SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply.dated July 30, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is an approximately 40, 000 sq. ft. parcel located in an R-40 Zoning District. The property has a 170.00 feet road frontage along Grand View Drive, then turns east for 240.23 feet to the rear property line where it turns south for 145.00 feet before returning 266.67 feet back to Grand View Drive. The property is improved with a two-story frame house currently under construction as shown on survey prepared by Ward Brooks,L.S., surveyed March 4,2021, received November 4, 2021. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's May 27,2021,Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at; 1) located in other than the code permitted rear yard; located at: 710 Grandview Drive, Orient,NY. SCTM No. 1000-14-2-3.34. RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool in a side yard,where a rear yard location is required. ADDITIONAL INFORMATION: During the hearing, testimony was given by the owner and owner's agent as to the siting of the pool for maximum sunlight. Resulting from the Board Member's questions, it was discovered that the house does not have a Certificate of Occupancy and that final inspection has not yet been completed. The owner testified that the well was waiting to be certified by the Suffolk County Department of } Page 2,November 18,2021 #7554,Jacquet SCTM No. 1000-14-2-3.34 Health, and described the mulch pile heating system on the property as the home's main source,of heat. The Building Department is awaiting engineering drawings and certifications for its use. It was further determined that a deer fence enclosing raised planting beds in the 'rear yard is currently not permitted. The Board informed the applicant and his agent that the code only permits the construction of structures that are accessory and incidental to a legally established principal dwelling,as confirmed by the issuance of a Certificate of Occupancy. While the neighbor to the south,who is adjacent to the location where the pool is proposed to be located,wrote a letter in support of the application, another'neighbor testified that the adjacent owner is an absentee landlord and that the house is currently being rented. Testimony was given by neighbors as to ongoing activities on the property and the continuous,state of construction upon the premises for several years.Neighbors also presented photos of the current condition of the property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 4,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property has more than enough room for an accessory swimming pool in the required rear yard. The neighboring property has plantings to screen so as not so see into the yard. By placing the pool iri the side yard, it would set a precedent in the neighborhood where there are no other pools in the side yards. 2. Town Law 4267-b(3)(b)(2).- The benefit sought by,the applicant can be achieved by some method,feasible for the-applicant to pursue, other than an area variance.,. During testimony it was noted that there was plenty of room, and sunshine in the required rear yard with an ability to'screen the rear yard-to create some privacy.' 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100% relief from the code. However, there are alternate locations where the pool can be placed in a conforming location. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an.adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of a accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Site plan indicates the proposed pool and deck extend 5 feet beyond the indicated building envelope.Since pools and decks are considered structures,is this allowable? d. The adjacent property to the north-west is a designated Park"and may currently be affected by runoff from the site and the large piles of mulch thereon. b. Nothing on this property is consistent with the character of the neighborhood. The site has been an eyesore for 8 years with construction materials and debris strewn about,all visible from the street. 3. Application a. All the questions on the application form "Reasons for Appeal"are inadequately or inaccurately answered by the applicant. 1.
