SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk, County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 25, 2021 stating that this.application is considered a matter'for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 6, 699 sq. ft. parcel,located in.an R-40 Zoning District. The parcel has a 50 feet road frontage on Bailey Avenue, then'runs east for 140 feet to a shared Right of Way,the rear property line fronts the Right of Way for 50:feet,then returns west for 140 feet back.to.Bailey Avenue. The property is improved with a one a and one Half story,frame dwelling,and an accessory garage in the_rear yard as shown on survey prepared by John C. Ehlers,L.S„ last revised,Febru py 23,_2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's July'6,'2021,Notice of Disapproval based on an application for a permit to demolish an existing accessory garage and construct a new accessory garage; at 1) more than the code permitted maximum lot coverage of 201/o;, located at: 825 Bailey Avenue, Greenport,,NY. SCTM No. 1000-34-4-13. RELIEF REQUESTED: The applicant requests a variance to demolish an existing accessory garage and construct a new 14 feet by 25 feet accessory garage,resulting in a lot coverage of 25%where a maximum of 20%is allowed. ADDITIONAL INFORMATION: Testimony was given by the owner of the property that the existing garage was very small and not able to fit in both one car and assorted lawn maintenance equipment. He also explained the reason that the parcel has two listed street addresses. One address is known by the Post Office,while the other is known by the Fire Department. The applicant's representative listed several prior comparable variances granted in the area, which were also listed on the application'addendum as follows: Page 2, December 16,2021 #7569,Maltese SCTM No. 100Q-34-4-13 Appeal#3885, Swimming Pool at 614 Bailey Avenue at 25% lot coverage. Appeal#4867, Deck addition at 531 Sterling Place at 25.9% lot coverage. Appeal#7127, 780 Chaplin Place, Swimming Pool located in other than the rear yard. Appeal#5142, 620 Knapp Place,,Accessory Garage granted rear yard setback relief. According to the applicant's testimony, electrical service shall be installed, but no plumbing is currently , contemplated in the proposed garage. The subject property and proposed improvements are outside of the New York State Department of Conservation Tidal Wetlands Jurisdiction. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts,to be tr_ue'and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change,in the character of the neighborhood or a detriment to nearby properties. The proposed accessory garage'is located in the required rear yard and meets all,the setback-constraints for an accessory building. Accessory garages are common in the Town of Southold-and will not produce any change in the character of the neighborhood. 2, Town.Law §267-b(3)(b)(2). The benefit sought by the appliprit.,cannot be achieved,by some method, feasible for.the applicant to pursue, other than art� area variance. The-existing totcoverap on the site is currently at-22.5 %- which is over the 20%maximum allowable, Therefore, any new construction would require an area variance for lot coverage. 3. Town,Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 25%_relief from the-code, "14owe'ver, the torrent_lot coverage is,22.5%, andthe applicant is.only proposing tQ add.170-sq, ft. ` more to the size of the new garage than the square footage of the existing garage,proposed`to-be demolished. 4,, Town Law 4267-bQ)(b)(4). No evidence has been submitted to.suggest that a variance in-this residential community, will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's-Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect'and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267=B,motion was offered by Member Lehnert,seconded by Member Acampora,and duly carried,', to Page 3, December 16,2021 #7569, Maltese SCTM No. 1000-34-4-13 GRANT the variance as applied for and shown on the Site Plan prepared by William Clark Manning, dated June 16,2021, and Architectural Plans prepared by Drew Bennett, dated February, 1,2020. Any deviation from the survey, site plan andlor architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan_and/or survey cited above, such as alterations, extensions, ordemolitions, are not authorized under this application when,involving non_ conformities under the zoning code. This action does not authorize or condone any current or future use,setback or other feature of the subjectprcperty that may violate the Zoning Code, other than such uses, setbacks and other feature's as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions;are met; and failure to comply therewith will render this approval null and void. The granting of the requested variance relief necessary to construct a larger accessory garage in place of the existing accessory garage, which would increase the existing nonconforming lot coverage from 22.5 to 25.0 percent, will not cause an undesirable change to the character of the neighborhood or detriment to nearby properties. Aerial imagery appears to show that at least 7 of the 12 properties situated along the east side of Bailey Avenue are improved with accessory garages; and accessory garages are similarly common throughout the neighborhood to the west of Bailey Avenue, between Knapp Place and Champlin Place. And due to the small lot size of many of the parcels throughout this neighborhood, lot coverage on numerous parcels appears to exceed 20 percent. Although many of the garages and nonconforming lot coverages are preexisting, conditions on several properties have been established with the benefit of variance relief. For example, in 1989, relief was granted to construct a swimming pool and increase lot coverage to 25 percent on a property with a dwelling and accessory garage at 614 Bailey Avenue, nine lots to the north (Case No. 3885); and in 2000, the property located at the corner of Knapp Place and Sterling Place, less than 600 feet to the northwest as the crow flies, was granted relief to increase lot coverage to 25.9 percent (Case No.4867). And variance relief was granted for accessory garages in 2018 at 780 Champlin Place, located around the corner and less than 200 feet to the southwest as the crow flies (Case No. 7127); and in 2002 at 620 Knapp Place,-located around the corner and less than 300 feet to the northwest as the crow flies (Case No. 5142). In addition to being consistent with the lot coverage approved in these other cases, the applicants' proposed lot coverage varies only minimally from the existing conditions on their property, as the proposed garage would replace a 170 sf smaller, legally existing garage in the same location. With respect to potential impacts on the adjacent properties, a conforming 4-foot rear yard setback will be maintained from the easterly lot line; the property 'to the north, which-is similarly developed with a dwelling close to Bailey Avenue and an accessory garage in the southeast portion of the property, would be unaffected by the project; and replacement of the existing garage will eliminate the preexisting nonconforming side yard setback from the property to the south, as the existing garage is located only 2 feet from the southerly lot line and the new garage would be set back a conforming 3-foot distance from the lot line. Moreover, the minimally proposed relocation of the garage footprint will eliminate the preexisting nonconforming side yard setback, thus reducing the number of zoning nonconformities associated with the garage structure from two to one. 4. The proposed garage replacement will not adversely impact the physical environment of the subject or neighboring properties. The nearest wetland is a "formerly connected" tidal wetland area (associated with Sterling Basin) located on the property to the east, between the opposite/east side of the dwelling on that property and Champlin Place. The existing garage's setback to that wetland is approximately 88 feet, and the wetland setback to the proposed garage is approximately 89 feet. The garage will thus remain at the outer limits of the Town's wetland jurisdiction; and the entire property should be determined to be outside the wetlands jurisdiction of the New York State Department of Environmental Conservation based on elevations. Nevertheless, to ensure that replacement of the new garage does not increase the potential for stormwater runoff, the garage will be equipped with gutters and leaders to capture roof runoff and direct it to a proposed drywell on the north side of the garage. And'a temporary project limiting fence will be erected along the property lines to contain site disturbance and potential runoff during construction. 5. The difficulty creating the need for area variance is not self-created. The existing dwelling and garage—and the associated nonconforming lot coverage—legally pre-dates 1957, as recognized by Certificate of Occupancy No. Z-31627, and even replacement of the garage in the same footprint would require variance relief.
