Box 1179 Eric Sepenoski ® Southold,New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples ® ,® Fax(63-1) 765-6641 C®UNTV,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD February 16, 2023 Robert & MaryBeth Polke 1325 Lupton Point Road Mattituck, NY 11952 RE: 1325 LUPTON POINT ROAD, MATTITUCK SCTM# 1000-115-11-9 Dear Mr. and Mrs. Polke: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, February-15, 2023: WHEREAS, ROBERT & MARYBETH POLKE applied to the Southold Town Trustees for an Amendment to Wetland Permit#10035 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 22, 2022, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit #10035 for the as-built addition of approximately 100 cubic yards of topsoil along the seaward side and west side of the property in order to re-surface the damaged lawn after construction; top soil graded out and area reseeded for lawn to match the grade of the existing lawn; and as depicted on the site plan prepared by Jeffrey Patanjo, last dated November 3, 2022, and stamped approved on February 15, 2023. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) Fees: None This is not a determination from any other agency. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-builts are INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built action was constructed without a Board of Trustee review or permit. It is recommended that the Board establish a vegetated buffer with existing vegetation to protect the wetland. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
