Cremers, Member Martin H. Sidor, Member Mark Terry, Senior Environmental Planner Victor L'Eplattenier, Senior Planner Carol Kalin, Secretary Chairman Orlowski: Good evening. I would like to call this meeting to order. The first order of business is to set Monday, March 10, 2003, at 6:00 p.m. at the Southold Town Hall, Main Road, Southold as the time and place for the next regular Planning Board Meeting. Hearings Held Over From Previous Meetings: Chairman Orlowski: Fishers Island Club, Inc. - This proposed site plan is for a 3,200 sq. ft. equipment storage building with an attached 800 sq. ft. covered equipment wash pad. Mr. Cremers: Mr. Chairman, I'll offer the following: WHEREAS, this proposal is to set off a 1.83-acre unimproved lot from a 44.219-acre parcel, north of Sound Avenue in Mattituck; and Southold Town Planninq Board Page Three February 10, 2003 WHEREAS, the Southold Town Planning Board granted conditional sketch plan approval on the plat, dated April 10, 2001; and WHEREAS, the Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, performed a review of this Unlisted Action, made a determination of non-significance and granted a Negative Declaration on August 18, 2001; and WHEREAS, the applicant has requested that the Planning Board relieve him of the suggested Covenant and Restriction for road maintenance of the right-of-way due to the fact that the right-of-way serves six lots in separate ownership and would create an extraordinary hardship; and WHEREAS, the Planning Board has agreed to relieve the applicant of the Road Maintenance Agreement; and WHEREAS, the required Park and Playground Fee in the amount of $5,000.00 has been submitted; and WHEREAS, the applicant has received approval from the Suffolk County Department of Health, dated October 4, 2002; and WHEREAS, all conditions and requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the final plat, dated as revised August 28, 2002, and authorize the Chairman to endorse the maps. The property is located on the north side of Main Road in Mattituck, one quarter mile west of Factory Avenue. SCTM#1000-122-6-20 & 22 As of yet, we have nothing from the Zoning Board of Appeals. Mr. L'Eplattenier: We don't have it in writing. We also don't have Mike's certification. Chairman Orlowski: Mike didn't certify it today. Mr. L'Eplattenier: We still need a fire letter which we called them about. Mr. Fischetti: Victor, you were in the office so I assumed that that was done. Otherwise, I would have pushed them on it. Mr. L'Eplattenier: I've been pushing. Chairman Orlowski: We've been pushing and we haven't got anything out of them. I know they're pretty busy over there and then Mike couldn't certify it today. Mr. L'Eplattenier: I'm so sorry. Mr. Fischetti: O.K. Chairman Orlowski: I'm sorry. We'll just have to hold it open and see how quick it comes in. Mr. Fischetti: Thank you. Chairman Orlowski: Sorry about that. I'll entertain a motion to hold the hearing open unless anybody wants to say anything. Mr. Fischetti: Is there any way we can - they voted on it; they just haven't given you the paperwork on it? Mr. L'Eplattenier: We believe they voted but we don't have anything at all in writing. Mr. Fischetti: O.K. Chairman Orlowski: We kind of thought it was going to be here, too. Mr. Fischetti: O.K., thank you. Chairman Orlowski: O.K. I'll entertain a motion to hold this hearing open. Chairman Orlowski: Perino, Joseph - This proposed major subdivision is for 7 lots on 20.8211 acres. The property is located on the south side of Main Road, 150' west of Sigsbee Road in Mattituck. SCTM#1000-122-7-9. This is tied up in the moratorium and was not granted a waiver. Nothing can be done right now. Do you want to do Number 4, Marty? Mr. Sidor: O.K. WHEREAS, the above application is a major subdivision without an executed conservation component; and WHEREAS, the applicant has requested a waiver from Local Law Number 3; and WHEREAS, the request was denied by the Town Board; be it therefore RESOLVED that Local Law Number 3 was adopted at the regular meeting of the Southold Town Board on August 13, 2002 entitled "Local Law in relation to a Temporary Moratorium on Processing, Review of, and making decisions on applications for Major Subdivisions, Minor Subdivisions and Special Use Permits containing Dwelling Units in the Town of Southold" and therefore no comment can be accepted or action can be made on this application. Southold Town Planninq Board Pa.qe Six February 10, 2003 Chairman Orlowski: Island Health Project, Inc. - This proposed lot line change is to merge a 10,890 sq. ft. parcel, SCTM#1000-9-2-6.2, with a 12,565 sq. ft. parcel, SCTM#1000-9-2-8, creating a 23,455 sq. ft. parcel. The properties are located at the north corner of Oriental Avenue and Crescent Avenue on Fishers Island. I have no idea what they're up to. Anyone can make a comment. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS Final Determinations: Chairman Orlowski: Estate of Leonor Wolf - This proposal is to set-off a 2 acre improved lot from a 24.40 acre parcel in the A-C Zoning District. The residual acrea~le (22.40 acres) will be perpetually preserved with the Peconic Land Trust. The property is located on Main Bayview Road, opposite Rambler Road in Southold. SCTM#1000-88- 1-11 Mr. Cremers: WHEREAS, the applicant proposes to set off a 2.00 acre improved lot, located within the A-C Zoning District, from a 24.40 acre parcel; and WHEREAS, the residual 22.40 acres will be perpetually preserved; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and WHEREAS, the $outhold Town Planning Board granted conditional final approval on the maps, dated May 17, 2002, and all conditions have been met; be it therefore Southold Town Planninq Board Pa.qe Seven February 10, 2003 RESOLVED, that the Southold Town Planning Board grant final approval on the maps, dated May 17, 2002, and authorize the Chairman to endorse the maps. SCTM#1000-96-3-7.1 Mr. Cremers: Mr. Chairman, I'll offer the following: WHEREAS, the applicant proposes to cluster set off a one (1) acre improved lot with 217.87 ft. frontage along the west side of Cox's Lane from a 12.57 acre unimproved parcel; and WHEREAS, no environmental constraints exist; be it therefore RESOLVED, that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, do an uncoordinated review of this Unlisted Action. The Planning Board establishes itself as lead agency, and as lead agency, makes a determination of non-significance and grants a Negative Declaration. Mr. Caq.qiano: Second. Show the locations of the existing septic system and well on the survey. 2. List the zoning district (A-C) on the survey. 3. Edit the title of the survey to read "Clustered Set-Off". 4. SCTM#1000-79- 5-20.13 Mr. Cremers: Mr. Chairman, Ill offer the following: WHEREAS, the applicant proposes to set off an 8 acre improved parcel (2), located within the R-40 Zoning District, from a 24.04 acre parcel (1), located within the R-40/A- C Zoning District; and WHEREAS, a Stage I Archival Search and Archeological Survey and Natural Resource Survey has been conducted by the applicant for the property; and WHEREAS, the Southold Town Planning Board, acting under the State Environmental Quality Review Act, performed a review of this unlisted action, established itself as lead agency, and as lead agency, made a determination of non-significance and granted a Negative Declaration on November 4, 2002; and WHEREAS, as a condition of any approval for the proposed application, the applicant has volunteered to place a covenant on Parcel 2 (8 acres) stating that "no further subdivision of Parcel 2 into perpetuity is permitted"; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional sketch plan approval on the plat, dated March 5, 2002, subject to the following condition: Southold Town Planninq Board Page Nine February 10, 2003 The filing of the Covenants and Restrictions, dated July 8, 2002, with the Suffolk County Clerk. The final plat must contain a notation that a Declaration of Covenants and Restrictions as required by the Planning Board has been filed. SCTM#1000-97-1-12.6, 12.7 & 12.9 Mr. Cremers: Mr. Chairman, I'll offer the following: BE IT RESOLVED that the Southold Town Planning Board grant a retro-active extension of conditional sketch plan approval from October 16, 2002 to April 16, 2003. The property is located north of King Street, 320+' west of the intersection of King Street and Old Farm Road in Orient. Chairman Orlowski: Got that, Marty?
