SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 25', 2021 stating that this application is considered a matter for local determination as there appears to -be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. 'PROPERTY FACTS/DESCRIPTION: The subject property is a 4,709 sq. ft. parcel located in an R-40 Zoning District. The parcel has 50 feet road frontage along County Road 48,then turns north for 98.9,8 feet,with a rear yard of 50 feet then returns 98.98 feet back to County Road 48. The property is improved with an existing one-story residence with attached deck, and an accessory shed as shown on a survey prepared by Nathan Taft Corwin,III,L.S. dated June 8,2021. BASIS-OF APPLICATION: Request for a Variance from Article XXIH; Section 2&0-124 and the Building- Inspector's August 9,2021 Notice of Disapproval based on an application for a permit to legalize an"as-built"wood deck attached to a single-family dwelling; at 1) located less than the code minimum required rear yard setback of 10 feet; located at: 2775 County Road 48,Mattituck,NY. SCTM No. 1000-141-2-11. RELIEF REQUESTED: The applicant requests a variance to legalize an existing attached wood deck measuring 10 feet by 9 feet resulting in an 8.6-foot side yard setback where a 10-foot minimum setback is required. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property Page 2,December 16,2021 #7571,Acevedo SCTM No. 1000-141-2-11 and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The as built wood deck is located on the western side(rear)of the house and follows the line of the existing house. The attached deck cannot be seen from the street and has no visual impact on any adjacent properties. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the non-conforming side yard setback of the existing house, any deck attached to the rear of the home that extends along the side of the dwelling wall will require an area variance. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing an approximately 14%relief from the code. However,the structure in question is an exterior wood deck, is open to the sky, is not habitable space, and only a small portion of the deck requires variance relief as it is not parallel to the property line. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law $267-b(3)(b)(Sl. The difficulty has been self-created. The applicant purchased the parcel after the -Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the,use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an exterior rear deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Lehnert,seconded by Member Planamento,and duly carried, to GRANT the variance as applied for,and shown on the survey prepared by Nathen Taft Corwin,III,Land Surveyor, dated June 8,2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The"as built"wood deck shall remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject-to conditions,_the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith'will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280,146(B)-of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The deck enhances and adds character to the home and does not present any adverse effect on nearby properties. Taking the deck down and replacing it with a stoop which would be the only other alternative I was given, may do the opposite. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance, because: The only other option I would have, per Building Department suggestion as an alternative, is to remove the existing deck completely and replace it with a stoop. This approach would not only be very costly requiring demo permits, dump fees and disturbance to the nearby neighbors during demolition and replacement but it will most likely detract instead of adding character and appeal to the property. 3.The amount of relief requested is not substantial because: The area of concern is only a very small fraction of the deck at one corner of it that is not conforming with the 10 ft. side yard set-back requirement. It's an area of about 3-4 SQF or about 4%of the total space of the deck or less as cab be seen on the current survey submitted dated June 8, 2021. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The variance is to legalize an existing deck structure which if, granted which I'm hoping it would be, it will be left as is undisturbed. No adverse effect or impact on the physical or environmental conditions of the neighborhood would be impacted by this action. 5. Has the alleged difficulty been self-created?
