ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke in favor of or against this application. The application was adjourned to the May 20,2021 Special Meeting, in order to allow the applicant and Town of Southold Zoning Board of Appeals staff time to gather additional information, and again adjourned to the June 3,2021 Public Hearing at which time it was closed. While the application was comprehensive, including a multi-page permit pack (including site plan, canopy visuals and main ID/signage) and included substantial information on the site and the proposed upgrading of the signage including updated logo/branding and conversion of the internal lighting to LED, the applicant's agent did not illustrate the history and initial authorization of the sign placement, including internal lighting. The applicant was not able to illustrate that a Certificate of Occupancy exists for any of the improvements they are seeking relief to alter. The public hearing was adjourned to allow the applicant time to research the file further. Town Zoning Board of Appeals staff was also asked to research the file. The applicant provided the following information as part of their request for relief: • Articles of Organization of Leon Petroleum, LLC • Zoning Board of Appeals decision 43696SE dated December 26, 1986 granting permission to establish self-service gasoline sales on the two(2)existing pump islands(platforms)on the westerly portion of the subject premises, not including the single island on the east dispensing kerosene and diesel fuel. • Certificate of Occupancy#Z-19137 dated June 12, 1990 covering a retail service station. • Certificate of Occupancy#35362 dated December 27, 2011 covering the replacement of four(4) gas tanks as applied for. On June 1,2021,the ZBA Staff received an email from the applicant's representative informing the Board that her client didn't have any further testimony and weren't able to find any additional documents that would adequately respond to the Board's inquiries. Prior to the May 20, 2021 Special Hearing,Town Zoning Board of Appeals staff located the following information, which was shared with the applicant: Southold Town Planning Board Resolutions granting approval for site plan on April 1, 1985,and then an amended site plan on August 25, 1986. Neither approved site plan depicted any descriptions of signage other than the location of the freestanding sign. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 6,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-bQ(b)(1). Town Law§2674(3)(b)(3), The variances requested herein are mathematically substantial, representing 100% relief from the code relative to'four internally light signs, 312.5%relief from the code relative to the size of the free- standing sign and 60%relief from the code relative to the height of the free-standing sign. 4. Town Law 1x267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and meet Town of Southold Planning Board site plan requirements. 5. Town Law §2674(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law&267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of updated signage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. For an understanding of my subsequent legal position on behalf of my client, the folloAving is the history of this application preceding the appeal to your Board. In ,January of 2021 I made a request to the Planning Dept. to schedule a pre application meeting to discuss the very bulls schedule issues that the Planning board has now requested an interpretation from you. The meeting was scheduled for February 25, 2021. The meeting; did not occur due to the non availability of Michael Verity, Chief Building Inspector. Subsequent to cancelling the meeting, I called Mr. Verity for guidance and was requested to submit a building permit application ( March 29, 2021) for 420 Paul's Lane LLC and provide the Dept. with a comprehensive evaluation of the Bull: Schedule as it would be applicable to a split zone property. ( see my March 3, 2021 Letter of Intent to Develop Parcel attached to Michael Verity). Subsequent to my submittal to the building dept., there were several conversations with the Department's Plan examiner. The result of their evaluation was the issuance of a "Notice of Disapproval" dated ,lune'], 2021 and amended August 10, 2021 (see attached). The Notice of Disapproval set forth two (2) very specific grounds upon which the disapproval was made ( in addition to the requirement that the planned uses required approval by the Southold Planning Board ). The two grounds which firm the specific basis of my appeal to the Board for relief are: 1. " The proposed construction on this conforming 115,761 sg. ft. lot in the B/LB District, is not Permitted pursuant to the Bulk Schedule,which requires a front yard setback of 100 feet. The proposed convenience store has a front yard setback of 75 feet and the proposed workshop/storage building has a front yard setback of 75 feet 2. In addition, the proposed workshop / storage building is not igermitted pursuant to 280-43 ( c ), which states: " A proiect shall be divided intor M arate structures so that no single structure shall have more than 60 linear feet offrontage on one street" Lastly„ pursuant to Article XX1I1, Section 280-127, the proposed uses require site plan approval from the Southold Planning Board" ( Emphasis in Orit'inal" Of particular significance regarding the pending application before the ZBA is the fact that the Building Department applied its own original interpretation and determination of the application of the Bulk Schedule to the subject property and determined that there were only,two (2) specific parts of the proposal that was not permitted under the Bulk Schedule , which requires specific variances for relief from the Zoning Board. All of this was done with full knowledge of the Building Department that the subject property is a split zone, single lot. However, the Notice of Disapproval only designated the aforementioned two grounds'-in its Disapproval. _ 'Nevertheless, the Southold Planning Board has requested a second interpretation of the split zone single lot property issue as a " general" interpretation that is intended to include my application The power of the Board are specifically set in the statutes. All zoning boards are directly given appellate jurisdictioia by State law. Under New York City Lai%, Town and Village Law state~ " The Board is limited to hearing and deciding appeals from and reviewing any order, requirement, decision, interpretation or determination made by the administrative official charged with enforcement of any ( zoning ordinance or local law)" the Board may reverse or affirm, wholly or partly, or may modify the order, requirement, decision, interpretation or determination appealed from... ( see Division of Local Government Services , Zoning Board of Appeals, reprint date 2015, Powers and duties of the board, pages 3-5. in apph ing the code to the application at hand, The Building Dept, as administrator, upon reviewing the building application, has rendered their original interpretation as the Bulk Schedule applies to 420 Paul's Lane 1-LC and determined parts of the project permitted under the Bulk Schedule and not subject to an appeal for a variance, which the Planning Board now wishes the Building Department to revisit through a Zoning; Board "general" interpretation. The Board is limited to making their interpretation to those parts of the Bulk Schedule presented for variances. The language of the code is clear that the powers of the Board to interpret, affirm, modify or reverse is limited to what is presented for variances. LBA cannot make an interpretation without the administrative official first making their original interpretation and determination. Barron v Getnick, 107 A,D. 2"d 1017, 486 N.Y.S. 2111528 ( 41" Dept. 1985). In summary, the Zoning Board has received an application from 420 Paul's lane LLC which requests specific variances based upon the interpretation and determination of the application of the Bulk Schedule as it applies to a split zone, single lot property. The Board's power does not extend to reinterpreting any portion of the Builk Schedule relative to this project not before it. It can only rule upon the two (2) specific areas noticed by the Building department and nothing beyond that. BBJ Associates, LLC v. The Planning Board's request for a "general interpretation from the Zoning Board cannot be applicable to my client's application now before the Board. There is no express or implied power given to the Board that would modify, affirm, or reverse an original interpretation of the Building Dept. that was not presented to the Board in the Notice of Disapproval. The development plan proposes to construct a ;:1500 SF Convenience ( Retail Store) within the B zone, which Is permitted under 280-48 A (2), v'ihich will requires plan approval, and an additional 8400 SF Workshop/Storage Building within the LB zone, which is a permitted use under 280-41 (A) (2), will also require plan approval. In applying the remainder of the Bulk Schedule to the proposed commercial buildings, we feel we would be required to conform to the schedule or request the following: General Business (B) Zone: 3500 SF Convenience (Retail ) store I. A variance for lot width: actual 103.98 feat 2. Lot depth of 495.78 exceeds the required) :150 400t minimum.150 feet, would be required 3. A variance for one sicle yard setback; actuEll setbacks of 20-ft. and 25 ft. are not in conformance with the schedule (50 ft. total) 4. The filling station is located at 32480 County Road 48, Southold, NY. In preparation of this analysis,we were provided with a document entitled"Site Plan"prepared by Deerkoski +Arm Design&Engineering,revision#3,last dated 7/16/21. Please refer to the below image depicting the subject property and adjacent filling station: ti 4 �r. � r Traffic/Access Concerns: The site is designed to have separate ingress and egress only driveways,with the entrance located along the westerly side of the property and the exit to the east. Based on-the plan,the exit will serve as a right turn only exit,which is obviated by the fact that CR 48 is a divided roadway with a grass center median fronting the subject property. The following concerns are raised with this design: a. The exit curb cut is proposed approximately 30' from the existing curb cut serving as the entrance driveway to the filling station. This has the potential to create substantial conflicts between vehicles exiting the subject property and those seeking to enter the gas station. Specifically, drivers waiting for a break in traffic to exit the subject property onto CR 48 may be confused by oncoming vehicles which are slowing down with their turn signal on and merging to the right into the shoulder. The limited frontage of the subject property dictates that the proposed entry and exit driveways be located so close to each other that drivers waiting at the exit driveway will have difficulty discerning whether or not oncoming/ eastbound vehicles are planning to turn into the subject property or the filling station driveway. As a result,these exiting drivers may be confused and enter into the path of vehicles intending to access the filling station, thus causing potential for collisions, not only with these two vehicles but possible chain-reaction accidents with other eastbound vehicles. b. As seen in the image above,the proposed exit driveway is located in close proximity to the break in the CR 48 median serviced by a 250 foot+/-long left hand turn lane which allows eastbound vehicles to turn left onto Henry's Lane or make a u-turn to head westbound on CR 48. Although the proposed driveway is shown on the plan to be utilized only for right turn/ eastbound CR 48 movements, there would be the ability for drivers wishing to make such a u-turn or access Henry's Lane to cut across two travel lanes and merge into the turning lane almost directly at the location of the median break. If there are any vehicles already queued in and/ or moving into this turning lane when such a maneuver is attempted, the potential for the exiting vehicle to need to stop and block the eastbound travel lanes waiting for the turning lane to clear poses a significant danger. c. It is noted that the subject property maintains access to Paul's Lane which is located just east of the filling station property. A potential remedy for ameliorating the potential dangerous conditions outlined above would be to mandate that exits from the subject property be limited to Paul's Lane. d. As CR 48 is under Suffolk County DPW jurisdiction,the Applicant is bound by NY State 239f Law to secure review and approval by this Agency via referral for same issued by Town of Southold. Inquiry should be made as to the status of said review by the Applicant as it is likely similar concerns will result from same. Environmental Health Concerns: The adjacent filling station property's domestic water is provided via a well. This existing domestic wellhead(shown in the image below)is located approximately 7 feet east of the side lot line between the two properties,and thus,less than 20 feet from the proposed paved area serving as this access driveway. The use of deicing chemicals during winter weather conditions will elevate the potential for these substances to leach through the paved and unpaved areas adjacent to the well causing it to become contaminated. If this exit driveway was eliminated it would greatly reduce, if not eliminate, this potential contamination concern. Also of note regarding this well is that Suffolk County Department of Health Services requires significant separation distances from proposed new septic system elements (which the proposed development will require given the absence of sanitary sewers in the area)from existing domestic potable water wells. Specifically,there must be 100 foot separation from any Septic Tank,Grease Trap,or Manhole, and 150 feet from a sanitary leaching pool. We are contacting you because we are strongly against the proposed new convenience store. We have owned our home for over Thirty-five years and in that time we have seen a great deal of changes include the gas station which was grandfathered in. We also have seen changes that have not been for the better. In those years we have witnessed many accidents (foil request included), cars heading West bound in the East bound lane, so they didn't have to make a U turn further down. Crossing over the grass median, not paying attention to the right turn only out of Pauls Lane. More that one occasion I have had to help with an accident or direct traffic including the time there was a pedestrian fatality. With another new proposed convenience store in close proximity to an existing convenience store I can only see more of people not paying attention to signage, traffic rules and more accidents.Also adding another entrance and exit from another business to already existing Henry's Lane, BP Gas Station and Pauls Lane is just asking for more Trouble. With the new business I can with confidence predict more vehicles going in the wrong direction so they don't have to make a U turn down in either direction, Crossing the Grass median and so on, so they are not inconvenience with making a U turn. Wouldn't it be safer for everyone to have the traffic enter and exit from Pauls Lane, unless they eventually will be separating that property at a later date?We could not attend a zoom meeting but would love to meet face to face with the board to discuss this further. In conclusion, Please do not change the Zoning on that particular piece of property to prevent future traffic and pedestrian incidents.
