That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. Moore, Esq., on behalf of STUART THORN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated December 12, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the submission of a revised plan and the issuance of a permit for the structures; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 13, 2019 and August 14, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of STUART THORN for the as- built removal and replacement of existing 2,468sq.ft. on-grade seaward side stone patio in-place except the area along the portion of the northern edge where the new patio will be set back from the top of bluff to allow for new plantings and a decorative split-rail fence; and to remove and replace the existing garden wall with new 21'6"x6'0" masonry wall; and as depicted on the project plan prepared by Patricia Moore received on June 18, 2019, and stamped approved on August 14, 2019. Any grading, excavation or other soil disturbance conducted within a structural hazard area must not direct surface water runoff over a bluff face. Purpose of all activity being proposed to patio is to prevent directing surface water runoff over the bluff. All existing drywells were inspected. If gutters and leaders were directing water over the bluff they were being re-directed. Drywells are proposed landward of the house. The new windows & doors to the existing house were required as normal maintenance to the house. The windows and doors were either original to the house or installed in 2000. (see permit#5244) The windows and doors were replaced with energy efficient and water tight improvements. Because these improvements were either unregulated actions or correcting existing conditions to stop water runoff from running over the bluff, the owner's agents believed that the work could be done without a permit. All the proposed work is correcting "permitted structures". Nate Corwin prepared the drainage plan showing the location of the proposed drywells together with the direction of the water flow. In 2000 the existing house was expanded with Trustee's permits and gutters and leaders, as well as drywells were installed with the construction. The drainage was recently checked and found to be draining onto the bluff. A corrective drainage plan is proposed. An application to the Trustees was filed to connect existing gutters and leaders from the house into the drywells shown on the enclosed Nathan Taft Corwin III survey. The existing patio with brick on crushed stone is being reduced in size and planted, resurfaced from brick to bluestone in sand and pitched away from the bluff. The owner of the subject property is also the owner of the house to the east, therefore the patio extends into the adjacent parcel. The existing brick patio has been specified in a manner which indicates that it will be re- constructed. This new work appears to be sloped away from the Top of Bluff and set on sand or stone with voids that continue down and into pervious sub-base materials If the Trusteed are satisfied with the new proposed limits of the Patio, this plan would meet the requirements of chapter 236 This new site plan does indicate new drainage systems for the residence which meets the requirements of chapter 236 for stormwater drainage. The only item not designed to provide drainage would be the driveway system. Drainage for this driveway would be required to comply with chapter 236. Without knowing the pitch or slope of the brick surface it is difficult to ascertain what damage or potential erosion may occur with regard to the Top of Bluff due to the location of the patio. Was the installation of this patio ever formally approved by the Trustees? In addition, this site does not seem to have drainage systems for the residence and other impervious surfaces found at this site Without having accurate contours or spot elevations it would be challenging to come up with recommendations to improve runoff conditions that may be adversely affecting adjacent properties as well as protecting the Top of Bluff. If this proposed addition and alteration currently under review by the Board requires a Trustee M Permit, I would recommend that compliance with Chapter 236 be mandatory for all existing and proposed site development. This would entail the submission of a full storm water management plan that is compliant with the requirements of Chapter 236 and it must address erosion controls and the installation of a complete site drainage system.
