The purpose of the zoning district is: The purpose of the General Business (B) District is to provide for retail and wholesale commercial development and limited office and industrial development outside of the hamlet central business areas, generally along major highways. It is designed to accommodate uses that benefit from large numbers of motorists, that need fairly large parcels of land and that may involve characteristics such as heavy trucking and noise. The LWRP CCR form dated November 21, 2021, indicates that the proposed use is artist studios. This proposal would not cause the loss of open space lands, prime agricultural soils, sensitive environmental features, including aquifer recharge areas. Surrounding land uses include Contractors' yards, residences, and a community center. Fishers Island Waste Management operates a transfer station on the property to the west and zoned R-120. The Town of Southold owns and maintains the property to the north of the subject parcel. The proposed use does not conflict with the surrounding uses or the zoning district. Policy 2.2. Protect and preserve archaeological resources. A. Conduct a cultural resource investigation when an action is proposed on an archaeological site,fossil bed, or in an area identified for potential archaeological sensitivity on the archaeological resources inventory maps prepared by the New York State Department of Education. 1. Conduct a site survey to determine the presence or absence of cultural resources in the project's potential impact area. The site is disturbed and improved with various paved surfaces and buildings from the historic development of the area. The parcel is SPLIA listed and within an Archeo-sensitive identified area. It also assumes 72 inches sea level rise for Suffolk County by 2100. A more plausible rise would be roughly 12 inches by 2070 (low end scenario ClimAID). Regardless of the timeframe, the parcel is expected to be impacted by sea level rise in the future. Portions of the parcel and the northwest corner of the building are also located within the CEHA. Note that the proposed build-out maximizes pervious surfaces including the use of gravel paving for parking areas and grass pavers for the patio. Policy S.
