That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. On September 11, 2021, CES conducted a site visit and documented the property using ground-level and drone photography. FINDINGS Upland Area The south-west side of the property was primarily vegetated with non-native/invasive species. Some idgenous species were present. Below is a list of species found in this area of the property. Native plants should remain untouched or transplanted. Once the area has been cleared, CES recommends vegetating the area with low lying native vegtetation. If designed properly,the native vegetation will, enhance the landscape while allowing for views of the water, prevent erosion, help improve the local water quality, and su sport pollinators. No non-native nor invasive species were noted during the inspection. The ease,endof Long Island is a fragile ecosystem, and small changes can have a significant positive affect. To take full ad antage of the property's natural beauty, CES recommends a few simple improvements, Plant native gardens and rain gardens, Properties on the water are not only environmentally sensitiv , but they are also becoming more vulnerable as climate change progresses. A major concern for waterfront homeowners is flooding. Strategically placed native gardens (rain gardens) near gutter downspouts can protect hones and landscaping during storms and protect the health of the waterway, benefiting the homeowner and the local ecosystem. Unlike turf grass, native plants have deep root systems. These deep roots absorb significantly y more water during storms, helping to prevent or reduce the affects of flooding. The root systems also help to f Iter pollutants from directly entering the water, thus having a positive impact on water quality. Install a Tick border Install 3'wide wood chip,stone,gravel, etc border in between planting areas and lawn area to deter ticks. Reduce fertilizer use, where applicable, Excessive amounts of nitrogen negatively impact the waterways, causing fish kills and harmful algal blooms. Nitrogen commonly enters the waterways during rain storms, iIt should be noted that the correctly choosen native plants do not require fertilizer. A native buffer along thg water would help filter and prevent fertilizer from directly entering the water. Install a smart sprinkler control. Smart sprinkler systems work with your current sprinklers and are WIN enabled. They use local weather forecasts to prevent watering during storms,which will save w ter and help prevent flooding.
