Public Hearing on Chapter 280 Zoning Use Regulations was held on November 30, 2021 @ 7:02 PM Testimony was taken and the public hearing was closed. This Local Law was NOT adopted. The Resolution was WITHDRAWN. It will be further reviewed and discussed by the Town Board and Town Attorney. Substantial changes will be made to it. BE IT ENACTED by the Town Board of the Town of Southold as follows: 1. Purpose. It has been determined by the Town Board that there is a continuing need for affordable rental units within the Town of Southold. It has further been determined that the development of such units must be properly regulated in order to maintain community character and manage growth in accordance with the Comprehensive Plan. Accordingly, an amendment to Chapter 280 is warranted. II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows: § 280-13. Use Regulations. In A-C, R-80, R-120; R-200 and R-400 Districts; no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used. in whole or in part. for any uses except the following: A. Permitted uses. Wilcenski, Chairman Members of the Planning Board Re: Request for Planning Comments—Conversion of Buildings to Apartments Local Law in relation to Amendments to Chapters 280-13, 280-17, 280-38, 280-41, 280- 44, 280-48, 280-=58 and 280-62, each entitled Use Regulations. In response to the Town Board's request for comments on the local law referenced above,the Planning Board provides the following review and recommendations. This series of code amendments proposes to expand and add clarification to a use that was added to eight zoning districts in December 2017. This use, "Conversion of existing space to affordable residential housing"was added to encourage the re-use of vacant buildings for apartments to increase the number of affordable rentals in the Town. The current code accomplishes this by allowing apartments to be created as a principal use, where in the past they had been allowed in most zoning districts only as an accessory use. The zoning districts to which this was added were as follows: • Agricultural-Conservation(A-C) District and Low-Density Residential R-80, R-120,R- 200 and R-400 Districts • Low-Density Residential (R-40) District • Residential Office(RO)District • Limited Business (LB)District • Hamlet Business(HB)District • General Business(B)District • Light Industrial Park/Planned Office Park(LIO) District • Light Industrial(LI)District 1 Currently the code classifies this use under the Special Exception category in all zoning districts, meaning all proposals must go to the Zoning Board of Appeals. Uses in this category are subject to a higher level of scrutiny than the Permitted Uses category. This higher level of scrutiny includes whether the proposed apartments fit into the character of the community (see Town Code §280-142 & 143 for the full list of standards and matters to be considered in reviewing Special Exception uses). The existing code has the following conditions for this use: • Existing space only (no additions allowed) • Located within a HALO (only for R-80,R-40) • Maximum of six"moderate income residential rental units" • Tenants must be on the Town of Southold Housing Registry • Owner must create the residential use within six months of approval • Rent at or below the maximum allowable monthly rent for affordable housing units • Maintain as apartments for at least eight years • One parking space per unit The proposed amended code that is the subject of this local law makes several significant changes and adds clarifications. See Table 1 for a side-by-side comparison. Table 1. Existing code compared to the proposed code. The current code references "affordable residential housing" and"moderate-income residential rental unit", neither of which have official definitions. The proposed code replaces these terms with"apartment", which is defined in the Town Code §280-4. Apartment Definition: An entirely self-contained dwelling unit consisting of a minimum of 450 square feet of living area containing complete housekeeping facilities for only one family, including any domestic servants employed on the premises and having no enclosed space (other than vestibules, entrance hallways or porches) or cooking or sanitary facilities in common with any other dwelling unit and/or "apartment." Two other changes are moving the use to the Permitted Uses section of each zoning district and allowing the apartments to be developed without having to remove other uses. The Planning Board is recommending that both these changes be examined more closely and edits to this proposed code be considered by the Town Board prior to adopting it. More details about these recommendations are provided below. 3 Change from Special Exception to Permitted Use In the current code the use is categorized as a Special Exception and must receive scrutiny from the Zoning Board of Appeals (ZBA) for a multitude of requirements. Below are a just a few of the many standards and matters to be considered in a Special Exception review(Southold Town Code Chapter 280. Zoning, Article XXV. Special Exception Uses, § 280-142. General standards & § 280-143. Matters to be considered). • That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. • That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general,particularly with regard to visibility, scale and overall appearance. • The conservation of property values and the encouragement of the most appropriate uses of land. • Whether the use or the structures to be used therefor will cause an overcrowding of land or undue concentration of population. • Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. • Whether the site of the proposed use is particularly suitable for such use. • Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. In comparison,these proposed code revisions move the use to the Permitted Use category (when no expansion of the building is proposed). This means that each new project will be subject to very little scrutiny over whether it fits the character of the community. While site plan from the Planning Board is required, they will not have the ability to evaluate whether the use fits the character of the neighborhood. This is because as a Permitted Use, it is assumed it fits the character. While this might be true within the hamlet centers, there is a concern when the entire HALO zone is considered. HALO zones extend far into residential neighborhoods where the zoning is all residential(R-40, R-80, RO). See the attached Hamlet Center& HALO Zone maps for each hamlet(Figures 1 —9).Note that Fishers Island does not have a designated Hamlet Center or HALO zone. If this code is adopted as currently written,those residential neighborhoods could see multiple homes being converted to apartments with no regard for the character of the community and the other balancing tests the ZBA would conduct as part of the Special Exception review. The Planning Board's recommendation is to place this use entirely within the Special Exception category for the residential zones (R-80, R-40, and RO),whether or not expansion of the building is proposed. The Town Board might also consider whether this change is advisable for the Limited Business (LB) zoning district which is intended to be a transition zone. 4 Permitting Multiple Uses on Undersized Parcels In the code that currently exists, if someone proposes to convert their building to six apartments, they would not be able to keep a second use (like a retail store),unless their lot area was twice the minimum lot size required. These code revisions change that by stating that `if only a portion of the building is being converted to apartments pursuant to this section, the apartments shall not be deemed an additional use on the property'. This essentially allows two uses on parcels that are undersized. While cases where this would be desirable are possible,there are also many scenarios where this section will cause confusion, or worse,have an undesirable effect on the neighborhood. One example of this would be a parcel with a single-family home being able to convert a barn in the back yard to multiple apartments. Another would be a building with a thriving business in the front being able to convert the back to multiple apartments. Both scenarios might be fine under the right circumstances, however having a higher level of scrutiny is advisable. This higher level of scrutiny would come from the ZBA reviewing them for an area variance. Further,this clause is inconsistent with other sections of the code that regulate accessory apartments. The code already allows accessory apartments in most zoning districts. By adding the statement that the use of apartments is not to be considered another principal use,the use is made very similar to accessory apartments,but with different rules. With the original intent being in part to find a use for unused buildings that also fulfills a need in the Town, it seems unnecessary to start accommodating the partial conversion of buildings and allowing multiple uses on undersized parcels. The Planning Board feels that the problems outweigh the benefits of this clause and recommends removing that clause entirely from all zoning districts. Property owners will have the opportunity to request an area variance if they wish to propose apartments under this clause and keep a second use on the property. Formatting The Planning Board found several other minor issues with the format of the proposed code. Please see attached formatting suggestions. These include the changes recommended above. The Planning Board recommends using the formatting suggested, regardless of whether the substantive changes recommended above are made. We have included a marked-up redline version highlighting the recommended edits, as well as a clean version with all the edits completed. It has been determined by the Town Board that there is a continuing need for affordable rental units within the Town of Southold. It has further been determined that the development of such units must be properly regulated in order to maintain community character and manage growth in accordance with the Comprehensive Plan. Accordingly, an amendment to Chapter 280 is warranted. II. Chapter 28.0 of the Code of the Town of Southold is hereby amended as follows: § 280-13. Use Regulations. In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses.
