What is next an additional Administrative Amendment recommendation by the Town of Southold Board of Trustees for the homeowner's 50ft wide"As Built"driveway?It's the homeowner's responsibility to seek town permits prior to any"As Built". It completely blocks the windows,light and air to the entire southern facing main floor of my home(4 rooms) and backyard. There is no southern cross ventilation now inside my home and on my property because the 6ft "As Built"fence blocks the southerly air/breeze/winds off of the Peconic Bay and waterway. The prevailing winds in the summer months are from the South. The 4-6ft "As Built"Stockade fence blocks the southern corridor of my property and is detrimental to the environment,my property line pre-existing living tree fence(Leyland Cypress') and property value. • Water run off impairment due to the 4-6ft "As Built"Stockade fence in terms of Deep Hole Creek should be a consideration.The 680 Deep Hole Drive Lot area is 9972 sq ft. I have just reviewed the letter on record from Trustee Goldsmith, dated August 30, 2021 responding to the residence of 680 Deep Hole Drive letter, made publicly available via the Town of Southold Laser Fiche Repository on December 22, 2021, giving approval that the property owner may remove 3 trees from the property. Also based upon the approval no permit was required for the removal of 3 trees.At the Town Board of Trustee meeting on December 8, 2021 according to the official meeting record the residents of 680 Deep Hole Drive, must replant 6 trees. In the Board of Trustees tree removal approval, no permit is necessary letter dated August 30, 2021, it is stated that: "Any other activity within 100' of the wetland boundary requires a permit from this office".All of the non-preexisting 4-6ft wooden stockade fencing, surrounding the property on the East, North and South boundaries was installed after August 30, 2021. For reference, in the letter dated July 20, 2021 on public record from the homeowners of 680 Deep Hole Drive requesting tree removal of 3 trees for safety and septic issues,the property's only pre existing fence which was on the north property line, approximately 4 ft in length and 6ft high that began west of the north side entrance of the home and ended at the western facing wall of the house, is clearly visible on both photos, page 2, submitted by the homeowners to the Board of Trustees. Also the location, of the prior existing fence has been made publicly available on the Homeowners Wetland Permit application dated 11/9/2021 page 8 and page 10, 11/21/2021 page 5 submitted to the Town of Southold-Board of Trustees. That the said Board of Trustees and the Town of Southold'are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,�to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection_4nd approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacea in season. • Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom.
