,Lake,and Overland Surges from Hurricanes NOAA National Storm Surge Hazard Maps)mapping indicates that the entire parcel would be affected by a Category 1 Hurricane and build out should be designed accordingly. DEC requires that plans depict the distance from the TWB. As per the application checklist, all tidal wetlands applications must include apparent high water line (AHW), apparent low water (ALW),vegetated wetlands boundary(if applicable), the name of the individual delineating the wetland boundary and the date of delineation. Delineations must be within the last 5 years. 4. The plans submitted state that the new I/A OWTS is to be proposed in a future application. SEQRA requires that projects not be segmented and therefore the I/A OWTS portion should be included in this application or the note of a future application be removed from the plans and Joint Application Form. If you wish to proceed with proposing an I/A OWTS,the location of the existing septic system and proposed I/A OWTS must be depicted on the plans. You must submit a cross sectional view of the proposed I/A OWTS showing all components a minimum of two feet above seasonal high groundwater and groundwater levels must be documented by test hole data. 5. Your client is proposing to construct a deck and addition within 75'of the edge of water. Part 661 states that the minimum setback of all structures in excess of 100 square feet must be located 75' landward from the most landward edge of the tidal wetland boundary. SorrmNrrr t Department of s"ATEOr Environmental Conservation V� DEC may allow new structures within the existing structures'footprint without requiring a variance, but any encroachment on the wetlands beyond the existing footprint will require a variance. This variance request will likely be objected to as it is not reasonable or necessary. The plans show a"new wood deck 632 sf". If this is an in-place replacement of the existing deck the plans must be revised to clearly identify that the existing deck is to be removed and a new deck be constructed in its place. 6. Lot coverage calculations must compare the area proposed to be covered with structures and impervious surfaces (i.e. dwellings, decks, driveways)to the total non-wetlands area of the lot. It is assumed that the proposed 15.1%total includes the wetlands on site and the 26% upland calculations are just of the adjacent area(non-wetlands area of the lot). If this is the case your client is requesting a lot coverage of 26% or 3,838 square feet which is beyond the acceptable 20% or 3,000 square feet on pre-existing lots. The Tidal Wetlands Land Use Regulations [6NYCRR Part 661.6(a)(4)]state that, "not more than 20 percent of the upland area... on any lot shall be covered by existing and new structures and other impervious surfaces. Provided, however,this paragraph shall not be deemed to prohibit the coverage of 3,000 square feet or less of adjacent area on any individual lot, lawfully existing on August 20, 1977, by existing and new structures and other impervious surfaces." Therefore, your client's proposal requires a variance from section 661.6. Part 661.11(a)states"The burden of showing that a variance to such provisions should be granted shall rest entirely on the applicant". In order to apply for a variance you must submit a written request specifying; a)which element(s)of the development restrictions relief is sought from; b)the minimum relief that is necessary; c)the practical difficulties claimed; d)a discussion of alternative project site and objectives; e) proposed mitigation and environmental impact reduction measures and; f)five copies of a plan showing the minimum variance necessary and all mitigation and impact reduction measures. It is suggested that the proposal be reduced to 20% (or 3,000 square feet if applicable)as the increased lot coverage is not reasonable or necessary and DEC will likely object to the project with its current lot coverage proposal. 7. Will your client require well point dewatering to conduct the proposed work? Any dewatering in excess of 45 gallons per minute using well points will require a Long Island Well permit from DEC. If dewatering is not proposed, then explain how your client will construct the pool in the shallow groundwater at the site. 8. The Joint Application Form mentions that 2 to 5 trees may need to be removed for this proposal. Removal of trees within the adjacent area is a regulated activity that would require a permit. If trees are to be removed the plans should depict the specific tree(s)with species and girth noted. Trees removed without a permit may result in a violation.
