(E~D.S.T.), Thursday, September ~, 1975 at the Town Office, Main Road, Southold, New York. There were present: Messrs: Robert W. Gill£spie, Jr., Chairman; Robert Bergen; Fred Hulse, Jr.; Charles Grigonis, Jr. Also present: Sherley Katz, Long Island Traveler-Mattituck Watchman. A public hearing on the following Appeal No. 2064, Pond Enterprises, Inc., was held on July 24, 1975. The appeal was denied. At a meeting of ~he Board of Appeals held on August 14, 1975 it was resolved that a rehearing of this.appeal be held on September 4, 1975. 7:30,P.M. (E.D.S.T.) Location of property: ProPerty of Nicholas Aliano, Southold, New York, bounded on the north by Town of Southold & I.C. Latham; on the east by.I.C. Latham & R. Bayley; south by Middle Road (CR 27); west by Thomas Morris & Ors. Southold Town Board of Appeals -2- September 4, 1975 The Chairman opened the hearing by reading the application for a special exception, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: The action of the Board on July 24, 1975 was to deny the applicant's request. Our findings were that applicant has sufficient signs to locate this enterprise. They are as follows: Property of John Krupski, north side of Oregon Road, Cutchogue; property of Gabriel Kousouros, at intersection of Middle Road (CR 27) and Sound Avenue, Mattituck; property of now or formerly P. Matwieczyk on the south side of Middle Road (CR 27) and west side of Depot Lane, Cutchogue; corner of Vista P~a~e and Depot Lane, Cutchogue; north side of County Road (CR 27) (northwest corner) & Depot Lane, Cutchogue; property of Nicholas Aliano, Greenport. The Board found that any further signs would create unnecessary visual pollution of this area. THE CHAIRMAN: Is there anyone present who wishes to speak for the rehearing of this application? MR. NICHOLAS ALIANO: I am here to speak for it. THE CHAIRMAN: In the minutes of July 24th we indicated that you had four or five signs. Is that correct, do you have that many signs? MR. ALIANO: If you want to call the arrow a sign, I do. Everything is alright with the exception of the arrow. There are, in Cutchogue, two signs, one on either side of Route 27. THE CHAIRMAN: Do you propose to move the sign on the southwest corner of Middle Road and Depot Lane? MR. ALIANO: I propose to take that sign out of there. In tkat I have no signs from Depot Lane going east, the North Fork Motel and the Southold Town Police call me every weekend to se~ if I have anything available. I have no signs at all from Depot Lane east, and I think that would alleviate the problem~ THE CHAIRMAN: You want this sign to be located on the property described in this appeal? MR. ALIANO: one on Route 27. need any signs. I need a sign on Route 25 but I also need If I were on the main highway I would not Southold Town Board of Appeals -3- September 4, 1975 THE CHAIRMAN: Restaurants, places of amusement, and places to sleep are necessary to the traveling public. We always try to grant what is necessary for this type of business. MR. ALIANO: I would like to leave the one on the south~ west corner, too, but I will eliminate it in order to have the one I'm requesting in this application. Next year I would like to apply for one west of Depot Lane. THE CHAIRMAN: Our theory is that you need one at the intersection. MR. ALIANO: corner. MR. BERGEN: Mi{. ALIANO: you have signs? MR. BERGEN: MR. ALIANO: I have a permit for the one at the southwest Do you send out brochures at all? Yes, but I have many people say "Why don't We can't find you." The average traffic goes too fast. The one I have in Mattituck is ideal. THE CHAIRMAN: Are there any other questions? (There was no response.) On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Southold Town Board of Appeals RESCIND Appeal No. 1275, dated August 21, 1969, granting one off- premises directional sign on the property now or formerly of P. Matwieczyk, south side of Middle Road (CR 27), and west side of Depot Lane, Cutchogue, New York. Vote of the Board: Ayes:- Messrs: Gillispie, Berqen, Grigonis, Hulse. Southold T own Board of Appeals -4- September 4, 1975 THE CHAIRMAN: Is there anyone present who wishes to speak against this application, Appeal No. 2064? (There was no response.) After investigation and inspection the Board finds that applicant requests a directional sign for The Beach- comber Motel for the benefit of the traveling public to be located on property of Nicholas Aliano on Route 27, Southold, New York. The findings of the Board are that applicant has no directional signs for the Beachcomber Motel east of Depot Lane, Cutchogue, on Route 27. The Board agrees with the reasoning of the applicant. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mr. Gilliap~ seconded by Mr. Hulse, it was RESOLVED, Pond Enterprises, Inc. d/b/a The Beachcomber Motel, Depot Lane, Cutchogue, be GRANTED permission to erect off-premises directional sign on property of Nicholas Aliano, Southold, New York, bounded on the north by Town of Southold & I.C. Latham; on the east by I. C. Latham & R. Bayley; south by Middle Road (CR27); west by Thomas Morris & Ors, as applied for, subject to the following conditions: (1) The sign shall be no larger than 4' x 6' (2) That the sign shall be no closer than 10 feet to any property line. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Grigonis. PUBLIC HEARING: Appeal No. 2073 - 7:45.P.~. (E.D.S.T.) upon application of Paul K. and Thelma W. Datahd, 186 Willow Terrace Lane, Orient, New York for a variance in accordance with the Zoning Ordinance, Art±cle III, Section 100-30 and Bulk Schedule for permission to alter property line and lot size. Location of property: Willow Terrace Lane, bounded on the north by D. Welch & Cooper; east by P. Weiden; south by P. Frey; west by ~rient Harbor. Fee paid $15.00~ Southold T own Board of Appeals -5- September 4, 1975 The Chairman opened the hearing by reading the applica- tion for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: The application is accompanied by a Van Tuyl survey which indicates that the Frey house structure extends across the line. The proposed line would create a triangular piece of property which would accommodate the dwelling which now overhangs the line. The line will have 92' along a 16' right of way and the Frey property will have an additional 9.58' on the 16 foot right of way. The Board looked this property over. We found that a building is being constructed. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. PAUL K. DALAND: I was told that since it's built on posts no building permit was required. The lumber people told me that; I called Mr. Copin up and asked him. MRS. DALAND: He said it was alright as it's not on concrete. It's one of those aluminum buildings. THE CHAIRMAN: You may also be in violation of D.E.C. MR. DALAND: This is improved land. THE CHAIRMAN: If you wanted to put a deck out you would have to apply to the Department of Environmental Conservation and also the Army Corps of Engineers. You would have to agree to assume the cost of a public hearing if D.E.C. decided that you should have one; it~might cost up to $2,000.00. You can't put up a tool house or an accessory building without getting a building permit. MR. DALAND: Sam told me otherwise. THE CHAIRMAN: Mr. Frey must favor this application. How long has this situation existed there? MR. DALAND: Van Tuyl did not understand how the lots were drawn. I looked at my Deed which said that all measurements from the north line shall be measured at right angles thereto. My 100 feet is measured to that line and at the rear of the property it becomes 200 feet. When Frey split his lot be split 50-50. Van Tuyl did not know. He came down and changed the sticks. Mr. Frey came here four years ago and got a variance to build. He had a survey at the time. Southold Town Board of Appeals -6- September 4, 1975 MRS. DALAND: He had it surveyed wrong. THE CHAIRMAN: There is a further consideration in that Mr. Frey owns land on the other side of the right of~ way, a triangular piece. When we were there yesterday there was a Volkswagon parked there. MR. DALAND: That's their property. His son went to Vermont and left the car parked there. MR. FRED HULSE, Jr.: I remember that Mr. Frey had a survey. MRS. DALAND: When his son built his place they re- surveyed. THE CHAIRMAN: As far as your accessory building is concerned you will have to get a permit. Your front yard is not on the Bay. The Building Inspector can't give you a permit for an accessory building in the front yard. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to alter property line and lot size on property located at Willow Terrace Lane, Orient, New York. The findings of the Board are that this is a unique circumstance in that area. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance' would produce practical difficulties or unnecessary hardship; the hardship created, is unique and would not be shared by all properties alike in the immediate ~icinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Hulse, seconded by Mr. Grigonis, it Was Southold Town Board of Appeals -7- September 4, 1975 RESOLVED, Paul K. and Thetma W. Daland, 186 Willow Terrace Lane, Orient, New York, be GRANTED permission to alter property line and lot size, as applied for, on property located 186 Willow Terrace Lane, Orient, New York. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Grigonis, Hulse. Mr. Richard Walsh, Director of Genesis House, St. John's Lutheran Church, Sound View Avenue, Southold, came before the Board for a review of the activities of Genesis House since Appeal No. 1771 was granted on July 3, 1973. THE CHAIRMAN: When we originally granted this appeal two years ago there were a lot of people here to speak for and against the application. The appeal was for something we had not done before and we felt that we should check up on it in two years. (Mr. Richard Walsh showed the Board a photograph album depicting various activities). THE CHAIRMAN: Are you familiar with the original letter written to the Board of Appeals? MR. WALSH: No. I have a copy of the results of the hearing. THE CHAIRMAN: The letter was a little vague as to What you were supposed to do there. It mentioned bible study meetings, Sunday school teachers' meetings, church council meetings, etc. Are any of these meetings conducted there now? How often are they run? MR. WALSH: It depends on what group of the church con- tacts us. They call in advance to see ill, they can come out for a weekend. Most of the time the programs are run by myself.., other times by a pastor. We.are a fellowship that is quite large. This is year round. I live~there all year round. I am on the staff of St. John's Lutheran Church. We are involved with some~of the activities Of the North Fork Baptist Church. THE CHAIRMAN: As I recall, a statement was made that other groups can use this facility. MR. WALSH: Yes. They take advantage of it. Southold Town Board of Appeals -8- September 4, 1975 THE CHAIRMAN: The letter also states: (2) "The property will be used as a residence by the director Of~the facility and his wife. The director will also have the responsibility for the maintenance of the property and will be the primary supervisor of the activities conducted there. Two rooms on the second floor will be used by the director and his wife as their apartment and of course they will make use of the kitchen and dining facilities on the first floor." MR. WALSH: That is right. THE CHAIRMAN: It is used for meetings and conferences, and some are held over weekends? MR. WALSH: Usually the people arrive on Friday and go home on Sunday afternoo-n. We do all the cooking. I make breakfast but I have a g~eat wife and she does the rest. THE CHAIRMAN: How many people do you sleep there? MR. WALSH: We are only allowed up to 30 individuals so we abide by that. If we run into difficulties when a larger group comes out, the girls stay in the house and the guys sleep in tents. There has only been one group of that size, about 50 people. THE CHAIRMAN: (4) of the letter states"Foster care of children by the director and his wife is a use which will be infrequent and of short duration. After carefully consider- ing the circumstances under which this might occur, it can be stated that such children would be under the age of six (6) and the length of their stay would be only for a weekend." MR. WALSH: I have met with Rev. Symonds of the Presby- terian Church. It seems he has run into a situation of children running away from home. I have offered our facility for them to wait for things to cool off. THE CHAIRMAN: Do you have a situation with courts w~ere families are having troubles? MR. WALSH: There were people involved with adoption agencies and we would come across them in shelters but that fell through. THE CHAIRMAN: How many people would you say have used your facility? Southold Town Board of Appeals -9- September 4, 1975 MR. WALSH: Roughly 700 people. We did not have the house available for all of those two years. There wasn't any heat. It took us six months to make it livable enough for us to live in it. We moved in in May. I traveled back and forth to Massapequa. We had our first retreat in February. THE CHAIRMAN: Have you had any foster children? MR. WALSH: The closest we came was a divorce case where the father drank and she needed a place to stay. They had five children. The pastor called us up and she and the children stayed a week. That's all we have ever done. It boils down, essentially, to retreats. We have Coffee House on Friday evenings. It's all local. We have from 30 to 50 people. On Wednesday nights we have Bible Study with about 20 people. Also, from the letter dated June 22, 1973: "the proposed uses would not constitute a church or a worship community or a mission church." THE CHAIRMAN: Do you have regular Sunday church service? MR. WALSH: No. "There is no intention of using the property as a multiple dwelling.~ The property will be used as stated more or less continually during the summer months. There is on the property space for parking approximately 60 cars which is more than will be needed for the uses proposed." MR. FRED HULSE: Do you have a bus? MR. WALSH: That was a singing group that came through. There is no bus. I have had no trouble with neighbors. MR. HULSE: Do you have a group every weekend? MR. WALSH: We would like to have but if we have two retreats a month we are doing well. THE CHAIRMAN: It sounds to me that you are doing almost exactly as you planned to do; maybe the activity is even a little more intense. MR. WALSH: We have one major problem. We were under the assumption that we could utilize the building if it met building code standards but we came to realize ~hat the third floor could not be utilized because it's wood frame. That third floor has five bedrooms and if we can't use it, it %alIy kn.~ckS ou~ Southold Town Board of Appeals -10- September 4, 1975 totally knocks out part of our retreat program such as marriage counselling. THE CHAIRMAN: - The person to talk to is the Building Inspector. MR. WALSH: He said that we would never be able to use the third floor even if we put in fire escapes. It seems that all third floors can not be utilized. It was erected before 1952, it'%s a multiple dwelling. It seems there should be some loophole so it could be used for weekends. MR. HULSE: Have you looked into making an apartment on the third floor? MR~ WALSH: I asked the Building Inspector whether this is his own personal feeling or whether it is illegal. THE CHAIRMAN: I don't think it's personal. We had this discussion with some of the members from Massapequa. I thought it was clear. MR. WALSH: T hey were under the impression if fire sprinklers were put in or fire escapes, it would be usable. THE CHAIRMAN: If it's New York State law, we have to follow that. MR. HULSE: Have you checked with your attorney? MR. WALSH: No. I have read that letter. THE CHAIRMAN: It was in response to a letter from us. There are a couple of other things in the file. Apparently the Building Department is concerned with your repairing the stairs. MR~ WALSH: That's on order. We had a new roof put on and the roofer dropped a hammer and cracked the cesspool cover so we are ordering a new cover. THE CHAIRMAN: There is another item in the file: "Had camper trailer in yard". MR. WALSH: My wife and I do a lot of camping. THE CHAIRMAN: You have to get a permit from the Town Board for a trailer. Southold Town Board of Appeals -11- September 4, 1975 MR. WALSH: We don't live in the trailer. As far as the stairs are concerned, we are just waiting for wood to come so we can repair them. THE CHAIRMAN: We have checked on the activities of Genesis House, and I suggest that the Board make a review again in a couple of years. Thanks very much for coming in. Sherley Katz of the Long Island Traveler-Mattituck Watchman asked to see the Paul K. and Thelma W~ Daland survey. She was shown the survey and the Chairman indicated the reason for the appeal. On November 29, 1973 Mr. Louis Getoff, Waterview Drive, Southold, New York, on Appeal No. 1854, was granted permission to erect a bus shelter in front yard area of property located on the northeast side of Waterview Drive, Southold, subject to the following conditions: That the shelter be placed at least 5 feet from any property line on the north side of Waterview Drive. It is further understood that this is a temporary permission subject to being rescinded at.any time in the,~uture. On August 18, 1975 a letter was sent to Mr. Getoff informing him that "At a meeting of the Board Of Appeals held on August 14, 1975, your application was reviewed and it was RESOLVED that applicant must comply with conditions of variance before September 1, 1975 or permission for variance will be rescinded at the nex~ Board of Appeals meeting to be held on September 4, 1975." On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that as applicant has not complied with con- ditions of the variance granted on November 29, 1973, Appeal No. 1854, permission for variance be RESCINDED as of September 4, 1975. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Grigonis, Hulse. Southotd Town Board of Appeals -12- September 4, 1975 On motion by Mr. Bergen, seconded by Mr. Grigonis, it was RESOLVED that the minutes of the Southold Town Board of Appeals dated August 14, 1975 be approved as submitted, subject to minor correction. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Grigonis, Hulse. Thirteen (13) Sign Renewals were reviewed and approved as submitted. The Chairman directed the secretary to write a letter to Mr. Fred K. Wingett, Gardiners Bay. Estates Club, Inc. in reply to his note on bottom of sign renewal stating that "these signs have been in existence for 30 years and suggesting that it might be advisable to make the permit for five (5) years instead of one (1). Less paperwork for all concerned." The Chairman replied that "We would like to reduce the paper work but the Board needs an early review of all signs because of the temporary nature of some of them". On motion by Mr. Grigonis, seconded by Mr. Hulse, it was RESOLVED that the Southold Town Board of Appeals set 7:30 P.M. (E.D.S.T.), Thursday, September 25, 1975, at the Town Office, Main Road, Southold, New York, as the next regular meeting of the Board. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Grigonis, Hulse. On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED that the Southold Town Board of Appeals submit the following Annual Estimate of expense and income to the Town of Southold for fiscal year beginning January 1, 1976.
