BOUNDARY LINE AGREEMENT

THIS Agreement, made the day of July, 2021, between Christopher Jackson and
Kara Jackson, residing at 480 N. Bayview Road Ext, Southold, NY 11971, Party of the First
Part and Thomas J. Smith and Trisha M. Tarpey, residing at SO Private Road 21, Southold,
NY 11971, Party of the Second Part;
WHEREAS, the Party of the First Part is the owner in fee simple of certain real property
known as and by 480 N. Bayview Road Ext, Southold, NY 11971 designated ad District:
1000, Section: 078.00, Block: 09.00, Lot: 041.000 on the Tax map for the County of Suffolk,
State of New York and more particularly described on Schedule A attached hereto and
made part hereof(hereinafter "Parcel A"); and
WHEREAS, the Party of the Second Part is the owner in fee simple of certain real property
known as and by50 Private Road 21, Southold, NY 11971, designated ad District: 1000,
Section: 078.00, Block: 09.00, Lot: 039.000 on the Tax map for the County of Suffolk, State
of New York and more particularly described on Schedule B attached hereto and made part
hereof(hereinafter"Parcel B"); and
WHEREAS, Parcel A adjoins Parcel B; and
WHEREAS, a survey of Parcel A has been prepared by Seccafico Land Surveying PC dated
June 22, 2021 (hereinafter the "Survey"), a copy of which is attached as Exhibit 1. Said
survey shows among other things a fence which runs along the southerly record line of
Parcel A and the northerly line of Parcel B, but is situate up to 9.8 feet inside Parcel A;
WHEREAS, the parties desire to fix and definitely establish the boundary line between the
two parcels mentioned above respectively owned by them without resort to litigation; and
NOW, THEREFORE, in consideration of the mutual promises and conveyances herein
contained,and other good and valuable consideration, the receipt of which is hereby
mutually acknowledged, the parties hereto for themselves and their heirs, legal
representative, successors and assigns, covenant and agree as follows:
THAT irrespective of the placement of the fence between Parcel A and Parcel B, the
common boundary line between the parcels shall be deemed the southerly boundary of the
property owned by the Party of the First Part and the northerly boundary of the property
owner by the Party of the Second Part,which is established as being described as follows:
A line commencing at a point, marking the southwesterly corner of Parcel A and the
northwesterly corner of Parcel B,which point is located the following three (3) courses
from the corner formed by the intersection of the southerly side of North Bayview Road
with the easterly side of Cedar Lane:
(1) Easterly along the southerly side of North Bayview Road, 408.24 feet to a point, said
point also being where the westerly line of Parcel A described herein and Map of
Bayside Terrace, filed 3/11/1953, Map No. 2034, intersects the southerly side of
North Bayview Road;
(2) Still along the southerly side of North Bayview Road, South 74 degrees 54 minutes
30 seconds East, 156.21 feet;
(3) South 23 degrees 33 minutes 40 seconds West 217.57 feet to the point or place of
beginning, and from said point of beginning:
THENCE North 66 degrees 26 minutes 20 seconds West, 163.27 feet to a point.
AND the Party of the First part does hereby remise, release and quitclaim unto the Party of
the Second Part, its successors and assigns, all of its right, title and interest in and to any
land lying to the south of the boundary line so established, and the Party of the Second Part
does hereby remise, release and quitclaim unto the Party of the First Part, its successors
and assigns, all of its right, title and interest in and to any land lying to the north of the
boundary line so established, and
THE parties further agree and acknowledge that any use by the Party of the Second Part,
their heirs, legal representative, successors and assigns, of any portion of Parcel A lying
south of the fence is permissive and not hostile to or with any claim of rights against the
Party of the First Part, their heirs, legal representative, successors and assigns.
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with the land
and inure to the benefit of and be binding upon the parties hereto and their respective
heirs, legal representative, successors and assigns.
IN WITNESS WHEREOF,we have hereunto set our hands and seals on the date first above
mentioned.

BEGINNING at a point in the southerly side of North Bayview Road, distant 408.24 feet
easterly as measured along the southerly side of North Bayview Road from the intersection
of the southerly side of North Bayview Road and the easterly side of Cedar Lane, said point
of beginning also being where the division line between the premises described herein and
Map of Bayside Terrace, filed 3/11/1953, Map No. 2034, intersects the southerly side of
