RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#9719 & Coastal Erosion Permit#9719C to construct 43±If of the 68±If of the wood access walkway "in lieu of the 15±If that is not being built, construct a new 44±sf deck area on the north side of the wood access walkway; and install two sets of steps to the beach sediments from the pier: on the North: 3.5±ft wide by 8.5±ft ; and on the South: 3±ft wide by 5±ft.; and as depicted on the site plan prepared by Docko, Inc., received on September 8, 2021, and stamped approved on October 20, 2021. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. The Dotson's instead wish to install two sets of steps to the beach sediments from the pier at the location shown on the attached modified permit drawings dated December 12, 2018, and revised on December 24, 2019, and now August 19,2021. They would also like to build a small 4 foot wide by 11-foot-long ramp off the north easterly corner of the shore walkway which will join to a woodland path which proceeds from this point, to the northeast along the back side of the bank. SCTM# 1000-7-1-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed dock is within the Coastal Erosion Hazard Area (CEHA). All development is prohibited in the nearshore area pursuant to 111-11. unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities in these areas maV include open timber piles or other similar open work supports with a to surface area of less than 200 s ware feet which are removed in the fall of each year. Therefore, the proposed action is prohibited in the nearshore area pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS. § 111-6. Definitions. UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter include but are not limited to elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purposes of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar open work supports with a top surface area of less than 200 square feet or which are removed in the fall of each years: normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program;planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes; routine agricultural operations, including cultivation or harvesting; and the implementation of practices recommended in a soil and water conservation plan as defined in § 3, Subsection (12), of the Soil and Water Conservation Districts Law; provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure. The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. There was no tidal wetlands vegetation on the beach beneath the pier, there is very little tidal wetlands on this rocky beach, in any case, because of the open exposure to waves and abrupt toe of the bank which is overgrown with vines and brush. The pier has been configured ed high, 8 feet above the bottom sediment with "Thruflow" decking over submerged aquatic vegetation which has grown around the end of the pier in the shallow subtidal waters. As such, it provides adequate height to clear environmental resources of concern and the materials to be utilized are consistent with Town of Southold's Local Law #6 regarding_environmental quality and not using pressure- treated Southern Yellow Pine timber decking components in particular. Pier reconstruction and maintenance work will have no adverse impacts on air quality as a result of this structure and the work on the pier should not diminish overall environmental quality or resource habitat in Fishers Island Sound. The area of pile contact on the bottom sediments for 75 piles is less than 30 SF. Permission to inspect Property Application Supplement 12/08 DOTSON PROPERTY DOCK RECONSTRUCTION WEST HARBOR/FISHERS ISLAND SOUND FISHERS ISLAND,NEW YORK NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION March 2020 GENERAL Mr. William Dotson owns parcel 1000-7.4-3 off Barlow Pond Lane located along the west shore of Clay Point/Fishers Island Sound on Fishers Island. The site is generally mildly sloped, sandy gravel soils, vegetated with grass, brush, landscaping ground cover and trees. The frontage of the property is approximately 400 feet along West Harbor at the east shore, abutted by the FBO Associates, LLC property to the north and the Thor's to the south. The waterfront consists of a partially rock-covered beach with sparse, sporadic, individual tidal wetlands plants at the base of the moderately sloped but low bank in the vicinity of the longstanding wood pile and timber pier. It is the Dotsons desire to reconstruct the existing longstanding fixed pier dock system using driven wood piles. The pier will have an end elevation of 6 feet above Mean Low Water (MLW), except for the lower north end boarding platform, with the main pier to shore sloping upward to an elevation of 8 feet above Mean Low Water and crossing over the boulder-strewn intertidal zone above the bottom sediments then declining to shore terminating on the bank with a level section of about 60 foot length along and existing path. This increase in pier elevation will allow passage of the public on the rocky beach below; a rare event there will be a low-profile wood walkway across the established and well-worn path through the brush to the road, above tidal wetland jurisdiction. Attached are application drawings prepared for this project showing this configuration and pertinent details. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, as well as the Local Waterfront Redevelopment Plan related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State Section 661 of the NYS DEC Regulation pertaining to work in or adjacent to Tidal Wetlands is also addressed in this narrative. DESCRIPTION OF WORK As mentioned in the introductory paragraph, this project is to reconstruct the existing fixed wood pile and timber pier and shore landing as depicted in the attached application drawings and described in the application documents. All work will be done in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. This is a continuance of a longstanding existing structure which is an accessory to the residential use of the property and the use of the structure for recreational boating access is lawful and in compliance with the Coastal Zone Management Act of the State. It is envisioned that this pier reconstruction will be conducted utilizing the following general construction methodology, sequence and material standards addressing Section 275-11 of Southold Law 6. • The marine contractor will arrive by barge with a deck-mounted crane and push boat and at least one work boat. The existing pier facilities will be disassembled, piles extracted and then 1 rebuilt as a new structure with the debris removed from the site and disposed of in accordance with applicable laws, codes, and ordinances. • New piles will be driven at approximately 10-foot intervals as necessary and it appears that all should be replaced. These piles will be driven by double-acting air hammer to a bearing resistance of approximately 30 tons. This generally results in about 12 to 15 feet of embedment of the pile in the bearing stratum. Pier support piles must be Class B, pressure treated Southern Yellow Pine or Geenheart, 12-inch nominal diameter measured 3 feet from the butt. These piles will be flush with the deck or extend above the deck to support a new rail. The stand-alone tie-off piles will also be 12-inch Class B pressure treated Southern Yellow Pine or Greenheart. • After the replacement piles are installed, new split caps consisting of pressure treated Southern Pine timbers ranging from 3 x 10 to 4 x 12 nominal dimension, will be bolted to the piles transversely. New stringers will be then laid on the split caps parallel to the length of the pier. In all likelihood, stringers will be 3 x 10 pressure-treated Southern Pine. Framing elevations will be set to support the decking at an elevation of 8 feet above MLW. • The outer stringer on each side will be bolted or spiked, at any rate attached to the pile to secure the deck against uplift forces that this pier might be exposed to. • After the stringers have been connected to the piles and split caps, the decking will be replaced. In accordance with Town of Southold's Ordinance No. 6, 2004, new decking will not be pressure-treated Southern Yellow Pine, but rather oak, fir, cedar, etc. Decking over the eelgrass will be "Thruflow" or similar plastic or fiberglass grate type of composite material with the brushed side mounted up. The synthetic decking can be either gray, brown or natural in color. Decking, will in any case, be attached to the stringers utilizing stainless steel flathead square-drive wood screws about 3 inches long and will be set with a 1/8" to 1/a" gap between members. In all likelihood, the decking will be wood landward of the eel grass. • The alignment of the pier will match the existing structure throughout its length running over the non-vegetated bottom sediments that currently exist in the intertidal zone. • The new piles or new rail posts will extend to 42 inches above the deck surface and have horizontal rail members mounted to them to support vertical balusters at the owner's option, with 3 3/4" inch clear between balusters. A horizontal handrail will be installed on the top of the rail system. Cable rails may be an option. • Electrical service will run out on the pier in the space between the stringers so that trickle chargers on the boat(s) may be powered during tie-ups. Power may be solar. In addition, the water will be installed to allow boats to be rinsed off after usage. A power post or box with an internal light will be mounted to the end of the pier with receptacles to provide power to the boats from extension cords. The power post will also have a coiling arm for storage of the hose between uses. Because the dock may be used during the hours of darkness, low-intensity lights will be mounted on staggered piles or dock rail posts to illuminate the walking surface. This system will be manually, and/or radio controlled so that the lights will only be on when necessary for safety of the users. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. 2 The permittee—will notify the Town in writing one'week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of completion. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, Section 279-11, the following additional information is offered. 1. Permits for the work are being applied for through the Town, U.S. ACOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. 2. The new piles to be installed will be of sturdy, durable and stable materials; in all likelihood, CCA pressure-treated Class B Southern Yellow Pine or Greenheart piles with new framing of the same materials. These members will be a minimum of 3 x 8's and 3 x 10's with two 3/a"bolt per connection. The pier does not present any adverse modification of the shoreline and the elevation is such that in high flood tides the pier head structure will be inundated. The structure's SYP timber materials represent the standard of the industry being specifically grown for this type of usage and are capable of withstanding full immersion. With the connections described above, this structure will be able to survive repeated inundations and even direct waves at high tide elevations with a structural life of approximately 20 years. 3. It is respectfully requested that the use of CCA pressure-treated piles and timbers be approved for this project, except for the decking. 4. The rebuilt pier will not be decked with CCA pressure-treated Southern Pine. This pier/walkway provides a safe walking surface for access to the berthed boat. 5. The 15-foot property line clearance specified in this paragraph can be met. The existing facilities are being rebuilt "in place" and they are clear of structures on adjacent properties. 6. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to the most seaward face of the pier for identification from the water. 7. There are no permanent structures located above the pier decking, nor are any planned at this time, other than the power post and railing. 8. The existing pier is built right to shore. There is little room to walk under the existing pier at low tide, however, the new pier will provide more than 5 feet of clearance between the inter-tidal shoreline sediments and the deck stringers. Foot traffic is not and will not, be impeded in this area because of the pier's profile at the shore allowing a beach walker to traverse the beach, below the existing pier. Pedestrian access is non-existent because of the isolated shorefront characteristics of this and adjacent properties. The shoreline stone forms a risky, almost impassible transition from the shallow subtidal sediments to the upland. The 3 adjacent properties along this part of West Harbor are; privately owned, similarly configured, and so there is little desirable public access. TOWN OF SOUTHOLD LOCAL WATERFRONT REVITALIZATION PROGRAM (a)Policy 1: Foster the area pattern of development The dock at the Dotson property has existed for more than 30 years. The purpose of this project is to reconstruct the wood pile and timber structure in the exact footprint of the historic facility. There are some minor modifications to the structure, primarily raising the deck height to a uniform elevation of 8 feet above the elevation of mean low water, in order to restore public access to Public Trust Lands of the State and Town but also in deference to current design standards for promoting growth of the eelgrass if other site characteristics are favorable. This project preserves open space and makes beneficial use of a coastal location while not changing any development impacts. (b)Policy 2: Preserve historic resources There are no known historic resources at this site, and in view of the size and shape of the parcel, as well as proximity to the road, it is unlikely that the parcel or this particular site would have any significant occupancy or usage history. (c)Policy 3: Visual quality to be maintained The proposed dock reconstruction process will create a neat and trim structure complete with appointments, including rails of the see-through stainless-steel cable type, which will add to the attractiveness of the structure. The new pier will be slightly more visible because of its increased elevation, dictated by standards and criteria of the NOAA National Marine Fisheries Service operating under the purview of the US Army Corps of Engineers. This project consistent with the visual quality requirements of Policy No. 3. (d) Policy 4: Minimize Damage from flood and erosion The proposed dock will be built to customary tough standards required for open exposures such as this in West Harbor. This will include use of 12-inch Class B Southern Yellow Pine Piles or Greenheart piles, driven to a tip depth of 10 to 15 feet into the bearing strata. The timber components will be, likewise, heavy duty pressure-treated southern pine pieces fastened to the piles with double 3/4-inch galvanized steel bolts. These standards have been developed over the years as being suitable for the exposures on the north shore of Fishers Island. This project is consistent with Policy 4. (e) Policy 5: Preserve local water supplies This policy is aimed at preserving a fresh water supply in the Town of Southold. The proposed dock construction for the Dotson property is located within marine waters of West Harbor and is that not within the hydraulic profile of any known freshwater draw points of existing wells on local properties. In addition, reference is made to the study conducted by the NYS DEC 20 years ago (2000) which stated that pressure-treated piles and lumber were an acceptable, and most suitable construction material for these nearshore marine waters. Water quality of the Town of 4 Southold will not be aepleted or adversely affected chemic-buy by construction of this dock facility using pressure-treated Southern Yellow Pine piles and timbers. (f) Policy 6: Protect and Restore Town ecosystem The waters around Fishers Island, including West Harbor, are recognized as being significant part of the Town's ecosystem primarily in their ability to support vast meadows of eelgrass. This site touches upon a part of the West Harbor eel grass ecosystem. The fact that the dock has existed for three decades and has accommodated boating usage during that lifespan, and the fact that the eelgrass density beneath and around the dark is significant, it is a clear indication that a natural balance has been struck with this facility at this site. The proposed replacement dock structure will comply with current NOAA NMFS design standards in that the pier walkway elevation will be raised and through flow open grate decking will be utilized for the section of the pier over the existing eelgrass bed. Otherwise, the dock facility is an open wood timber pile pier which clearly allows for unencumbered water flow and circulation, consistent with preservation policies for maintaining the ecosystem. (g) Policy 7 Protection of Air Quality This project will not adversely affect or impact air quality for the Town of Southold. (h) Policy 8 Solid waste issues This project will not impose any type of environmental degradation related to solid waste or hazardous substances and waste products. All residual and scrap lumber from the pier construction project will be properly disposed of in accordance with laws and regulations of the States of New York and Connecticut. (2) Public Coast Policies (A) Policy 9: Public Access This project not only provides for public access along public trust lands of the State and Town but improves such access over the conditions which have existed at the site for the last several decades. The public will be able to boat around this facility as well as walk beneath the pier, without encumbrance, on the existing rocky beach. Public access will be improved along this stretch of beach front in West Harbor as a result of these dock reconstruction design standards. (3)Working Coast Policies This site is not located along a stretch of shorefront designated as, or to be in the future, a working coast. The following is a summary of critical factors for approval by the Trustees: • Navigation: the proposed dock facility reconstruction meets standards and does not extend beyond the existing pier or beyond 1/3 of the width of West Harbor, the water body. The depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps of Engineers 5 } guidelines and-there is not recognized Federal/New li oix State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically have been are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed pier design adequately elevated so that it will not impede access for those seeking shellfish and crustacea in season. • Scope in relation to viewshed: The seaward end of the proposed dock will not extend beyond adjacent existing dock. As such, the perspective will not be discernibly different from the existing view. • Environmental preservation: The dock project design raises the deck profile and incorporates open grate decking to the benefit of the aquatic vegetation and has a typical useful lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. • The original dock at this site appears to have pre existed at the adoption of the current Town regulations regarding dock configuration, size and materials. US ARMY PERMITTING This project is covered under Nationwide Permit#3 of the U.S. Army Corps of Engineers being a reconstruction of an existing, longstanding dock facility in its current location and footprint with no further encroachment into public trust waters of the State. Raising the main walkway is consistent with NMFS policies established in 2016 and listed below as well as the concerns of the Fishers Island Seagrass Management Committee: • The elevation/cross section drawing must clearly show the height of the proposed structure above the plane of mean high water and wetland grad, as measured from the bottom of the stringers, for the full length of the structure and they do. The National Marine Fisheries Service requires a minimum height of 4.5 feet in order to avoid adverse effects to Essential Fish Habitat and that clearance is provided (2.3 MHW+4.5 foot clear = 6.8 feet, + 1 foot) for deck framing yielding a dock elevation of 8 feet and that is the deck elevation specified. • The total number, type and diameter of piles to be installed, the installation method, and the time of year the piles would be installed. There will be 45-50 piles installed, all Class B pressure treated Southern Yellow Pine or Greenheart, 12-inch diameter, driven piles in early fall of 2020. • The staging area to be used for work vessels will be just west of the eel grass. The frequency and timing of transit over the eelgrass beds will be once a day and will be conducted at high tides. The NMFS requires work vessels to be moored outside of eelgrass beds and access to and from the work site will occur only during high tide. • The mailing address of adjacent property owners, which are shown on sheet 1 of the drawings. NYS DEC Tidal Wetlands Regulations—Sections 661.5 and 661.9 This project represents the reconstruction of existing dock facility at the Dotson property at the easterly quadrant of West Harbor. The dock facilities to be rebuilt include a pier with an "L"head and pier landing over the intertidal zone. There are no areas of tidal wetlands fringe vegetation. Piers for recreational boating at residential properties on the waterfront are considered to be generally compatible use in an adjacent area (AA) with a permit being required under Section 661.5 (b) (1), 15 and 24. 6 This pier, landing and floating dock facility was repaired in the 1990's. Routine maintenance and replacement of lost or storm damaged decking has been on an "as needed"basis. Under Section 661.9, the standards for issuance of permits of NYS DEC regulations and Section 275- 9 of the Town of Southold Local Law No. 6, the following are considered to be pertinent considerations. • The policies are created to preserve and protect tidal wetlands and prevent their despoliation and destruction. Regulated activities will not have an undo adverse impact on the present or potential value of the affected tidal wetlands. It should be noted that this project is the reconstruction of a long-standing dock facility. No tidal wetlands exists east of the pier along edge of the Dotson shoreline with rocky bottom sediments in the intertidal zone. Certain restrictive characteristics of the existing facility will .be improved by this project, primarily the height of the pier and the use of grate type decking both of which will allow more sunlight to reach the water column to allow tidal wetlands vegetation and SAV to grow if other conditions are suitable. This pier reconstruction project is compatible with public health and welfare policies of the State. • The project complies with development restrictions contained in Section 661.6 as this work is routine maintenance repair and re-construction of an existing long-standing dock facility structure and is compatible with zoning and the long-standing use of the site. • This project will not have an undo or adverse impact on the present or potential ecological value of nearby tidal wetlands vegetation. New York DOS—Waterfront Revitalization Program These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State and they have determined that this project is consistent with the Coastal Management Act of New York and the Waterfront Revitalization Program (see attached). The following policies from the Waterfront Revitalization Program are appropriate. Policy 2 Water Dependent Uses — This project is to reconstruct a fully functional water docking facility for recreational boating at this waterfront site. Policy 5 — Use of Existing Developed Shorefront — This project will be primarily to restore a long- standing dock facility, clear of sensitive habitat or tidal wetlands and restore it to be safe and reliably usable condition and in compliance with environmental policies to enhance and protect habitats such as eel grass, tidal wetlands vegetation with suitable design features. Policy 7 — Significant Fish & Wildlife Habitat— Protection of significant fish and wildlife habitat has been considered in the development of this project layout. The existing pier begins at the shoreline and extends initially over the rocky shoreline. The existing height will be maintained and raised to 8 feet above intertidal and subtidal bottom sediments at the Mean Low Water line to diminish shading impacts. The intertidal zone is gravel, sand and occasionally moderately sized stone. There will be no change to the dimension, or amount of structure which might affect fish habitat and the height will be 7 raised so habitat ana water quality should benefit. The plastic grate decking should also benefit the eel grass bed. Policy 8 —Protection & Preservation of Habitat —Protection and preservation of habitat has also been considered in this project and the dock structure is being kept to its existing configuration and will be restored consistent with standards of the industry and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold. Policy 11 —Minimize Damage to Natural Resources -The pier reconstruction project will be conducted in such a way so as to minimize damage to natural resources as identified in Policy 7 above by alignment and elevation. There are no tidal wetlands in the intertidal zone at-this dock site and the small patch of tidal wetlands vegetation further south will not be disturbed. The eelgrass meadow at the end of the pier will have a minimal pile contact area of 60 SF or so, and the main dock height will be raised and open grate decking will be used on the outer half of the pier to diminish shading impacts. Policy 14 — No Measurable Increase in Flooding= This project consists of routine replacement of an open wood pile and timber pier that will in no way adversely affect water flow and circulation in the harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound, Fishers Island Sound and Block Island Sound and this structure will have no adverse influence on those flood levels. Policy 15 —No Dredging —Dredging is not required in this project. The dock system will be retained in its current location and configuration to avoid any dredging requirements. The depth of greater than 4 feet, as generally recommended by the NYS DEC and US ACOE, has been reached. The waters are unprotected, and so boats must be berthed stern to shore leaving the motor in the deep enough water to avoid bottom contact during low tide wavy conditions. The berthed boat will not ground out at low tide. Policy 19 —Impact on Public Access —Public access will not be jeopardized or impeded as a result of this project. There is no public access usage of the public trust lands or waters at this site due to moderately size stones making passage dangerous for public trust lands at the dock site. The intertidal zone hosts a small patch of spartina just south of the dock site. A bed of observed submerged aquatic vegetation has existed in their area for the past 10 years during which regular observations have been made. The shallow subtidal waters do not present any opportunity or enticement for public access in the area, however, design features have been incorporated into this project which will enhance accessibility, thus, public access to the State's lands and waters will be improved and not be adversely affected by the project. Policy 20 — Public Trust Compatibility with Existing Adjoining Properties and Land Uses- Public Trust compatibility with existing adjoining properties and land uses have also been considered in this project. Adjacent and nearby properties have docking facilities similar to this one and this docking facility will not interfere with existing facilities nor will it impact navigation. Policy 21 —Water Dependent Recreation—This project is consistent with water-dependent recreational opportunities policies set forth in this section. The dock system will continue to be used for boating and water recreation without adversely affecting water point access by the neighbors or navigation by the public at large. Policy 24 —Scenic Resources, Impairment or Loss - This policy is designed to meet appropriate resource standards and to prevent impairment or loss of scenic resources. The reconstruction of the fixed wood pile and timber pier will not represent any new encroachment or structure which would create a loss of scenic resources. The rail and tie-off piles are not a significant aesthetic impact. 8 Policy 25 —Enhance Overall Scenic Quality - The existing dock structure will remain consistent with the scenic quality of the area that has existed for decades and will not adversely affect scenic resources as described in Policy 24 above. Shoreline dock facilities are a common feature along shores of West Harbor and all of New England. This dock does not, nor will it adversely impact the scenic quality of West Harbor; the structure is only visible to the boating public on those and Barlow and Clay Point Road and their numbers are minimal. Policy 44 — Preserve and Protect Tidal Wetlands — It is acknowledged that a small patch of spartina alterniflora exists along the shorefront would be a valuable resource, however, it is so small and such a very limited resource that it cannot be considered significant habitat. Nonetheless, the restorations of the pier will match the configuration of the long-standing dock facility at this site and should allow the growth and continued health of the spartina plants south of the wood pier. SUMMARY This project will rebuild an existing, long-standing dock facility for recreational boating access for the Dotson's home and property on Fishers Island. In summary, the restoration of the long-standing docking facility is consistent with current permitting policies of the State, Federal and local governments. There will be no new adverse environmental impacts associated with this reconstruction project. In addition, by design, the new structure will be more ecosystem friendly, supporting the growth of an existing eelgrass bed, and user friendly to the public, enabling improved waterfront access both from the waterside and along public trust lands of the State of New York and the Town of Southold. This project is consistent with regulations for this work at this location. No mitigative or compensatory measures are required. This routine dock replacement- project complies with applicable standards of the New York State Coastal Management Act, and Consistency Determination has been received.
