RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#10071 for the addition of a buried 500 gallon liquid propane tank; install an A/C condenser on south-west side of dwelling; remove existing generator slab and relocate for a new propane powered generator on north-east side of dwelling; the as-built lower deck on the seaward east side has been reconfigured and cut back by 2'3" and also on the southern side (angular portion) ±5'8" further from the water with the approved 267sq.ft. square footage remaining the same; and as-built 5'8"x7' hot tub on upper deck; and as depicted on the site plan prepared by Mark Schwartz, Architect, received on January 23, 2024, and stamped approved on February 14, 2024. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. The owners decided they rather preserve the upper deck and reduce the lower deck instead The square foot of changes made is the same as the approved square footage. all the changes that have been made were the removal of the lower deck portion, on the waterside, rather than the upper deck portion (landward) Hope this makes sense. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. The property contains a functional bulkhead and all proposed construction activities will be located on the landward side of the bulkhead and landward of existing structures. The project includes two proposed additions to the residence and a small deck addition. One proposed addition is located on the landward side of the residence at approximately 27' x 7' or 184.5 sq. ft. which will contain a new foyer, coat closet and laundry area. This proposed front addition is located 90+feet from the bulkhead. The second proposed addition is located on the southwest corner of the residence at approximately 25' x 28' varying dimensions or 302 sq. ft. Which will allow for the creation of a master bedroom suite and larger kitchen within the residence. The proposed southwest addition will be located 45.3' from the bulkhead. The small deck addition will "fill in" a space between the exiting deck and the proposed southwest addition. The proposed deck dimensions are approximately 14' x 5' varying dimensions or 29.6' and will be located approximately 35' from the bulkhead. The total proposed additions will have a net increase is 516.7 sq. ft. where the existing residence is 3742.1 sq. ft. and the proposed lot coverage will be 4258.8 sq. ft. This will require relief for lot coverage from the ZBA in the amount of 2.2% of lot coverage (425.4 sq. ft.), where the exiting lot coverage is 19.5%, the proposed lot coverage is 22.2% and the maximum allowed within the R-40 zone is 20%. The ZBA recently granted approval for the small coverage relief by their decision dated November 18, 2021. The residence contains an existing multi level deck in the rear of the residence. EWRYDETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (L)YRP) Policy Standards. The LVW Coordinator issued a recommendation dated October 5, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposal to increase the permissible lot coverage over 20 percent is INCONSISTENT with the following LWRP standards and therefore is INCONSISTENT with the LWRP. Policy No. 1-The expansion of an existing structure over the permitted 20%lot coverage is inconsistent with the above policy and it does not support a pattern of development consistent with the Southold Town Comprehensive Plan. The expansion of structures in areas vulnerable t flooding and storm damage is unsupported. Policy No.4.1 -The residential structure does not functionally require a location on the coast and is not water dependent. BASIS OP APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's June 14, 2021 Notice of Disapproval based on an application for a permit to construct additions and s alterations to an existing single-family dwelling;at; 1)more than the code permitted maximum lot coverage of 20%; located at: 850 Lupton Point Road, (Adj.to Deep Hole Creek)Mattituck,NY. SCTM No. 1000-115-11-16. RELIEF,REOUESTED: The applicant seeks a variance to allow for excessive lot coverage of 22.2%where the code limits lot coverage to 20% in the R-40 residential zone. The applicant seeks relief in order to expand their home through additions and alterations allowing for the expansion of a first-floor bedroom with the addition of a walk-in closet; the creation of a kitchen pantry; enlarge the existing kitchen; create a front porch, an entry hall with closet, and laundry room;and to reconstruct the second floor with a loft,office and balcony over the first floor. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Lupton's Point is a private, residential, neighborhood developed over the past 100 years and is accessed via a 20-feet wide right of way that meanders through the peninsula offering residences on both side of the lane waterfront access from rear-yards. The terrain follows the coastline and is irregular establishing a unique community of a variety of house sizes and styles. Most homes are built at non- conforming locations, many do not meet required setback and several properties appear to exceed allowable lot coverage. The requested relief of 2.2% excessive lot coverage over the allowable 20% will not create a noticeable or undesirable change in the character of the community. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Presently, the site is developed at 19.5% lot coverage so, virtually any increase in the expansion of the existing dwelling will require variance relief. 3. Totivn Law§267-b(3)( )(3). The variance granted herein is mathematically substantial,representing 11%relief from the code. However,most of the proposed renovation is within the existing footprint and the applicant proposes a very modest addition of 425 square feet of living space r 4. ,Town Law U67-b(3)M(4). I No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is located along the south side of Luptons Point Road and fronts along Deep Hole Creek which feeds into the Great Peconic Bay with a functional bulkhead along the creek.
