TERMINATION OF EASEMENTS
This Termination of Easements has been made as of the 2-3 day of 1 2021 by and
between Alfred C. Frodella, Jr. and Juliet A. Frodella ("Frodella"), having an address 40735 County
Road 48, Southold, NY 11971, and Jennifer D. Babtist ("Babtist"), having an address of 2345 Plum
Island Lane,Orient,NY 11957.Frodella and Babtist are sometimes hereinafter collectively referred to as
the ("Parties").
PREAMBLE
WHEREAS,Frodella is the owner of a certain parcel of land, located at 40735 County Road 48,
Southold,NY 11971, Town of Southold, County of Suffolk, State of New York, designated as District
1000, Section 059.00, Block 07.00, Lot 029.002 on the Suffolk County Tax Map and attached on
Schedule "A"annexed hereto (the "Frodella Lot");
WHEREAS, Babtist is the owner of a certain parcel of land, located adjacent to the Frodella Lot
Property, located at 8402 Soundview Avenue, Southold, NY 11971, Town of Southold, County of
Suffolk, State of New York, designated as District 1000, Section 059.00, Block 07.00, Lot 029.005 on
the Suffolk County Tax Map and attached on Schedule B annexed hereto("Babtist Lot"),-

WHEREAS, a certain Easement'was created in the deed from Robert T. Bayley and Joan A.
Bayley and Rolando Mariani, dated July 11, 1978 and recorded July 20, 1978, recorded in Liber 8465 f
Page 46,over and across a portion of the Babtist Property,which was described as being over the n/e 50
feet and north 50 feet for use by others and possible dedication for public highway ("Easement I");

WHEREAS, another puqm#rd Easement was roo4ed in that same deed recorded in Liber 8465
Page 46 over and across the Frodella Property, 50 feet in width running from the southeasterly corner of
the premises described in said deed 745.49 feet to Middle Road(County Road#27), the easterly line of
said easement having a course of South 41 degrees 43 minutes 10 seconds east. Said easement for the
purpose of ingress and egress to and from Middle Road(County#27)and for installation,maintenance,
repair and replacement of utility lines,pipes and conduits on the survey,above the surface and below the
surface in such manner as to not interfere with surface travel("Easement 2"and together with Easement
1, collectively, the "Easements")
WHEREAS, the Easements are no longer necessary;
WHEREAS, the parties desire to terminate the Easements as provided herein.
NOW THEREFORE,in consideration of the mutual agreements set forth in this Agreement and
for One($1.00) and other and good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the parties do hereby agree as follows:
1. The foregoing Preamble provisions are herein incorporated into and made a part of this
Agreement.
2. Frodella and Babtist hereby terminate Easement l and forever release the Babtist
Property from Easement 1 and consent to the same being terminated of record; and
3. Frodella and Sabtist hereby terminate Easement 2 and forever release the Frodella
Property from Easement 2 and consent to the same be'n ter nat 71
of record.

BEGINNING at a point on the northwesterly side of Middle Road (Country Road # 27) which
point of beginning is 536.14 feet, more or less southerly from the intersection of the
