POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1-2 days after the meeting. A full copy of the minutes, agenda
and meeting video can be viewed by going to the official Town of Southold website:
www.southoldtownny.gov and following either of the following:
(1) Move pointer over “Government” on the Town website home page. You will find the title
“Town Supervisor/Town Board”. Under this title you will see “Southold Town Board Meetings
and Agendas”. or
(2) Go to “How Do I”, in the right upper corner of the Town website home page, Choose
“Access”, then “Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the
resolutions. (Scroll to bottom of page for KEY to symbols). You can view the live video of the
meeting by clicking on the camera symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor’s Executive Orders regarding the
COVID-19 pandemic in-person access to the Public will now be permitted. The meeting will
still be accessible via Zoom and streamed live on the Town’s website. The meeting can be
viewed live by going to the Town’s website at www.southoldtownny.gov home page. Click on
the “Government” tab, once the drop down menu appears, under “Town Supervisor/Town
Board”, click on “Southold Town Board Minutes and Agendas” which takes the user to the
Town of Southold Meeting Portal page. Once on the Meeting Portal page, click on “June 29,
2021 4:30PM” and then click on “Video”. A recording of the meeting will also air on Channel 22
and will be posted on the Town’s website

Instructions and link to attend the meeting will be available on the Town’s website or by calling
the Town Clerk’s office at (631)765-1800. A telephone number will also be provided to allow
members of the public to attend via telephone.
Written comments and/or questions may also be submitted via email to the Town Clerk at

and/or questions will be considered at the public hearing provided that they are submitted no
later than 12:00 P.M. (Prevailing Time) on the day of the public hearing.
Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a
transcript will be prepared of the public hearing, and a copy shall be filed with the Town Clerk
and placed upon the Town's website.

Section 1. Legislative Intent.
This Local Law proposes to amend the Town of Southold Water Supply Plan Map to include the
extension of a water transmission main across the Central Drive Spur toward 950 Red Fox Road,
Mattituck SCTM# 1000-106.00-01.00-023.001. Historically, the Water Supply Plan Map
reflects the physical changes in the water supply network since 2000. The property owner,
Jennifer Leuba, has represented to the Town that the groundwater quality at this property is
inadequate and poses a significant concern that requires the extension of public water to the
property. The extension of the transmission main is intended to supply the Leuba property and is
not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County Department of
Health Services to provide safe drinking water to the Leuba property, and upon our consideration
of the recommendations of the Town Planning Department, and the public comments taken at the
public hearing, we hereby amend the Town of Southold Water Supply Plan Map to include the
extension of a water transmission main to 120 Old Main Road, Mattituck.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000 by the
Town Board, and most recently amended by Resolution No. 2010-478, is hereby amended to
reflect the extension of a water transmission main to 950 Red Fox Road, Mattituck.
Section 4. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 5. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. A new Chapter 106 of the Code of the Town of Southold is hereby adopted as follows:
A Local Law entitled, “A Local Law Opting out of Adult Use Cannabis Retail
Dispensaries and On-Site Consumption Sites”.
§ 106-1 Legislative Intent
It is the intent of this local law to opt out of allowing cannabis retail dispensaries and on-
site cannabis consumption sites in the Town of Southold that would otherwise be allowed
under Cannabis Law Article 4.
New York Cannabis Law requires Towns to opt out prior to December 31, 2021 or forever
lose the right to do so. Thus, in order to allow the public to decide for themselves by
permissive referendum whether to allow retail dispensaries and on-site consumption in the
Town of Southold it is necessary to opt out at this time.
§ 106-2 Authority.
This local law is adopted pursuant to Cannabis Law § 131 which expressly authorizes the
town board to adopt a local law requesting the Cannabis Control Board to prohibit the
establishment of cannabis retail dispensary licenses and/or on-site consumption licenses
within the jurisdiction of the town and is subject to a permissive referendum, the

procedure of which is governed by Municipal Home Rule Law § 24.
§ 106-3 Local Opt-Out.
The Town Board of the Town of Southold hereby opts out of allowing cannabis retail
dispensaries and on-site cannabis consumption sites from being established and operated
within the Town's jurisdiction.
II Severability.
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application
thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of
competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect,
impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, subdivision, or part of this Local Law or in its application to the person,
individual, firm or corporation or circumstance, directly involved in the controversy in which
such judgment or order shall be rendered.
III Permissive Referendum/Referendum on Petition
This local law is subject to a referendum on petition in accordance with Cannabis Law § 131 and
the procedure outlined in Municipal Home Rule Law § 24.
IV Effective date.
This local law shall take effect immediately upon filing with the Secretary of State.

WHEREAS, said property is identified as part of SCTM #1000-115.-10-1. The address is 4180
New Suffolk Avenue in Mattituck. The property is located in the R-80 Zoning District and is
situated at the southeasterly corner of Marratooka Road and New Suffolk Avenue in Mattituck,
New York; and
WHEREAS, the proposed acquisition is for a development rights easement for agricultural
purposes on a part of the property consisting of approximately 11.9± acres (subject to survey) of
the 15± acre parcel. The exact area of the acquisition is subject to a Town-provided survey
acceptable to the Land Preservation Committee and the property owner; and
WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase
price is $69,000.00 (sixty-nine thousand dollars) per buildable acre, estimated at $821,100.00
(eight hundred twenty-one thousand one hundred dollars) for the 11.9± acre easement. The
purchase price is below that of the value indicated in the Town’s commissioned appraisal.
Purchase price will be adjusted at time of closing based on final survey acreage determination,
plus acquisition costs; and
WHEREAS, the property is listed on the Town’s Community Preservation Project Plan; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
(“LWRP”) and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,
WHEREAS, THE TOWN BOARD OF THE TOWN OF SOUTHOLD CLASSIFIES THIS
ACTION AS AN UNLISTED ACTION PURSUANT TO THE SEQRA RULES AND
REGULATIONS, 6NYCRR 617.1 ET. SEQ.; AND,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
It has been determined by the Town Board that there is a continuing need for affordable
rental units within the Town of Southold. It has further been determined that the
development of such units must be properly regulated in order to maintain community
character and manage growth in accordance with the Comprehensive Plan. Accordingly,
an amendment to Chapter 280 is warranted.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
§ 280-13. Use Regulations.
In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used
and no building or part of a building shall be erected or altered which is arranged,
intended or designed to be used, in whole or in part, for any uses except the following:
A. Permitted uses.
(8) Conversion of an existing building or a portion thereof, to apartments, subject
to the following conditions:
(a) The number of apartments shall be limited to a maximum of six
apartments;
(b) The existing building to be converted must be located on a parcel
within a designated Hamlet Locus (HALO) Zone or Hamlet Center;
(c) The apartments to be created shall be subject to the following
conditions:
(1) The apartments shall be offered for rent;
(2) the eligible applicants for tenancy must be registered in the
Town of Southold Housing Registry, administered by the
Government Liaison Officer prior to the commencement of
any tenancy;
(3) the maximum rent charged may not exceed the maximum rent
set forth in section 280-30(D), in perpetuity;
(4) tenants must work or reside in the Town of Southold at the
time they take possession;
(5) the use, once approved, may not be changed to another
permitted use for a minimum period of eight (8) years;
(6) The subject parcel, the subject building, and the apartments
must remain in common ownership;
(7) Town of Southold rental permits must be obtained for each of

the apartments.
(8) The parcel must have at least one parking space per
apartment;
(d) Site plan approval shall be required:
1. the Planning Board shall expedite the site plan application
process pursuant to section 180-133 (C) to the greatest extent
possible, and;
2. as a condition of site plan approval, property owners must
convert the existing building to the apartment house use within
six months of site plan approval;
(e) For purposes of the Bulk Schedule, if only a portion of the building
is being converted to apartments pursuant to this section, the
apartments shall not be deemed an additional use on the property.
B. Uses permitted by special exception by the Board of Appeals. The following uses are
permitted as special exception by the Board of Appeals, as hereinafter provided, and,
except for the uses set forth in Subsections B(1), (13) and (14) hereof, are subject to
site plan approval by the Planning Board:
(17) Conversion of existing space to affordable residential housing. \[Added 12-
5-2017 by L.L. No. 20-2017\]
(a) Tenants shall be reserved to moderate-income individuals and families who
do not have any ownership interest in any other residence or vacant lot.
Tenants must work or reside in the Town of Southold at the time they take
possession. The eligible applicants must be registered in the Town of
Southold Housing Registry, administered by the Government Liaison
Officer prior to the commencement of any tenancy.
(b) Converted space shall be limited to a maximum of six moderate-income
residential rental units.
(c) As a condition of the granting of a special exception by the Zoning Board
of Appeals, property owners must convert said applied-for space to
residential use within six months, rent the units at a rate at or below the
maximum allowable monthly rent for affordable housing units, and
maintain the excepted residential units as affordable residential housing for
a minimum period of eight years from the date of granting.
(d) All converted affordable residential housing shall be subject to all Town
and county building code and septic specifications.
(e) All converted affordable residential housing must have at least one parking
space per unit.
(f) The premises must be located within a designated hamlet locus (HALO)
zone.
(17) Conversion and expansion of an existing building to apartments, subject to
the following conditions:

(a) The number of apartments shall be limited to a maximum of six
apartments;
(b) The existing building to be converted must be located on a parcel

(a) Tenants shall be reserved to moderate-income individuals and families who do
not have any ownership interest in any other residence or vacant lot. Tenants must work or
reside in the Town of Southold at the time they take possession. The eligible applicants
must be registered in the Town of Southold Housing Registry, administered by the
Government Liaison Officer prior to the commencement of any tenancy.
(b) Converted space shall be limited to a maximum of six moderate-income
residential rental units.
(c) As a condition of the granting of a special exception by the Zoning Board of
Appeals, property owners must convert said applied-for space to residential use within six
months, rent the units at a rate at or below the maximum allowable monthly rent for
affordable housing units, and maintain the excepted residential units as affordable
residential housing for a minimum period of eight years from the date of granting.
(d) All converted affordable residential housing shall be subject to all Town and
county building code and septic specifications.
(e) All converted affordable residential housing must have at least one parking space
per unit.
(f)The premises must be located within a designated hamlet locus (HALO) zone.
(3) Conversion and expansion of an existing building or a portion thereof, to apartments as set
forth in and regulated by § 280-13 (B) (17) of the Agricultural-Conservation District.
§ 280-38 Use Regulations.
A. Permitted uses.
(4) Conversion of an existing building or a portion thereof, to apartments as set
forth in and regulated by § 280-13 (A) (8) of the Agricultural-Conservation
District.
B. Uses permitted by special exception by the Board of Appeals. The following uses are
permitted as a special exception by the Board of Appeals as hereinafter provided and
subject to site plan approval by the Planning Board, provided that not more than one use
shall be allowed for each 40,000 square feet of lot area:

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
