That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Section 505.10 of the Department's Coastal Erosion Management regulations(6 NYCRR Part 505) lists the basis for an appeal of an erosion hazard area designation. As stated in Subdivision 505.10(e): The sole acceptable basis for an erosion hazard area designation appeal is technical information indicating that: 1, the long-term average annual rate ofshoreline recession was incorrectly established;or 2. the subject area was erroneously identified as a natural protective feature area. Your letter indicates that you are appealing the designation of the Coastal Erosion Hazard Area based on 505.10 (e)(2),claiming the subject area was erroneously identified as a Natural Protective Feature Area (NPFA).The current CEHA map for the area is CEHA Map Sheet 11 of 49 for the Town of Southold,which was certified by the Department on August 29, 1988 and shows,the location of the NPFA at the subject property. The landward limit of the NPFA line on the Map indicates the landward extent of the CEHA jurisdiction. The location of this line would have been established through interpretation of aerial imagery available at that time. It appears that the most landward Natural Protective Feature,which determines the location of the NPFA line on the property,was identified as a bluff during the development of the Map. A"Natural Protective Feature Area" is defined in Section 505.2 (z)of the Department's Coastal Erosion Management Regulations as: A land and/or water area containing natural protective features, the alteration of which might reduce or destroy the protection afforded other lands against erosion or high water, or lower the reserves of sand or other natural materials available to replenish storm losses through natural processes.All natural protective feature areas are delineated as such on coastal erosion hazard area maps. Pursuant to 6 NYCRR Section 505.2(y),a"Natural protective feature"is defined as: NEW YORK I Department of STATE OPPORTT UNITY Environmental Conservation a nearshore area, beach, bluff,primary dune, secondary dune, or wetland, and the vegetation thereon.. In Section 505.2(d),a bluff is defined as: Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of water. The seaward limit of a bluff is the landward limit of its seaward natural protective feature. Where no beach is present the seaward limit of a bluff is mean low water. The landward limit is 25 feet landward of the bluff's receding edge, or in those cases where there is no discernable line of active erosion to identify the receding edge, 25 feet landward of the point of inflection on the top of the bluff. The point of inflection is that point along the top of the bluff where the trend of the land slop changes to begin its descent to the shoreline. In considering this CEHA designation appeal,Department staff reviewed the information provided with the CEHA designation appeal, including the Gomb Beach Survey dated 9/21/2020,along with historical imagery from 1983 that was available at the time the applicable CEHA map was developed. The NPFA is mapped to include all-natural protective features at a given site.At the subject property, the natural protective features include a beach,bluff,and nearshore area. In order to include all of these natural protective features within the NPFA during map development,the most landward feature would have been used to delineate the location of the NPFA. In reviewing the historic imagery,the Department determined that the most landward natural protective feature at the property during map development was properly identified as a bluff,and that the NPFA was properly mapped. After reviewing all the submitted and available information regarding the subject area,the Department has determined that the subject area was not erroneously identified as a natural protective feature area established in 1988.Therefore,your CEHA Designation Appeal is hereby denied. SCTM# 1000-52-1-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and therefore INCONSISTENT with the LWRP. 1. The natural feature(bluff) line may be incorrect. The top of slope appears to be at the 20' contour line. 2. The pool setback of 27.6' to the"top of bluff' is insufficient and inconsistent with Policies 4 and 6. It is recommended that the Board relocate the pool to meet required setbacks. 3. The 2-story frame house and garage are close to the top of bluff(less than 43') and coastal erosion hazard line. Structures located within these areas are subject to damage and loss over time from the erosive forces of the Long Island Sound and storms, including hurricanes. The location of the structure is not consistent with Policy 4. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
