as executrix of the last will and testament of Magda Ellis, late of Queens County,who died on the
3rd day of January, 2018, and who was also the surviving tenant by the entirety with Kerry Ellis,
who died intestate in Queens County on July 4, 2017, party of the first part, and
Hind Hatoum, residing at 13-20 143rd Street, Whitestone, NY 11357; and
Alicia Sanchez, residing at 4239157th Ct., Miami, Florida 33185; and
Victor Monteagudo, residing at 37 Homer Street, Maysville, Georgia 30558,
as tenants-in-common, party of the second part,
WITNESSETH,that whereas letters testamentary were issued to the party of the first part by the
Surrogate's Court, Queens County, New York, on and by virtue of the power and authority given
in and by said last will and testament,and/or by Article 11 of the Estates, Powers and Trusts Law,
and in consideration of One($1.00)Dollar paid by the party of the second part, does hereby grant
and release unto the party of the second part, the distributees or successors and assigns of the
party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at "Laughing Water", Southold, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point of easterly line of Nokomia Road which said point is located a distance of
355 feet southerly from the intersection of the easterly line of Nokomis Road and the southerly
line of Hiawatha's Path;from said point running thence north 84a 21' east 110 feet;thence north
5° 45' west 18.13 feet; thence north 84° 21' east 110 feet; thence north 5° 45' west 18.13 feet;
thence north 84°21 east 110 feet to the westerly line of Wabasso Street;thence south 50 45' east
62.5 feet along the westerly line of Wabasso Street;thence south 84° 21' west 110 feet; thence
south 5"45' east 70.63 feet;thence south 84* 21' west 110 feet to the easterly line of Nokomis
Road; thence north 5"45' west along the easterly line of Nokomis Road 115 feet to the point or
place of BEGINNING.
TOGETHER with and subject to the right to use of the roadways within "Laughing Water" and to
the beach or strand of Hog Neck Bay jointly with other owners of premises at "Laughing Water".
TOGETHER with a right to the use,in common with others,of the playground,beaches,Muskoday
Bridge and the Marina,together with access thereto,subject however to the rules and charges of
the Laughing Water Property Owners Association.
BEING AND INTENDED TO BE the same premises conveyed to Kerry Ellis and Magda Ellis by deed
dated January 27th, 1977, and recorded on February 1, 1977, in Liber 8184 page 395.
TOGETHER with all right,title and interest, if any,of the party of the first part,in and to any streets
and roads abutting the above-described premises to the center lines thereof;TOGETHER with the
appurtenances and also all the estate therein, which the party of the first part has or has power
to convey or dispose of,whether individually,or by virtue of said will or otherwise;TO HAVE AND
TO HOLD the premises herein granted unto the party of the second part, the distributees or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
