Regarding Vitrano,your office was advised that the project was not staked for the January 111h field inspections and if not staked in February for field inspections it would be postponed and a $50 fee will be required to go inspect a third time. The Board performed an inspection on February 10th and the project was not staked so at this point prior to any future inspections/meetings a $50 fee is due and your office will have to notify our office as to when the staking has been completed. Regarding Schwartz, during the January public hearing your office was asked to submit a proposed revised plan. Upon submission of said revised plan and verification of staking out the revised proposed dock location the Board will schedule another field inspection with a possible hearing date. The Board noticed that the Notice of Hearing Cards were not posted, but the projects were staked out. The deadline to post the properties and send out the certified return receipt mailings was on Tuesday, December 7th, Because the properties were not posted,the Board is postponing both applications to the January 19, 2022 public hearing date. You will receive a new noticing packet to which you will have to re-send out the certified return receipt mailings and post the property no later than the morning of Tuesday,January 11, 2022. That Tuesday the Board will be performing their site inspections and they will stop by each site again to see that the properties were posted with the Notice of Hearing card. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and therefore INCONSISTENT with the LWRP. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potentialadverse imj2a of the proposed use, structure, or facility on public interest in public lands under water. Although a dock was permitted for this location in the past, the navigation of the waterbody could be negatively impacted when a boat is moored at the end of the dock. The width of a representative vessel is not provided. A certain width of the navigable channel should remain free and clear of potential obstacles. What is the distance to the opposite shoreline with a vessel moored? Further, a net loss in public use of waterways is expected as a result of a dock in/on public waterways. The construction of this proposed, private residential dock structure on public trust lands and/or waters would result in a net loss of public recreational use of such waters. The proposal to construct a dock in this location is inconsistent with this policy. In the event the action is approved the minimization of CCA treated materials in construction in this low flow area is recommended to further Policy 6.
