Regarding Vitrano, your office was advised that the project was not staked for the January 11th field inspections and if not staked in February for field inspections it would be postponed and a $50 fee will be required to go inspect a third time. The Board performed an inspection on February 1011 and the project was not staked so at this point prior to any future inspections/meetings a $50 fee is due and your office will have to notify our office as to when the staking has been completed. Regarding Schwartz, during the January public hearing your office was asked to submit a proposed revised plan. Upon submission of said revised plan and verification of staking out the revised proposed dock location the Board will schedule another field inspection with a possible hearing date. If your office formally requests to move forward with the current proposed structure (no revised plans),the Board will add your application to the next available public hearing date. — -- - - Eeer" Senior Office Assistant yp Town of Southold ,Wewr Board of Trustees Office: 631-765-1892 Email: elizabethc@sotuholdtownny.gov From: Kate Rummel <kate@coIeenvironmentaIse rvices.com> Sent:Tuesday, February 15, 2022 10:50 AM I ?a , To: Cantrell, Elizabeth <elizabethc@town.southold.ny.us> Cc: Chris Cole <chris@coleenvironmentalservices.com>; Cole Environ! <info@coleenvironmentaIse rvices.com> I Subject: Hold Applications-3875 Main Bayview Road (Vitrano)+279 Hi Elizabeth, — We hope you're staying warm during this cold spell! Cole Cole Environmental Services, Inc. 425 Montauk Highway East Quogue, NY 11942 RE ENVIRONMENTAL DECLARATION OF SIGNIFICANCE PURSUANT TO NEW YORK STATE ENVIRONMENTAL QUALITY REVIEW ACT NYCCR PART 617 JUSTIN & ALLISON SCHWARTZ 2793 COX NECK ROAD, MATTITUCK SCTM# 1000-113-8-7.6 Dear Mr. Cole: The Southold Town Board of Trustees adopted the following Resolution at a meeting held on Wednesday, January 19, 2022: DESCRIPTION OF ACTION; Cole Environmental Services on behalf of JUSTIN & ALLISON SCHWARTZ requests a Wetland Permit to construct a proposed 4'x165' fixed pier with open grate decking a minimum of 4' above tidal vegetative grade; a 3'x16' aluminum ramp; a 6'x20' floating dock situated in an "T" configuration; and to install a natural path leading from upland to fixed pier using permeable material. Located: 2793 Cox Neck Road, Mattituck. SCTM# 1000-113-8-7.6 S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on January 11, 2022, and having considered the survey of property by Kenneth M. Woychuk Land Surveying, PLLC. last dated September 20, 2019, and having considered the plans for this proposed project submitted by Cole Environmental Services last dated September 2021 at the Trustee's January 13, 2022 work session, and WHEREAS, on January 19, 2022 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A., and WHEREAS, on January 19, 2022 the Southold Town Board of Trustees classified the application as an unlisted action under S.E.Q.R.A., and WHEREAS, in reviewing project plans submitted by Cole Environmental Services last dated September 2021, it has been determined by the Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacea in season. • Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. It is unclear where the trees to be removed are located on the parcel. Removing trees within the natural/non-disturbance buffer is not permitted. The purpose of these types of buffers is to leave them in a "natural" state to provide function and values for wildlife and wetland protection. Laurel Lake is a Critical Environmental Area. The use of a treed buffer to protect water quality is important. DANIEL FERRARA & JAMIE SCHWARTZ request a Wetland Permit to construct a proposed 32'x40' (2,169sq.ft.) two-story, single-family dwelling; a raised 10'x40' (485sq.ft.) seaward side deck with 10'x40' on-grade concrete patio under; an 8'x12' (96sq.ft.) front porch; install a new UA OWTS system; install shrubs along the "Limit of Clearing, Grading and Ground Disturbance" line located ±5' seaward of proposed patio in keeping with the natural landscaping; install a 60'x±12' (±755sq.ft.) gravel driveway; and to remove 9-10 trees due to construction or dead/damaged. Located: 1805 Laurel Way, Mattituck. SCTM# 1000-121-4-24 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
