SCTM# 1000-35-5-35 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated 7/26/202'1 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.The,;LWRP Coordinator issued a recommendation dated September 8,2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards, and therefore is INCONSISTENT with the LWRP. In accordance to Policy #1, Structures in subject location, adjacent to waterbodies, sliould be minimized and riot exceed the bulk schedule requirements. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 17,350 square foot waterfront parcel located in an R-40 zoning district. The parcel runs 102.61 feet of bulkhead frontage along Gull Pond Inlet. The parcel runs 100 feet along Snug Harbor Road. The parcel runs 162 feet on the North side and 185 feet on the South side. The parcel is improved with a two-story frame house and garage with roof over covered porch and a wood platform with floating dock. All is shown on a survey prepared by Nathan Taft Corwin,III,L.L.S. dated September 12,2017. BASIS OF APPLICATION: Request for Variances from Sections 280-124 and the Building Inspector's May 14, 2021 Notice ofDisapproval based on an application for a permit to construct an accessory in-ground swimming pool with a raised patio.At 1)more than the code permitted maximum lot coverage of 20%; located at 600 Snug Harbor Road, (Adj to Gull Pond Inlet)Greenport,NY SCTM No. 1000-35-5-35. RELIEF REQUESTED: The applicant requests a variance to build an in-ground swimming pool with a raised"above grade level" patio that will result in a lot coverage of 24.9% where town code permits a maximum lot coverage of 20%. Page 2, October 27,2021 #7545,Geraci SCTM No. 1000-35-5-35 ADDITIONAL.INFORMATION: At the hearing the applicant's agent presented four prior comparable variances in the neighborhood granting non-conforming lot coverage as follows 1)ZBA variance number 2397 located at 520 Snug Harbor Road for a 22.8%lot coverage granted in 1978. However, the lot in variance 2397 is an oddly shaped lot that is much smaller than the subject lot. 2)ZBA variance number 3457 located at 50 Snug Harbor Road for 25%lot coverage granted in 1986. However,the variance granted is for an at grade patio and in ground swimming pool. Current Southold Town Zoning code does not include at grade patios in lot coverage calculations. The subject application is for a raised patio and swimming pool. Suffolk GIS arial photograph and ZBA records show that the swimming pool and at grade patio located at 50 Snug Harbor Road were never constructed and the existing improvements on that parcel have a code conforming lot coverage. 3) ZBA variance number 3531 located at 715 Dawn Drive for a swimming pool and deck with non-conforming wetland setback. Lot coverage is not an issue in this application. 4) ZBA variance number 4294 located at 330 Snug Harbor Road for 27% lot coverage granted in 1995. However, application 4294 was to build a deck and steps. It did not include structures as substantial or that would require the site work needed to build the raised patio and inground swimming pool. The applicant'sagent further submitted evidence that there are three swimming pools in the neighborhood of Dawn Lagoon. Two of the swimming pools are on parcels with code conforming lot coverage. The third swimming pool located at 520 Snug Harbor Road was not the subject of variance relief and it is not clear if that pool has legal status or was developed at a time before swimming pools were calculated as part of lot coverage. Furthermore,when asked why an elevated patio was proposed, the applicant's representative responded that it was the best option for likely approval by the Board of Trustees because an at grade pool would require a retaining wall and regarding the slope toward Gull Pond. Several letters of support were received, as well as a detailed letter from immediate neighbors who addressed their concerns and opposition to this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 7, 2021 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood was developed after zoning code was in effect and consists of single-family homes with code conforming lot coverage. Not many homes in this private beach community have swimming pools„therefore, swimming poos are not characteristic of this neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling on the subject parcel occupies 19.9% lot coverage. However, the applicant demolished the existing structure and constructed a new house in 2019. The applicant had the opportunity to plan to build a swimming pool and new house with a code conforming lot coverage. Page 3,October 27,2021 #7545,Geraci SCTM No. 1000-35-5-35 3. Town Law §267-b(3)(b)(3). The variance denied herein would be mathematically substantial, representing 24.5%relief from the code. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law'4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect. The applicant designed and constructed a new dwelling in 2019 and had actual knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of design and construction of the existing dwelling. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The granting of the requested variance relief necessary to construct the proposed swimming pool and raised .masonry pool patio, which would increase lot coverage to a nonconforming 24.9 _ percent,will not cause an undesirable change to the character of the neighborhood or detriment to nearby properties. Both the proposed pool and the degree of nonconforming lot coverage are consistent with the character of the surrounding neighborhood, as 1) several properties located adjacent to Dawn Lagoon are improved with swimming pools on the waterside of the dwelling, one which was constructed pursuant to variance relief; 2) one property was granted similar lot coverage relief for a waterside pool that has not been constructed; 3) one property was granted more extensive lot coverage relief for a deck addition; and 4) there is a waterside pool located on the adjacent property to the north, which was developed pursuant to lot coverage relief. Specifically, the property located diagonally across the lagoon, 715 Dawn Drive, is improved with a waterside swimming pool constructed less than 75 feet from the bulkhead, for which variance relief was required in 1986 (case No.,3531). Also in 1986, the property located six parcels to the north, 55 Snug Harbor Road, was granted relief for 25 percent lot coverage to develop the property with a house and swimming pool, though the pool has not been constructed (Case 3457). In 1995, the property located four parcels to the north, 330 Snug Harbor Road, was granted relief for 27 percent lot coverage to construct a deck addition (Case 4294). And the dwelling on the adjacent lot to the north, 520 Snug Harbor Road, was constructed pursuant to a 1978 variance that allowed for 22.8 percent lot coverage (Case 2397). In 1979, an additional building permit was issued for construction of an 18' x 36' swimming pool on the same property, which would have increased lot coverage to at least 27.3 percent, for which it appears no variance was required or granted. Nevertheless, the pool was constructed, received a Certificate of Occupancy in 1981, and remains on the property today in a configuration similar to that requested by the applicants. Similar to all of the above described parcels, the subject property fronts tidal waters and is a preexisting-nonconforming, undersized parcel with a lot area less than half that�required by code. But the 24.9 percent lot coverage requested by the'applicants is less than that which exists on and/or was approved for all of the same properties. Moreover, the pool and patio will be'located immediately behind the dwelling, in a conforming rear yard location and thus not visible from the road; and both structures would be located farther from the sid lot lines than the existing dwelling, well in excess of the required side yard setbacks for acces o structures. As a result, they developed the plan to install the proposed swimming pool and patio to significantly enhance the potential use of their new home for outdoor recreation. And while they were careful to limit the size of the pool and patio and ensure that both meet the required 50' wetlands setback for pools and related structures set forth in Town Code Section 275- 3(D)(1)(a)(5), it is not possible to construct the pool without variance relief because the lot coverage resulting from the new dwelling construction equals 19.9 percent. 3. Representing-less than 25 percent relief from the maximum allowable lot coverage, the relief requested herein is, arguably, mathematically insubstantial. The relief also-is not substantial in fact because in addition to resulting in a substantially similar configuration to the dwelling and pool located on the adjacent northerly parcel, the proposed pool and patio would result in less lot coverage than exists on that parcel and less than that of the three properties in the surrounding neighborhood for which prior lot coverage-variances were granted. 4. The proposed project and incorporated mitigation measures have been designed to avoid causing any adverse impacts on the adjacent waterway and tidal wetland ecosystem, specifically: a. Compliant with Town Code Section 275-3(D)(1)(a)(5), the proposed pool and patio would be situated at least 50 feet from the wetland boundary, which is equal to the seaward face of the bulkhead along the shoreline of Gull Pond Inlet. The project is located outside the wetlands jurisdiction of the New York State Department of Environmental Conservation because the property has been bulkheaded since prior to 1977. b. The swimming pool will be elevated at least two feet above the groundwater table, thus avoiding the need to dewater the pool during construction and impacting the groundwater table. c. The proposed swimming pool would be equipped with a saltwater filtration system, thus avoiding use of a traditional, high-chlorination treatment system. d. Pool backwash will be directed to a proposed drywell. e. The existing covenanted, 10' wide non-turf buffer adjacent to the existing bulkhead would be expanded by 5 feet, resulting in a 15' wide buffer occupying an additional 710 sf of the property area between the Gull Pond Inlet and the propose pool and patio. Box 1179 Southold, NY 11971-0959 RE:Anthony and Angela Geraci#7545—Variance request Ladies and Gentlemen, My wife and I own the adjacent property to 600 Snug Harbor Road for which a variance is being requested.We hereby request a denial or the very least a postponement of the hearing to allow additional time for a further review of the documents. Per a letter mailed to the Zoning Board of Appeals on September 28, 2021 we requested a 30-day hearing postponement along with hard copies of the supporting documents. On October 1,we did receive documents along with instructions on how to download the supporting documents. We believe that we should be afforded the proper time for review and comments and hence a 30-day postponement of the hearing. We still request the 30-day postponement, but with a cursory review of the documents,we oppose granting a variance for the above application. We make the following preliminary comments pertaining to the application. General comments regarding the variance application: 1. Non-conforming—will exceed the 20% lot coverage limit by about 25%which is substantial - amount 2. Problem was self-created—the owner knew the zoning and recently chose to build a house that was the maximum size allowed for the lot. Furthermore,the house size built on that particular lot does not conform to the neighborhood. 3. The addition of a pool may cause issues with run-off to adjacent properties in heavy rain—they are proposing to have a pool wall 5'6" above grade and add an additional 25% of ground coverage which may further affect drainage. With regard to the comments mentioned in the application regarding variances on adjacent properties as establishing precedent are not persuasive: 1. Their applicant's variance request for a pool to be located approximately 50 feet from the water does not really compare to the one cited in 1986#3531(35 years ago) being at about 75 feet. In I addition,from what we can tell the 1986 variance#3531 request did not also require a lot coverage variance. 2. The variance#3457 granted for a pool that was never constructed in 1986(35 years ago)seems to only have required a lot coverage variance limit and not a variance with regard to distance from water.That variance permit has also long expired. 3. The deck variance#4294 cited for lot coverage was only for 10% more than allowed limit and is not pertinent. This is only a deck, not a pool with all the supporting equipment,walkway, fencing, etc. 4. The variance#2397 cited for the property at 520 Snug Harbor Road was built in 1978/1979 (about 42 years ago) and a CO was properly issued for the house and pool in 1981(40 years ago). The regulations are clear,there is no valid reason to make an exception and grant the variance for either or both distance from water and lot coverage. Additional comments with regard to comments made in the application: 1. The existing tree that is supposed to remain (all others were removed during building construction),we question whether it will survive the pool construction due to its location. 2. Covid 19 is not a valid reason for now needing a pool.They state they want to spend more time away from congested public spaces. Covid 19 issues are and will dimmish, but the construction if allowed by granting the variance will remain. We therefore ask that the Zoning Board of Appeals to deny the application or as a minimum or provide a 30-day postponement affording us the proper time to further review and provide additional comments. We reside in the contiguous lot next to the subject property. We were under the impression that a pool was included in the original plans submitted to the town and the Board of Trustees. If the pool was not included, it was certainly contemplated, because the applicant talked about putting in a pool from the very beginning of construction in 2019. So to state that the applicant had "no intention" is erroneous. Additionally, to imply that this application is a "Covid-19 pool' inspired by the pandemic-of 2020 is further disingenuous. To argue that the degree of non-conforming lot coverage "is consistent with the character of the surrounding neighborhood" also does not ring true. There are approximately 14 homes on Dawn Canal, however, non- conforming lot size was cited in just four cases: 715 Dawn Drive 330 Snug Harbor Road 520 Snug Harbor Road 55 Snug Harbor Road (This is NOT a waterside lot—and no pool was ever built) The most recent application for lot coverage relief was for 330 Snug Harbor Road in 1995, 26 years ago. The point being that it is believed that the rules/guidelines may have been applied less stringently in the past. The citation of the aforementioned properties does not lend credence to the argument that this project does not affect the neighborhood. The subject premises, as built, presents as a huge structure. The proposed pool, is also an imposing structure. There is a lot of"volume", existing and proposed, on this one parcel. And yet it is understood that "volume" is not considered, only "footprints".of structures. Accordingly, the present house, as constructed, configured to almost exactly the 20% allowable lot coverage being calculated at 19.87% according to the plans submitted. That left only .13% additional lot coverage, hardly enough for a pool or any additional structure. And now here we are, after two years of construction, with plans submitted fora pool that brings the total lot coverage to 24.9%, which is just short of 5% over the allowable lot coverage. Essentially, 5% overage in allowable lot coverage is actually a 25% increase in the allowable lot coverage. If a pool was left in the original plans, would a variance be required or would the house have been modified to-conform to the 20% rule? Or would concessions have to be made? It appears that the applicant may have built the house he wants, staying just below the 20% allowable lot coverage, but is now requesting the relief to build the pool he wants. Applicant should have taken the pool into consideration from the original plan submission and built a house according to their needs as opposed to seeking an area variance. s , Therefore, the request for this pool presents as a "self-imposed" hardship. Although beautiful, this two story house is completely out of character in a neighborhood consisting of lots that, almost exclusively, vary between a quarter of an acre to a third of an acre. The house towers over our ranch house currently affording us little privacy. In one of the photos submitted by the applicant, one can actually glimpse our adjacent house (Exhibit A). Please note, this is the bedroom area of our home. The scope and elevations of the proposed pool are only going to exacerbate the lack of privacy. Also enclosed is a photo of the rear of the two properties showing how our home is dwarfed by the adjacent property which is built to the maximum allowable side set back (Exhibit A-1) The applicant's plans are not just for an in-ground pool attempting to conform to the contours of the land. The scope of the plans also include an above ground "stone terrace" of 422 square feet and 262 square foot "gravel garden". It appears that a side of the pool will have a five foot retaining wall above grade (Exhibit B). The plans also include a 209 square foot "gravel pad" in the front of the pool that is pictured being a patio (Exhibit C) V The plans seem to be impacting the existing contours of the land. There is concern for increased run-off, not just into Gull Pond, but onto.our property which is just feet away. Absent a lawn and grass, where is all the rain water going to drain? During unusually high tides, from storms and other conditions, the water from Gull Pond has breached the bulkhead. On more than one occasion, water has risen half-way up our rear yard. To a lesser degree, our basement has also had water in it from the rising water table that the storms bring. This is not particular to our house, because other homes on Gull Pond have suffered similar experiences. And now, considering the altered contours of the land in the proposed plans, is this going to impact flooding in our. yard? This project with increased lot coverage and elevation change could result in less surface area for flood water and rain water to drain, causing it to impact adjacent properties.
