SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections,A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 25, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming, .325-acre, 14,1,72 square foot parcel located on a corner lot with two front yards,in the R-40 Zoning District. The northerly property line measures 102.06 feet, the easterly property line measures 140.59 feet and is adjacent-to Eighth Street, the southerly property line measures 101.69 feet and is adjacent to Corwin Street an:d the easterly property line measures 139.00 feet. The parcel is improved with a one-and-one half story single family frameddwelling with,a fenced in in-ground swimming pool in the rear yard as shown on the survey prepared by Gary Benz,LS and dated June 9, 2020. BASIS OF APPLICATION:_ Request for a Variance from Article XXIII, Section 2807424; and-the Building Inspector's August 6, 2021 Notice of Disapproval based on an application for a permit to demolish and reconstruct a single-family dwelling; at 1) located less•than the code minimum required front yard setback of 35 feet; located at: 255 Corwin Street, Greenport,NY. SCTM No. 1000-48-1-44.2. RELIEF REQUESTED: The applicant requests a variance to demolish (as per Town Code definition) and reconstruct, in place, a single-family dwelling with two front yards. The applicant proposes a secondary front yard setback of 19.4 feet on-Eighth Street where the Code requires a minimum of 25 feet for a Secondary front yard, however,pursuant to section 280-104A: "Established front yard setback. Where property in the vicinity is improved with principal buildings with front yards of less than that required by the provision of this chapter,the front yard setback shall be the average setback of the existing buildings within 300 feet of the proposed building on the same side of the street within the same use district." The average setback on Eighth Street is 24.8 feet. Page 2, December 16,2021 #7572, DiVello SCTM No. 1000-48-1-44.2 Since the average front yard setback on Eighth Street is 24.8 feet, the proposed addition will require a variance for less than the required 24.$ feet. The Site Plan and Architectural Plans (A-1 thru A-4) prepared by David A. DiGiovanni,Architect, updated January 21, 2Q21, show the proposed addition of a full second story, renovations to the first floor and renovations to the cellar all to stay within the existing footprint. ADDITIONAL INFORMATION: The existing dwelling was issued a Certificate of Occupancy,No.Z6517 on June 10, 1975,the in-ground swimming pool and fence where issued a Certificate of Occupancy No.Z15862 on June 18, 1987. The subject property is the beneficiary of Zoning Board of Appeals decisions: #1946 dated September 12, 1974 and#7481 dated April 16,2021, both relative to reduced front yard setback. On April 15, 2021,the applicant was granted a variance for a front yard setback to construct additions and alteration to a single-family dwelling, Appeal No. 7481. Since the structure was demolished, the,applicant was forced to request a de-minimus approval from the ZBA,which was denied on August 2,2021. This current application requests variances for the demolition and reconstruction of a single-family dwelling. The property located to the south is zoned industrial (LI) with a large industrial building. Other properties in the direct vicinity of the subject dwelling have lesser front yard setbacks than what the applicant proposes. No member of the public or immediate neighbor spoke in favor of or against this application. A letter of support was received prior to the public hearing. During the public hearing,the applicant was requested to provide the Board with copy of their Suffolk County Board ,of Health approval fora,traditional waste-water sanitary system. On the afternoon of December 2,202 1,the applicant provided a copy of the Suffolk County Board,of Health approval dated November 6;2021 for a traditional'(non-UA) sanitary system approved for a 4-bedroom single-family residence valid until November 6,2024. FINDINGS OF FACT/-REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 2,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal'inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the residences in the nearby neighborhood have less than the code required front yard setbacks. The property to the south of the subject property zoned for industry improved with large-commercial buildings, furthermore, the- subject parcel is the beneficiary of two prior'Z-BA- decisions granting relief for-reduced front yard setbacks. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The current existing home is a one and one-half story structure. The applicant wishes to make a full second floor that will add 650 square feet to the dwelling. The footprint of the single-family dwelling will remain the same. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 21.7%total relief from the code. However,this is an existing structure that has an existing Certificate of Occupancy,based upon two prior Zoning Board of Appeals decisions,and the current,non-conforming front yard setback will be maintained. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created, The applicant purchased the parcel after the Zoriing Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a fully renovated,two story residence as the result of demolition as defined by Town Code while preserving and protecting the character of the neighborhood and the health, safety and-welfare of the community.
