Dear Ms. Wessell:
This letter is,a`follow up to your letter of November Z-2021 wherein you detailed a
request to remove four (4) trees in your backyard, which trees were tagged and shown
in photographs which you provided. The,Board"of Trustees_ reviewed your request to
remove these four(4) trees designated that are with_ in 100' of the wetlands, as reviewed
and seen by Trustee Nicholas, Krupski.
The Board of Trustees determined that these four (4) trees may be removed. No permit
will be required in order to remove these trees.
Any other activity within 100' of the,wetland boundary requires a permit from this office.
This is not a determination from any other'agency.-

We need to remove this tree which Shamrock Tree confirmed is a hazard to the home. It is within the

Dear Diane,
Below are 3 photographs of 3 separate trees located at 1650 West Creek Ave, Cutchogue NY
11935. Two are on the west side of the home, one slightly south just next to the Bilco doors,the other
at foot of the steps. The third is on the north east side of the home close to the electric meter. These
trees are causing damage to the foundation and need to be removed. Once removed,the foundation
needs to be exposed for repairs.
Separately, I am also emailing a 4th and 5th photo next showing roots growing through the basement
wall.
The home is in the 100' setback under the Trustees jurisdiction but out of DEC jurisdiction. Letter of DEC
non jurisdiction is attached.

Dear Ms. Wessell,
Based on the information you have submitted, the Department of Environmental
Conservation has determined that the above referenced project landward of the 10 foot
contour line, as shown on the,survey prepared by Kenneth M. Woychuk dated
5/15/2020, is beyond Tidal Wetlands Act(Article 25)jurisdiction. Therefore, in
accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required. (DEP-ARNO)
Be advised, no construction, sedimentation, or disturbance of any kind may take
place seaward of the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all precautions are taken to
prevent any sedimentation or other alteration or disturbance to the ground surface or i
vegetation within Article 25 jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15'to 20'wide construction area) or
erecting a temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies or local municipalities.

We need to remove the tree depicted below.Jonathan Shipman of Shamrock Tree confirmed it is a threat and hazard to
humans, our furry friends and our cottage. It leans precariously. It is within the 100' hazard zone but outside of DEC
jurisdiction.
