SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk-County Department of Planning issued its reply dated April 23, 2021 stating that this application is considered a matter for focal determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Action's exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure (detached garage). The applicant also requests a variance to establish the accessory apartment on two floors with a total of 825 square feet: n 586 sq.ft. of livable floor area on the first floor, 88 sq. ft, of livable floor area on a second-floor loft open to below and accessed by a full staircase,and 155 sq.ft. of non-habitable attic storage on the second floor accessed through the proposed second floor loft. The code permits a maximum of 750 sq ft. of livable floor area and a minimum of 450 sq.ft. in an accessory apartment in an accessory structure. The Building Inspector confirmed, in his"Verification of Livable Floor Area: memo dated May 11, 2021 and received by the ZBA stamped May 12,20201,that the proposed total livable floor area on two floors is 667 sq. ft. in conformance with the square footage allowed by code. However,the code states that the livable floor area must all be on one floor. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 29,874 square foot parcel located in an R-40 Zoning District. The parcel runs 74.49 feet along Main Road,400.01 feet on the West side, 75 feet on the North side, and 399.50 feet on the East side. The parcel is improved with a two-story frame dwelling with attached enclosed porch and framed accessory garage. All is shown on a survey by Kenneth M. Woychuc,k L.L.S. dated January 25,2015. Page 2,October 7,2021 7508SE Kiely SCTM No. 1000-115-1-7 ADDITIONAL INFORMATION: Site inspection showed that there is an in-ground swimming pool currently under construction which is not before this Board. As part of the application the applicant submitted copies of the following documents relative to the property and their full-time residency status: 1. Affidavit of Occupancy 2. New York State Driver's License of owners 3. --Certificate of Birth showing the tenant a family member 4. Utility Bills SECOND FLOOR LOFT: Town code on accessory apartments states in §280-13(B)(13)(e): "The entirety of the living floor area of the accessory apartment must be on one floor of the accessory structure." At the public hearing,the applicant submitted floor plans and elevations dated 6/3/2021 but unsigned and unstamped by an unidentified architect/designer,along with a perspective rendering of the proposed second floor open loft space and full interior staircase. The open loft area is proposed to be finished and conditioned, and the proposed attic storage will be unconditioned space. The applicant's mother,who will be in residency with the applicant's father,testified that she wanted to incorporate shed dormers on the second story level for natural light and ventilation and that a full staircase to the proposed storage loft was necessary for the comfort, convenience and safety of herself and her husband. It was discussed at the hearing by the Board that storage areas could only be accessed through a pull- down interior staircase since a full staircase leading to a second floor constitutes a non-permitted habitable use on more than one floor.Additionally, since the applicant is proposing a conforming 586 square foot habitable apartment on the first floor,they can add an additional conditioned storage area on the first floor to the footprint of the as built garage to provide the accessible storage space they require. Moreover, shed dormers and a cathedral ceiling in the proposed apartment can be designed without creating non-conformity to provide the light and ventilation that the applicant's mother stated she desires. AMENDED FLOOR PLAN: Pursuant to condition 1 (one) of the July 15,2021 ZBA approval of the Special Exception for the subject Accessory Apartment,the applicant submitted an amended floor plan,last revised dated August 24,2021 prepared by Anthony Henry Andrews,LPE. In the revised floor plan the applicant removed the non-conforming loft space and relabeled it anfished attic storage,and added a room on the first floor labeled "conditioned storage" on the Wesi)side of the building. During the September 16,2021 Special Meeting of the Zoning Board of Appeals, the Board Members reviewed the amended building plans dated August 24,2021 and sent a letter to the applicant dated September 21, 2021 explaining that although the August 24,2021 amended plan, as required in the conditional approval for the proposed accessory apartment, does not exceed the square footage of the code permitted maximum livable floor area for an accessory apartment in an accessory structure, it now depicts a fully conditioned habitable second room addition accessed through the great room that, although labeled as conditioned storage, includes windows and exterior French doors that could possibly be used as a second bedroom,which is not permitted by code. Accordingly, in the letter the Board offered the applicant one of the following options in order to conform to the intent of the Board's July 15, 2021 decision: Page 3, October 7,2021 7508SE Kiely SCTM No. 1000-115-1-7 1. Remove the interior wall between the proposed conditioned storage area and the great room; 2. Seal the interior doorway and access the storage room from the exterior only; 3. Reduce the size of the proposed storage area to a non-habitable size; i.e.; less than 70 square feet. As a result, the applicant submitted revised floor plans still dated August 24,2021 but stamped received by the Zoning Board on September 23, 2021 showing a solid wall between the Great Room and the"conditioned storage space",with the only access to the conditioned storage room from the exterior entrance on the west side of the building. FINDINGS OF FACT: The Zoning Board of Appeals held a public hearing on this application on at which time written and oral evidence were presented.Based upon all testimony,documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant will comply with the requirements, in the amended approval granted herein for the reasons noted-below: 1. The Accessory Apartment unit, as amended,will be located on the first floor of the accessory structure with a conforming area of 586 square-feet of livable floor area,where the code permits a maximum of 750 square feet, as described-and shown ori the'floor plan submitted-to ZBA June 3,2021 and as confirmed by' the Building Inspector in a memorandum titled"Verification of Livable Floor Area" dated May 11, 2021 and received by the Board of Appeals on"May 12,2021. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with all code requirements as defined in Section 280-13(B)(13)of the Zoning Code except for the size of the apartment. The owner confirms that the accessory apartment shall not contain less than 450 sq. feet of livable floor area, and will not exceed the code permitted maximum of 750 square feet of livable floor area, and, as amended,will be located on one floor with only one full bathroom and bedroom. 3. The applicant herein, owns and resides at the property and will continue to occupy the single family residence as a principal residence in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4),and as documented by copies of a driver's license and national grid invoice. 4. The occupants of the accessory apartment will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article III, Section 280- 13(B)(13)0, 1-4). The tenant of the accessory apartment will be Rebecca Northey,the homeowner's mother, as evidenced by copies of birth certificate and letter of agreement dated April 4, 2021. 5. The owners' plans comply with the on-site parking requirements and provide for a total of 3 parking spaces, as shown on the survey prepared by Kenneth M. Woychuck,L.L.S., dated January 25, 2015. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the district in which is located, adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the accessory structure, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety,health,welfare,comfort,convenience,order of the Town would be adversely affected. 4)The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5)No adverse conditions were found after considering items listed under Sections 280-142 and 280-143 of the Zoning Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the'balancing test under New York Town Law 267-B, motion was offered by Member Dantes seconded by Member. Acampora and duly carried,to GRANT amended approval for a Special Exception Permit to establish an Accessory Apartment measuring 586 sq.ft. of livable floor area only on the first floor of the existing accessory garage SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit amended floor plans and elevations to the Board of Appeals stamped 'and dated by a licensed architect or engineer in conformance with the amended approval granted herein,prior to obtaining a building permit. 2. The proposed attic must remain unfinished as open rafters and may only be used for mechanical space or storage and accessed only by a pull-down interior staircase. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson) seconded-by - Member Lehnert and duly carried,to GRANT approval for a Special Exception Permit to establish an Accessory Apartment measuring 586 sq. ft.of livable floor area only on the first floor of the existing accessory garage as shown on the August 24,2021 architectural plans dated received on September 23,2021 and prepared by Anthony Henry Andrews,LPE. The proposed attic storage must remain unfinished as open rafters and stud walls and may only be used for mechanical space or storage and accessed only by a pull-down interior staircase. 2. The space on the-ground floor labeled as "conditioned storage space" on the amended floor plan stamped received on September 23,2021 may be insulated but-must remain unfinished as open rafters and stud walls. The space may only be accessed from the exterior entrance on the west side of the building and may only be used as non-habitable storage. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In-the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the-conditions, occupancy or other requirements described herein, may-require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. _Vote of the Board: Ayes: Members Weisman (Chairperson), Dante, and Planamento, Acampora and Lehnert. Leslie Kanes Weisman: I am writing to request 'a modification of your Amended Determination dated October 7, 2021, on ZBA Application No. 7508SE, relating to the conversion of the garage at 16045 Main Road, Mattituck, into an accessory apartment. Because of changed circumstance, my clients would like permission to turn the addition to the garage that was designated as conditioned storage into living space by finishing the walls and ceiling and adding a doorway from the addition into the adjacent living space. The accessory apartment will remain in compliance with Zoning Code Section 280-13 (B) (13) in that it will not exceed the code permitted maximum of 750 square feet of livable floor area, contained on only one floor, and will have only one bathroom. (There appears to be no code limitation on the number of other rooms) . The owners of the property, Julia Kiely and Rebecca Northey are, respectively, my wife and mother-in-law. At the time of the original permit application, ;they had expected that the apartment would be used only has a dwelling by Ms . Northey and her husband. Although they needed conditioned storage for his musical instruments and equipment, additional living space was not essential . Accordingly, they accepted without challenge the restrictions imposed by the ZBA in its October 7 determination. Since we filed the original application, Julia and I have been fortunate enough to obtain favorable financing and are about to begin substantial renovations to the main dwelling unit on the property. We have investigated renting another home in the area for ourselves, our two children, ages 5 and 7 (who both attend Cutchogue East Elementary School) , and our pets for the duration of the renovations, but have found nothing appropriate and affordable. Finishing the storage addition of the apartment would allow us to live there temporarily during the renovations . Thereafter, my father-in-law, who is a lawyer as well as a professional musician, could use the addition as home office and practice space as well as instrument storage. Finally, at such time as my in-laws no longer need the apartment for living, the additional living space would make the apartment rentable to a small family on the affordable housing list. However,the code states that the livable floor area must all be on one floor. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 29,874 square foot parcel located in an R-40 Zoning District. The parcel runs 74.49 feet along Main Road,400.01 feet on the West side, 75 feet on the North side, and 399.50 feet on the East side. The parcel is improved with a two-story frame dwelling with attached enclosed porch and framed accessory garage. All is shown on a survey by Kenneth M. Woychuc,k L.L.S. dated January 25,2015. Utility Bills SECOND FLOOR LOFT: Town code on accessory apartments states in §280-13(B)(13)(e): "The entirety of the living floor area of the accessory apartment must be on one floor of the accessory structure." At the public hearing,the applicant submitted floor plans and elevations dated 6/3/2021 but unsigned and unstamped by an unidentified architect/designer, along with a perspective rendering of the proposed second floor open loft space and full interior staircase. The open loft area is proposed to be finished and conditioned, and the proposed attic storage will be unconditioned space. The applicant's mother,who will be in residency with the applicant's father,testified that she.wanted to incorporate shed dormers on the second story level for natural light and ventilation and that a full-staircase to the proposed storage loft was necessary for the comfort, convenience and safety of herself and,her husband. It was,-discussed at the hearing by the Board that_storage areas could only be accessed through a,pull- down interior staircase since a full staircase leading-to a second floor constitutes a non-permitted habitable use ori-m-ore than-one floor.Additionally; since-the applicant is proposing a,conforming 586 square foot habitable apartment on the first floor,they can add an additional conditioned storage area on the first floor to the footprint of the as built garage to provide the accessible storage space they require. Moreover, shed dormers and a cathedral ceiling in the proposed apartment can be designed without creating non-conformity to provide the light and ventilation that the applicant's mother stated she desires. FINDINGS OF FACT: The Zoning Board of Appeals held a public hearing on this application on at which time written and oral evidence were presented.Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III; Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant will comply with the requirements, in the amended approval granted herein for the reasons noted below: 1. The Accessory Apartment unit, as amended, will be located on the first floor of the accessory structure with a conforming area of 586 square feet of livable floor area,where the code permits a maximum of 750 square feet, as described and shown on the floor plan submitted to ZBA June 3, 2021 and as confirmed by the Building Inspector in a memorandum titled "Verification of Livable Floor Area" dated May 11, 2021 and received by the Board of Appeals on May 12, 2021. 2. The occupants of the accessory apartment will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article IIl, Section 280- 13(B)(13)0, 1-4). The tenant of the accessory apartment will be Rebecca Northey,the homeowner's mother, as evidenced by copies of birth certificate and letter of agreement dated April 4, 2021. 5.
