Box 1047 Southold, NY 11971 RE: SOUTHOLD SUNSETS, LLC 4200 KENNY'S ROAD, SOUTHOLD SCTM# 1000-54-4-3 Dear Mr. Kimack: The Board of Town Trustee's took the'fol lowing action•during its Regular meeting held on Wednesday, December 15, 2021 regarding the above matter: WHEREAS, Michael A. Kirriack on behalf of SOUTIHOLD SUNSETS, LLC applied to the Southold Town Trustees for a Wetland permit under the provisions of Chapter,275 and a Coastal Erosion Permit under the provisions.of Chapter-111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated October 27, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended-that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6.3 —Protect and restore tidal and freshwater wetlands; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 15, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275; and WHEREAS, the Board has determined that the request, as applied for, will have a-detrimental effect upon the health, safety and general welfare of the people of the town, and, WHEREAS, the proposed structure, as applied for, is"located in a dune area as per Definitions in Chapter 111 Coastal Erosion Hazard Areas of the Town Code and governed by Section 11"1- 13 A. In primary dune areas: (5) Nonmajor additions to existing.structu_ res are allowed in primary. - dunes pursuant to a coastal erosion management permit and subject to permit conditions concerning the location, design and potential impacts of the structure on a primary dune; Section 111-11 C. All development is prohibited in ne_arshore areas unless specifically provided for by this chapter, and, NOW THEREFORE BE IT RESOLVED, that for the foregoing reasons, and because the proposed action,is located entirely within the coastal erosion hazard area and in a primary dune area, and_because the proposed application is a prohibited act pursuant to Chapter 111 of the Town Code, which requires Appeal by the Town Board, the Trustees deem-the proposed project to be impermissible under Chapter 111, and, BE IT FURTHER - RESOLVED that for the foregoing reasons, the Board of Trustees DENIES the,Wetland and' Coastal Erosion Permit application of SOUTHOLD S,UNSETS,'LLC'for the as-built above ground 500 gallon propane-tank (30"x8'--20sq.ft.); as-built raised'platform for A/C units (3'x9'-- 27sq.ft.); as-built on=gr6do'dry laid slate patio and walkway's (877sq.ft.); as-built concrete walkway with added dy laid slate walkway/landing (±1008q.ft.); as=built Belgian block gravel drive surround (±140 linear feet); as-built gravel driveway (±635sq.ft.); as-built fire pit (28.2sq.ft.); existing 8'x12.2' (97.6sq.ft.) shed has been`removed from the property; and the American Beach grass,planting area-to be in conjunction with as-built plantings in the secondary dune area and as depicted,on the site plan prepared by M.A.Kimack, received on December. 10, 2021 This determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Dear Trustees: In regards to the 'as build" notice that is posted for SOUTHOLD SUNSETS at Kenney's, Beach it is of particular concern to see the plantings and lack of plantings on this project after the construction. While they have done a beautiful job on the house the plantings that where used to the left of the driveway are not in keeping with the natural dune and should be replaced with native American Beach Grass. In fact any disturbed area needs to be restored with native plantings. The areas where Blue lime grass was used should be rernoved The blue lime grass has a a very bad habit of spreading and choking Out Our native beach grass, 11 hope that you require that this invasive grass be removed ASAP and replaced With the American Beach grass. In,addition the tall privet hedge that as been planted is in no way keeping with a natural dune area such as this serisitiv6 beach dune, Nature will probably take care of those and by looks already has started. This short video documents the dune restoration along the entire length of Kenney's beach parking lot that was done on a cold day in January 2003 by volunteers of the Kenney"s Beach Assn. Measures should be in place to also plant and restore the dune area with native beach grass and restore it back to its natural state. Located: 4200 Kenneys Road, Southold. SCTM# 1000-54-4-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP Policy 6.3 and 9 therefore INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions a. The as-built conditions do not appear to fully comply with TR-9752. b. The as built structures and features were constructed without obtaining a Wetlands Permit and Coastal Erosion Hazard Permit. c. The parcel was over-cleared to what was represented in the file (Page 50 Laserfiche) d. The agent for the applicant states that the area where the slate patio is located was pre-disturbed. That is incorrect.
