COUNCILMAN GHOSIO: RESOLVED the Town Board of the Town of Southold hereby sets
Tuesday, September 21,
2021 at 9:01 AM. at the Southold Town Meeting Hall,53095 Main Road, Southold,New
York as the time and place for a public hearing upon the Coastal Erosion Hazard Board of
Review Appeal of Farther Out East LLC (c/o Thomas & Maureen Dowling) which seeks
relief from Chapter 1 11, Section 111-12D to authorize the removal of an existing propane tank
on the western side of the existing dwelling, remove existing hot tub, remove± 132.0 ft.2 of
existing seaward deck and reconstruct seaward deck with steps (minus balcony)for a total of 501
ft.2 in-kind and in place, reconstruct/expand existing seaward balcony (inclusive of existing
balcony area)for a total of 104 ft.2, remove existing cellar entrance, abandon and remove existing
sanitary system in accordance with S. C. D. H. S. Standards, remove existing shed from
landward side of existing dwelling, remove existing chimney from eastern side of the existing
dwelling, and to remove 358 ft. 2 of existing northeasterly deck, on existing 1,092 square foot
dwelling, construct a 58 square-foot addition onto northeastern corner, construct a 20 square foot
pergola with counter under against the seaward side of the dwelling, construct 67 ft. 2 porch
along the northerly portion of the dwelling, construct a 381.25 screen porch along the easterly
side of the dwelling, install a new propane tank along the westerly portion of the property,
construct a new 50 square foot basement entry along the westerly side of the dwelling, install
new IA/OWTS septic system landward of the dwelling, construct a 2.5 foot high (maximum
height) by 97.5 foot long retaining wall along the northeast corner of the property, and as
depicted on the survey prepared by Gary Benz, L. S. Received on February 12, 2021, within a
near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM 4 1000-
31-18-18, 860 Rabbit Lane, East Marion,New York, and directs the Town Clerk to publish
notice of such appeal in the Suffolk Times newspaper not less than ten (10) days nor more than
thirty(30) days prior to such hearing and to notify the applicant by first class mail.
I do have a signed affidavit, notarized that this was in fact in the Suffolk Times, it was also
advertised on the Town Clerk's bulletin board and town website. I believe that is it.
SUPERVISOR RUSSELL: Would anyone like to comment on this?
BRUCE ANDERSON: I am Bruce Anderson, I represent the applicants, Thomas and Maureen
Dowling, the property owners. Here is the coastal erosion appeal application, along Rabbit Lane.
You will notice that many of them (inaudible)Also, you have the survey in front of you
(inaudible) coastal erosion hazard line which slices the property in half. So, we were denied by
the Trustees, by way of background, we filed an application with the Trustees back in February,
(inaudible) however the Trustees denied our coastal erosion hazard area permit and the review of

the Trustees minutes which is included in the application (inaudible) it was part of'the overall
project

4(A) Section 100-4(A) of the Southold Town Code, "Property Maintenance", at the property
located at 145 Williamsburg Road, Southold,NY. SCTM #1000-78-5-13, and on June 1, 2021,
this alleged violation was confinned by Town of Southold Code Enforcement; and
WHEREAS on June 1, 2021, a Notice of Violation and Order to Remedy the condition by June
30, 2021, was served upon the owner of record and posted at the subject property; and
WHEREAS as of July 1, 2021, the property had not been brought into compliance with Section
100-4(A) of the Southold Town Code and on July 29, 2021, employees of the Town of Southold
Department of Public Works were dispatched to the property and performed the maintenance
required to bring the property into compliance with Town Code, now,therefore, be it
RESOLVED that the Town Board of the Town of Southold, pursuant to Section 100-10 of the
Southold Town Code, hereby directs that the costs and expenses incurred by the Department of
Public Works in effectuating the cleanup of the property located at 225 Williamsburg Rd,
Southold , in the amount of$559.70 shall be levied against the real property of Thomas Peters,
SCTM #1000-78-5-13, and that said costs and expenses are to be collected at the same time and
in the same manner as the Town taxes.

E-Filing System for Filing a SCAR Petition(S)
WHEREAS, the County of Suffolk and each of the ten Suffolk County Towns are in a State of
Emergency with the entire State of New York as declared by the Governor as of March 7, 2020,
due to COVID-19; and
WHEREAS, in light of the foregoing, the Town of Southold, the Supervisor, the Board of
Assessors and the legal representatives of the Town recognize the need to reduce expenses, to
conserve resources and to maintain some type of"social distancing"now and into the future.
Therefore, there is a need to make certain changes to the current procedure for the application of
a real property tax exemption(s) authorized under Article 4 of the Real property Tax Law.
Changes to the current application process would not only limit the personal contact between the
public and assessment staff, but also greatly reduce the already limited resources of the Town
reviewing and processing the large number of exemption applications that are generally filed
each year; and
WHEREAS, the filing period for such exemptions is imminent and the adoption of an E-Filing
system is in the best interest of both the Applicant and the Town; and
WHEREAS, the use of a uniform E-Filing system for filing a SCAR petition(s) upon the Town is
currently provided for by the Real Property Tax Law §104(1)(a) and the proposed uniform E-
Filing system provides Complainants with the same protections they currently enjoy; and
WHEREAS. the adoption of a uniform E-Filing system is not intended to replace a Petitioner's
ability to file grievance complaints in accordance with the current statutory and regulatory
fi•amework but rather it is to be an alternative thereto; and
WHEREAS, the Procedures and Protocols will be located at:

of an existing-propane tank on the western side of the existing dwelling, remove existing hot tub,
remove± 132.0 ft.' of existing seaward deck and reconstruct seaward deck with steps (minus
balcony)for a total of 501 ft.' in-kind and in place, reconstruct/expand existing seaward balcony
(inclusive of existing balcony area)for a total of 104 ft., remove existing cellar entrance, abandon
and remove existing sanitary system in accordance with S. C. D. H. S. Standards, remove

construct 67 ft. 2 porch along the northerly portion of the dwelling, construct a 381. 25 screen
porch along the easterly side of the dwelling, install a new propane tank along the westerly
portion of the property, construct a new 50 square foot basement entry along the westerly side of
the dwelling, install new IA/OWTS septic system landward of the dwelling, construct a 2. 5 foot
high (maximum height) by 97. 5 foot long retaining wall along the northeast corner of the
property, and as depicted on the survey prepared by Gary Benz; L. S. Received on February 12,
2021, within a near shore area in a Coastal Erosion Hazard Area located on property on parcel
SCTM# 1000- 31- 18- 18, 860 Rabbit Lane, East Marion,New York, under the Town of
Southold Coastal Erosion Hazard Areas Law (the "Law") of the Town of Southold pursuant to
Section 111-11(c); and
WHEREAS, on July 20, 2021, the Applicant submitted an application to the Town Board of the
Town of Southold seeking to appeal the determination of the Board of Trustees, or in the
alternative, seeking a variance from the requirements of the Law; and
WHEREAS, on September 21 2021, the Town Board conducted a duly noticed public hearing
on the instant appeal with an opportunity for all interested parties to be heard and testimony was
taken of the Applicant's consultant and other interested parties; and

ROBERT DUNN: Robert Dunn. Regretfully, I am here again. I've been talking to the town
since October 2020 about an encroachment by a new neighbor on the town property that is being
adjudicated, so I understand. Subsequent to that encroachment,there was construction being
done on that home unpermitted. I reported it to the building department and a stop work order
was put on it. The homeowner did what is very common in our town, is to apply after the fact
for a permit, was denied the permit by the building department because they were looking to go
out beyond the boundaries. They then went to ZBA and got permission last Friday to do that.
Also on last Friday, I got a summons for arraignment regarding this. This property, this
homeowner has been flashing lights into my bedroom (inaudible), put noise makers along the
property line. Summonses have never been issued on any of that, it's a violation. And here it is
almost a year later, I am being arraigned.
COUNCILMAN GHOSIO: Arraigned for what?
MR. DUNN: Mischief. Criminal mischief. I am not going to discuss that because I have to
discuss it on Friday in here at my arraignment, so we (inaudible). But I am just talking about....
SUPERVISOR RUSSELL: I am sorry but it was just several meetings ago where you expressed
gratitude because they did address the noise and the lights.
MR. DUNN: No, no, no. They tried to. They tried to.

MR. DUNN: They tried to and as a matter of fact, that was back in July, I know that code
enforcement actually went by there again on Labor Day because I was sitting there at the beach
and I saw it while I was working. but the idea that the outcome now is that I am going to go
through this and this lighting and the noise makers are still there, never been fined for it. Never
been anything. I will show you pictures of it, I took pictures of the lights, they are on 24 hours,
some of them. I took a picture just before I left to come here, they have never been addressed to
the extent that the code calls for. Never. But I am being arraigned. Ask if I am ashamed of my
town, ask me if I am angry with my town, ask me if I have been insulted by my town. I don't
understand this. It's like a Fellini movie. Dead silence. Thank you.

GENEVIEVE BAHRENBURG: Genevieve Bahrenburg. My house is dead center in Orient and
there are several different things I am trying to do to organize, to bring the organization of
Southold into Orient. Poquatuck Hall. I came here earlier this week and I took some of the
pictures you have here and then I put them on a poster at Poquatuck but what I am trying to do
with Poquatuck is to organize it as,to have the organization you have here, to bring it there.
Because what has happened in Orient, we have several different areas that are doing different
things, all of which are great and I am a big fan of but what I am trying to do with Poquatuck is
to create a place for organization and in doing that, I mean the organization you all have here
there as well. What I am trying is Village Lane, we need road work on there because it is great
all the way to the school and the (inaudible)but what I am looking for is to have Village Lane
upgraded that, in addition to that, (inaudible)what I hadn't seen is we have gotten a lot about
DEC, this was from before about Orient Harbor(inaudible)
