SCTM#1000-106-2-16 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 16,988 square foot parcel in the Residential R-40 Zoning District. The northerly property line measures 92.01 feet, the easterly property line measures 201.90 the southerly property line along Central Drive measures 90.00 feet and the westerly property line measures 182.78 feet. The parcel is improved with a one-story frame dwelling with an attached one-car garage and an attached wood deck at the northwest corner of the rear of the residence. There is an outdoor shower at the rear northeast corner of the residence as shown on the survey map prepared by Thomas Matarazzo,LS, and dated April 1, 2021. BASIS OF APPLICATION: Request for Variance from Article XXIII, Sections 280-124 and the Building Inspector's June 11, 2021 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling;at; 1)located less than the code required minimum side yard setback of 10 feet; located at 990 Central Drive,Mattituck,NY. STM#1000-106-2-16. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to an existing residence The proposed construction, is not permitted pursuant to Article XXIH, Section 280-124 which states: lots measuring less than 20,000 square feet in total size require a minimum side yard setback of 10 feet. The survey shows proposed construction with a side yard setback of 9.4 feet. ADDITIONAL INFORMATION: The neighboring community has many homes that have been updated and renovated in recent years. Page 2,November 18,2021 #7555,Mamais SCTM No. 1000-106-2-16 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 4, 2021at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This applicant wishes to improve the residence by raising a portion of the roof to match the existing roof height for more attic storage and to construct a conforming covered front porch. The applicant is staying within the existing 9.5-foot non-conforming side yard setback and the footprint of the dwelling. The new roof addition will have a gable roof as shown in the Architectural Plans prepared by Robert James Higgins dated July 6, 2020, and will improve the esthetics of the residence. The existing setback is 9.4 feet where 10 feet is the code required minimum setback allowed along with the new covered front porch. There is no request to add more living space. The surrounding neighborhood has and is going through change with upgrades to the older homes along with new homes being built. The upgrade to this residence will have a positive impact to the neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling is existing and the footprint will remain the same. The required minimum side yard setback is 10 feet and the existing setback is 9.4 feet. 3. Town Law X267-b(3)(b)(3). The variance granted herein is not mathematically substantial,representing 6% relief from the code. However, since the setback does not meet the required code,the variance is needed. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an esthetic roof change and covered new front porch,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the variance as applied for, and shown on the survey map prepared by Thomas Matarazzo, L,S and dated April 1,2020,and the Architectural Plans prepared by Robert James Higgins,Architect and dated July 6, 2020. All proper permits must be obtained from the Building Department to lift a recent Stop Work Order that was issued for inside and outdoor work begun without approvals. 2. A Certificate of Occupancy (C of O) must be obtained for the rear outdoor shower. Condition for Possible Demolition, if applicable 1. Prior to receiving a building permit,the owner(s) of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition, as defined by Section 280-4 of the Town Code,12 occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town Code. NOTE:Section 280-4 of the Town Code defines "Demolition"as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50%of the market value of the existing structure before the start of removal. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, NOTE:Section 280-4 of the Town Code defines "Demolition"as any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50%of the market value of the existing structure before the start of removal.
