SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County,Administrative Code Sections A 14-14 to 23,and the Suffolk County"Department of Planning issued its reply dated May 21,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 14, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy#4.1 standards and therefore is INCONSISTENT with the LWRP. Both Chapter 275 Wetlands and Shorelines and Chapter 280 Zoning of the Town of Southold Town Code requires a 100' setback from a pool and related structures to a bluff system. The intent of the setback is to minimize impacts on the natural protective-feature and protect structures from damage and loss due to storms and erosion over time. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was forwarded to the District for commentary. Their reply, dated June 3,2021 indicates a site inspection was performed on May 27,2021 observing that the department previously evaluated the site in January 2017 (prior to the redevelopment of the residence)and offered the following commentary: The proximity of the proposed pool at 44.4 feet from the top of the bluff may cause issues in the future. The current condition of the bluff suggests it is already experiencing runoff issues. Proper measure should be done to significantly improve the bluffs current condition and further reduce potential issues from affecting the structural integrity of the bluff. The use of heavy machinery near the top of the bluff is not encouraged because it can result in further degradation of the bluff's stability and can be dangerous. Eliminating any potential stormwater,greywater,irrigation water,pool water, and/or other runoff from being discharged on or near the bluff is also highly recommended. There are several other factors that can be done,to help stabilize the bluff and reduce further erosion from occurring. The District encourages planting native-bluff plant species along the top, face, and toe of the bluff. A diverse Page 2,November 18,2021 #7521,LaValle SCTM No. 1000-15-3-7 selection of native bluff-niche plant species will successfully reduce bluff erosion by properly minimizing soil exposure and creating a strong root system to hold the soils in place during large storm events. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 26,355 square feet, .613 acre, rectangular- shaped, waterfront parcel, located in the R-40 Zoning District, measures 100.00 feet along Sound View Road, then runs north 265.48 feet along a residentially developed lot to the east,then runs west 100.00 feet along the shoreline of the Long Island Sound,then returns south 268.14 feet along a second residentially developed lot to the west. A 10 feet wide easement from Sound View Road to the Long Island Sound is shown on the westside of the lot and a 15 feet wide non-turf buffer runs the width of the lot at the crest of the bluff. The property is improved with a two-story, wood-frame residence with attached rear deck,waterside covered porch and adjacent brick patio,a gravel driveway, basement access stairs, and a small, wood deck with stairs leading from the top of the bluff to the beach below, as shown on the survey prepared by Paul Barylski, Licensed Land Surveyor, dated November 5, 2016 and revised to illustrate pool placement,May 5,2021. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1); and the Building Inspector's March 12, 2021,Amended May 12, 2021 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at 1) located less than the code required 100 feet from the top of the bluff; located at: 555 Sound View Road, (Adj.to Long Island Sound)Orient,NY. SCTM No. 1000-15-3-7. RELIEF REQUESTED: The applicant requests an area variance to locate an inground swimming pool and hot tub, measuring 16 feet by 36 feet in a compliant rear-yard location, 44.4 feet from the top of the bluff where the code requires such improvements to be located a minimum of 100 feet from the top of the bluff. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on September 24,2021 submitted a revised pool plan by Jonathan S.Foster,RA dated September 12, 2021 and,labeled POOL LAYOUT increasing the setback to 68 feet from the top of the bluff, as a result of rotating the pool placement and reducing the proposed pool size to 13 feet by 36 feet, thereby bringing the plan into more conformity with the codes. The applicant also at this time provided copy of an updated survey prepared by Paul Barylski, Licensed Land Surveyor, dated September 13, 2021 with revisions to illustrate pool placement. ADDITIONAL INFORMATION: No member of the public or an immediate neighbor spoke in favor of or against this application. A letter of support was received August 3, 2021. Despite relief granted to locate the redeveloped residence at 83.1 feet from the top of the bluff,the applicant chose to build the house at 100 feet from the top of the bluff,thereby conforming to the Code. The subject parcel is covered by the following Town of Southold issued documents: • Certificate of Occupancy Z-40156 dated January 8,2019 covering a one family dwelling with rear enclosed porch, rear first and second story decks, front entry, attached garage and unfinished basement per ZBA- decision#7026, dated February 16, 2017, as applied for. • Authorization of a Request for De Minimus determination, consenting to the relocation of the proposed residence 83.1 feet from the top of the bluff where previously 67.5 feet was granted. • ZBA decision #7026 dated February 21, 2017, granting relief for alterations and additions to a residence, located 67.5 feet from the top of the bluff where the Code requires such improvements to be a minimum of 100 feet from the top of the bluff. • ZBA decision#2176(now VOID)dated September 2, 1976,granting relief for the construction of an attached garage to a residence,resulting in a non-conforming front yard setback of 33 feet from the front yard setback. Page 3,November 18,2021 #7521,LaValle SCTM No. 1000-15-3-7 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5, 2021 and November 4,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Orient-by-the-Sea, beachfront community, consists of homes developed in the last quarter of the 201'century. Many homes, including those located directly on the water have private pools,several of which are closer than what the applicant proposes. The immediate westerly and easterly properties to the subject premises have pools located closer to the bluff than the proposed pool(435 Sound View Road and 735 Sound View Road). When redeveloping the site,the applicant was previously granted relief by the ZBA to locate the newly constructed residence at 67.5 feet from the top of the bluff(revised to 83.1 feet from the top of the bluff as the result of a De Minimus request),where the code requires improvements to be a minimum of 100 feet from the top of the bluff. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. As the result of the location of a 10-feet wide right of way running along the western lot line and the existing sanitary system by the eastern lot line,placement of the pool is not possible in a side yard location,which would alternatively require variance relief. Furthermore,the pool cannot be placed in a conforming front yard location as that portion of the property is encumbered by drywells required for storm water management. A pool in a front yard location would be out of character of this neighborhood and would negatively impact the community. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 32%relief from the code. However, the applicant was previously granted relief for additions and alterations and redevelopment of a previously existing house at 67.5 feet from the top of the bluff. A dimensional structure, such as a two-story residence would have greater impact on the environment,the stability of the bluff and an adverse impact on adjacent and neighboring site lines and view than a pool located at grade. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased and redeveloped the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase and redevelopment. 6.Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an inground swimming pool and hot tub measuring 13 feet by 36 feet while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman, Chairperson, and duly carried,to GRANT the variance as AMENDED, and shown on the revised survey prepared by Paul Barylski, Licensed Land Surveyor, last revised September 13, 2021. Evaluation of this property has been conducted. This single-family dwelling located at 555 Sound View Road, Oreint NY is adjacent to the bluff, facing the Long Island Sound, in a residential area. The proposal for this site is to construct an accessory in-ground swimming pool and small patio in the backyard. This document contains information on what has been observed in relation to potential bluff erosion issues. A site visit was conducted on May 27th, 2021, in response to your request to review and evaluate a proposal for the parcel located at 555 Sound View Road, Orient NY. The proposal has been previously disapproved for the following reasons: The proposed swimming pool, on this nonconforming 26,355 sq. ft.parcel in the Residential R- 40, is not permitted pursuant to Article XXII Section 280-116A(1), which states: "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the beach shall be set back not fewer than 100 feet from the topof such bluff. bluff. Office Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. friday 7:30 a.m. through 3:00 p.m. Observations and Current Conditions: The site had been previously evaluated by the Suffolk County Soil and Water Conservation District, in January of 2017. Previously, technicians observed evidence of severe erosion throughout the top, face, and toe of the bluff, listed areas of concern, and provided recommendations to improve the integrity of the bluff. Upon arrival, it appears the topography is slightly pitched from the southern side of the property towards the bluff. The adjacent property on the west side appears to be at a higher elevation which is pitched north/north east (towards the bluff). The property's lawn is covered by turf grass with minimal soil exposure—which is only present in the garden beds along the east side of the property. There is minimal evidence of stormwater runoff leading to the bluff from the dwelling. All gutters and downspouts appear to discharge into the ground to drywells. There are a few irrigation heads present near the top of the bluff that were seen on the east side of the property within a garden bed. Along the top of the bluff is a graveled area for outdoor lounge seating. The proposed pool is roughly 41 feet from the top of the bluff. The staircase down the bluff to the beachfront is in good condition. However,the bluff itself is in moderately poor condition. There are several areas of gully and rill erosion present on the bluff. Other stabilizing structures like geotextiles may be used to help get these plants established and may further help minimize erosion issues. It is essential to note that these plants should be a variety of native-bluff specific species. Monocultures are easily susceptible to "whip-outs" from disease, pests, weather conditions, etc. which can cause the bluff to become prone to further destabilization. Non-native/ornamental plants will not be as affective in stabilizing the bluff, can be invasive, and may even cause additional issues. A diverse selection of native bluff-niche plant species will successfully reduce bluff erosion by properly minimizing soil exposure and creating a strong root system to hold the soils in place during large storm events. The proposed pool will be in keeping with surrounding pools. The immediate westerly and easterly properties to the subject premises have pools located closer to the bluff than the proposed pool. Other homes in the immediate neighborhood with pools include 135 Soundview Road (#6630) and 1055 Soundview Road (#7336 ), 1391 Soundview Road and 1500 Latham Lane, all in Orient Point. - 2) The benefit sought cannot be achieved other than with an area variance because placement of the pool in side yards is prevented by the Right of Way granted to the Town of Southold to the West and newly installed septic system to the East. The front yard is also encumbered by drywell required for Storm Water Management. A front yard installation would in addition adversely affect the character of the neighborhood. The rear yard is the only alternative for a pool installation and available only through a variance grant. 3) The relief requested is not substantial. The 100 foot setback requirement renders the entire back yard nonconforming. The lot coverage area with the proposed pool would be 14.44 %, substantially below the allowable 20% mandated by the Town Code for lots between 20,000 and 39,999 square feet. 4)The variance will not negatively affect the physical or environmental conditions. Upon purchasing the property in 2016 the then existing house was located 67.5 feet from the bluff. The Zoning Board of Appeals under application #7026 approved for renovation this house in the same location, larger and with a new foundation. That, in order to gain further distance from the bluff it was recommended that I remove the then existing house and rebuild 100 feet from the bluff, satisfying all set back requirements for the side, rear and front lines. The prior decisions would have allowed me to build a . is p house closer to the bluff(67.5 feet,) this affording me more options in building a pool in other locations. Even under that plan any proposed pool would not have been built in a conforming location. Relying however on the fact that a house existed so close to thgECEIVED bluff I was unaware that once removed I would not be able to rebuild in the same '1,5 location. �SEP 2 4 2.021 It is noted though that the Suffolk County SWCD report# 7026 for the house ZONING BOARD OF APPEALS construction indicated that at the time of visit the property upland of the bluff appeared to be in stable condition...no signs of erosion are evident. The requirement of a 15 foot non turf buffer by the Southold Town Trustees has been installed to further protect the bluff and it is my intention to perform further remediation with local plantings to further protect the bluff at some point in the immediate future. 5) The lot is pre-existing nonconforming. The existing home prevents the placement of the pool in any area other than the rear yard. The pool as reduced in size and location is the minimum that is necessary and adequate, intending to preserve and protect the character of the neighborhood and the health of the natural surroundings. 6) The difficulties created are unique to the topography and not personal to myself. The difficulty was not created by myself as the nonconformity of the land and the preexisting building did not meet all setbacks for both front, rear and side yards and would have required a variance either for the preexisting house or the now applied for pool. The Zoning Board of Appeals has granted rear yard in ground pool variances under Basios (#7364), Yatrakis (#6237) and McAllister (#4976) where relief was granted upon applicant's reliance on a demolition permit for existing residence and did not recognize that they would not be entitled to rebuild in previously developed location. A similar application was recently decided by the Zoning Board of Appeals under Zoitas (#7525) in 2021. That pool application was approved for a much larger pool than the proposed pool under this application and at a comparable distance relative to the lot sizes. The proposed pool will conform to all regulatory standards. Air quality will not be affected as it is for residential use. Run off or emptying of the pool shall be to drywells, and shall have no effect on flooding or erosion. My house at 555 Soundview Road, is located in an area of Orient Point where there are multiple homes with pools in the rear of the premises (on the waterside) facing a low bluff. Both homes on either side (Westerly and Easterly) of my house currently have non- conforming swimming pools adjacent to the bluff (specifically 435 and 735 Soundview Road). The distances of both these pools being less than 100 feet from the bluff. Other addresses with similarly situated pools are 1500 Latham Lane, 1391 Soundview Road, 1055 Soundview Road, all in Orient Point in the immediate vicinity of my house. I can see no adverse impact in my residential community as I am surrounded by pools on either side. Furthermore, the Zoning Board of Appeals should be informed that at the time of purchasing the property, the original house was located closer to the bluff. In order to meet strict requirements and to better preserve the natural landscape, I decided to demolish the existing house and move the house further landward to 100 feet. At the time, the existing house was approximately 67.5 feet from the bluff. I also reduced the foot print of the proposed house and the size of the proposed house to reduce the impact on the bluff. I understand the Zoning Board of Appeals has in the past allowed a pool installed on the side or front yard, however on the Westerly side of my house a 10 foot Easement to The Town of Southold exists and on the Easterly side the septic systems prevents a pool. The front yard is further encumbered by dry wells required by Storm Water Management. There is room on the property to locate the pool near the house thereby increasing the setback to the top of bluff. Policy 4:The Town Board of Trustees requires a setback of 50 feet from a pool and related structures to a top of bluff. Policy 4.1: In order to minimize potential loss and damage,structures should be located as far from erosion hazards as possible. It is recommended that the pool is relocated to achieve the greatest setback from the top of bluff. Policy 6.3: Development on or near bluff ecosystems has resulted in loss and impairments to these and other dependent natural features (beaches) and their functions; cumulatively impacting the Town of Southold's ecosystem. Based upon the aforementioned comments by the LWRP Coordinator, the Board requested that the applicant relocate the pool to a more conforming location in order to mitigate the described adverse impacts to the environment. Agency comments include: • Irrigation located throughout the property should be monitored and regularly maintained to eliminate the risk of erosive runoff and ensure stability of the bluff face. • It is essential for the health of the bulkhead and stability of the bluff to perform regular maintenance on the structure. • Installation of a pool is a ground disturbing activity. It is important to use caution during any type of construction in close proximity to the bluff. Compaction from heavy machinery should be minimized by creating and utilizing necessary paths to enter, work and exit the property. Areas that have experienced disturbance of vegetation should be revegetated with plant species native to the ecology. • Heavy equipment should not be stored near critical areas of bluffs or near any unstable soils. • Water runoff is a major contributor to bluff destabilization. It is advised to vegetate bare soil with native species to mitigate the effects of stormwater runoff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6,2020 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3,February 20,20202 #7364,Basios SCTM No. 1000-94-1-12.2 1. Town Law 4267-b(3)(b)(1). Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes setback 100 feet or more from the top of the bluff. Swimming pools in code conforming locations are characteristic in this neighborhood. However, the placement of the existing home does not leave space to construct a swimming pool in a rear yard location and still meet the code required minimum 100-foot setback from the top of the bluff. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The applicant could build a swimming pool located in the side yard in order to meet the code required minimum 100 foot setback from the top of the bluff, or in a code conforming front yard if the sanitary system is not located there. However, the proposed 76-foot bluff setback is the minimum distance from the bluff that is practical to allow the pool to be placed in the code permitted rear yard. 3. Town Law 4267-b(3)(b)(3). The variance as Amended granted herein is mathematically substantial, representing 24% relief from the code. Additionally, the relocation of the swimming pool partially located in the side yard is mathematically substantial representing 100% relief from the code. However, the house is exists and the applicant is proposing the minimum practicable bluff setback while constructing the pool in the code conforming rear yard. 4. Town Law §267-b(3)(b)(4). Comments received from the LWRP coordinator suggest that a variance in this residential community may have adverse impacts on the physical or environmental conditions in the neighborhood. The coastal area may be adversely affected by structures that are located in close proximity. The applicant has attempted to mitigate any possible impacts by increasing the top of bluff setback to 76 feet. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. S. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of relief As Amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson),and duly carried,to GRANT RELIEF AS AMENDED as follows for a swimming pool located 76 feet from the top of the bluff and shown on the survey prepared by Howard W. Young,L.L.S. last revised February 6,2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. A Drywell for pool de-watering shall be installed. 4. Approval from the Board of Town Trustees is required. 5. Any deviation from the variances) granted AS AMENDED herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
