Prydatko, et al, residing at 230 Wiggins Lane, Greenport,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. The proposed construction on this 28,500 square foot parcel is not permitted pursuant to Article XXIII, Section 280-124,which states that,on lots measuring between 20,000 and 39,999 square feet in total size, the minimum front yard setback is 40 feet. The proposed construction notes a front yard setback of 35 feet. Furthermore,the proposed accessory in-ground swimming pool is not permitted pursuant to Article III,Section 280- 15 which states that accessory structures must be located in the rear yard. The proposed Swimming pool is being located in the side yard as shown on the survey prepared by Kenneth M.Woychuk,LS,and last revised January 21, 2021,and architectural drawings by Robert James Higgins,Architect proposes a two-story dwelling at 3,133.4 square feet with 842.8 square foot three car garage dated February 20,2021. ADDITIONAL INFORMATION: The applicants have received New York State Department of Environmental Conservation(NYSDEC)and Southold Town Board of Trustees approval for the existing bulkhead and wetlands on the parcel; and the current project is pending approval from both those agencies. The applicant's representative advised that the proposed side yard location for the swimming pool,which will be surrounded by permeable pavers on grade,is to insure NYSDEC approval. The applicant also indicated that an Innovative Advanced Wastewater Septic System is proposed. At the Public Hearing both neighbors to the north and south of the subject property testified. The neighbor to the north was concerned about the three-car garage and possible disturbance from car lights and noise from incoming and outgoing vehicles and was hoping the applicant would screen that north side of the property to give the neighbors privacy and less noise. The neighbor to the south had a concern as he has an existing fence and would not like to see a fence next to his fence and he, too hoped the applicant would visually screen that side of the property. FINDINGS-OF FACT/REASONS FOR BOARD ACTION:- The Zoning Board of Appeals held a public hearing on this application on May 6,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267=b(Vb)(1). Grant of the variance for the pool location will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties, with the conditions imposed herein. The applicant was asked to bring the front yard setback into conformity with the code since this is new construction which can be slightly re-designed to do so 2. Town Law U67-b(3)(b)(2), The benefit sought by the applicant for the front yard setback can be achieved by some method,feasible for the applicant to pursue,other than an area variance. The front yard setback can conform if the applicant makes changes to the plans. The proposed pool is best Iocated in the proposed non-conforming side yard,where a variance is required,because a sanitary system will be installed in the front yard,and the rear yard is adjacent to wetlands and a creek where a pool would cause adverse environmental impacts. 3. Town Latin~1267-b(31(b)(3): The variances requested s herein are mathematically substantial,representing 100% relief from the code for the in-ground swimming pool in the side yard and a 12.5%relief from the front yard setback. However, locating a pool in the side yard will have the least impact to the environment and can most easily be screened from views to adjacent properties and to the street. 4. Town-Law$261-b(3)(b)(4). To evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
