That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable•interference with navigation,as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repas&along the beach between high and,low water marks. 7., That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in,the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, - upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required ,supplemental'to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 14, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP also recommends the existing sanitary system be upgraded to an UA on site wastewater treatment system due to its proximity to Pipes Cove which is a high value marine wetland. Based upon the conditions imposed herein, the ZBA finds the application to be CONSISTENT with LWRP policy standards and therefore CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 8,593 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 50 feet along Pipes Cove on the easterly boundary, runs 50 feet along the westerly property line fronting Brooks Road (Pipes Neck Road), runs 168.75 feet on the northerly property line, and 175 feet on the southerly property line. The parcel is improved with a two-story frame residence, a bulkhead, a wood platform, and a 6 ft. by 10 ft. frame shed. All is shown on a survey by Michael K Wicks,LLS last revised August 13, 2018. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's July 12,2018, Amended July 13, 2018, Notice of Disapproval based on an application for a building permit to make additions and alterations to an existing single family dwelling; at; 1) located less than the code required minimum side yard setback of 10 feet;2) located less than the code required minimum combined side yard setback of 25 feet; 3) more than the code permitted maximum lot coverage of 20%; at: 590 Brooks Road, (Adj. to Pipes Neck Creek), Greenport,NY. Page 2,January 17,2019 #7234,McMahon-Hintze SCTM No. 1000-53-1-15 RELIEF REOUESTED: The applicant requests a variances to construct additions and alterations to an existing frame residence with a side yard setback of 6 feet, a combined side yard setback of 12.5 feet, and lot coverage of 22.4 %. Town Code requires lot coverage not to exceed 20%, a minimum side yard setback of 10 feet and a combined side yard setback of at least 25 feet. ADDITIONAL INFORMATION: The survey lists the applicant's neighbors as the County of Suffolk. Site inspection showed that both neighboring lots are vacant parcels. In response to the LWRP Coordinator's comments, the applicant's representative submitted a proposed floor plan with a letter dated December 20, 2018, indicating that the existing bedroom plan is five bedrooms and that no additional bedrooms will be added. During the hearing, the applicant's representative enumerated two similar variances for side yard setbacks and lot coverage issued to neighbors;46743 dated 2014 and#5516 dated 2004. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance(s) will/will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The existing home is the second to last home on Pipes Neck Road which is a dead end street. The applicant is proposing to make a modest second floor expansion of an older home while keeping the existing footprint. The applicant's side yard neighbors are vacant lands owned by Suffolk County which will never be developed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is proposing a second story addition within the existing footprint of the dwelling. None of the dimensional setbacks are changing. Any additions and alterations will require the benefit of an area variance. 3. Town Law §267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 40% relief from the code for the non-conforming side yard setback, 50%relief from the code for the combined side yard setback, and 12 % relief from the code for the non-conforming lot coverage. However, the existing footprint of the home is not changing and the dimensional setbacks for the home will remain the same. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. However, since the proposed additions and alterations are substantial,and the subject property is in close proximity to Pipes Cove, a high value marine wetland, the LWRP report recommends that the existing sanitary system be upgraded to an I/A on site wastewater treatment system. The applicant must also comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. k !
