This letter serves to clarify the steps necessary to move the site plan forward in the review process and to address certain issues raised in your letter. If you recall, the Planning Board notified you by letter dated August 5, 2008 that the wetlands indicated on the survey dated May 10, 2008 and submitted to the Planning Board on July 15, 2008 required verification based upon Planning Staff s review of aerial maps of the property and the Town's freshwater wetlands maps. A copy of the August 5, 2008 letter is attached. Receiving no response, the Planning Board notified you a second time in its October 1, 2008 letter that the location of the wetlands as indicated on the survey submitted as part of your application required verification and that the Planning Board had requested that the Board of Trustees (hereinafter the"Trustees") delineate and flag the wetlands on site. A copy the October 1, 2008 letter is also attached. In response to this request, the Trustees flagged the wetlands on the site on a single occasion on or about October 2008. Thereafter and on November 7, 2008, you, your consultants,Robert Fox and Jim Grimes, Planning Staff and Town Trustees met at the site to review the wetland flagging by the Board of Trustees. At that time, Planning Staff requested that you submit a revised survey that included the wetlands as flagged by the Trustees. i F Site plan application for Reiters Seven Acre Farm P.2 On February 5, 2009 you submitted a revised survey dated January 10, 2009 ("revised survey") representing 4 different wetland delineations; namely; "R. Fox dated 11-08", "R. Herman dated 12-08", "J. Grimes 12-08" and "TO Southold 12-08". We note that the"R. Fox dated 11-08", "R. Herman dated 12-08", "J. Grimes 12-08" delineations on the revised survey were not requested by the Planning Board and appear to be the delineations-of your consultants. Please be advised that the Planning Board does not have the discretion to consider any other delineation other than that of the Trustees ("TO Southold 12-08"). You then came to the counter on February 23, 2009 and were informed by Planning Staff that the Trustees would need to confirm the consistency of the line indicated as"TO Southold 12-08"on your survey with the wetlands that were flagged on the site and that a site inspection was necessary. In April 2009, the Trustees conducted a site inspection and confirmed that the flagged wetlands on your property were consistent with the"TO Southold 12-08"wetlands delineation on the revised survey. However, at the inspection, the Trustees determined to make minor changes to the"TO Southold 12-08" delineation. The sole purpose of the April 2009 site inspection was to confirm the wetlands delineated on the revised survey. The Trustees did not re-flag the wetlands on your property at that time,but agreed to make minor changes thereto and requested that a revised survey be submitted indicating solely the"TO Southold 12-08"delineation with changes. After the April 2009 site inspection, the Planning Board requested that you revise your survey a third time to show only the"TO Southold 12-08"and changes requested by the Trustees in a letter dated May 28, 2009. The Board of Trustee flagged wetlands are highlighted on a plan that was attached to that letter. East property area: After much discussion in this area,no agreeable wetland line was reached. The position of Mr Grimes in this area is that the area has been disturbed and that the dominant tree species(pin oak and swamp white oak,both indicator speciesf was not enough to determine that the area in question was a wetland. His positron was based upon lack of the herb strata. Town staff disagreed with this assessment,explaining that the areas were delineated using dominant tree,shrub and herb species,Chapter 275 Wetlands and Shorelines methods and ACOE three parameter wetland protocols(hydric vegetation,soils and hydrology). Staff pointed out that the entire area contains hydric soils,and exhibits hydric indicators(ponding,water stained trunks and reduced leaves). The argument that the area has been disturbed was discounted by staff as it has no legal influence in determining that the area is not a jurisdictional wetland. The area was flagged and included by the Town as a jurisdictional wetland. Southeast comer of the property: Staff walked this area with the applicant,Jim King and Jill Doherty. The southeast comer of the property contains a jurisdictional wetland. The area has been filled with dredge spoil over the last few months,however,large hydric species(pin oak and swamp white oak)still exist. Staff pointed out that the hydric indicators within this area. Towards the west,an old fence and a rock wall was observed,the grade changes and the area does not contain dominant hydnc vegetation. The applicant explained that an old road occurs in this area which has raised the grade. Staff agreed with this assessment due to the grade change and occurrence of black locust(dominant)and cherry trees within this area. Northeast comer of the property: Staff walked this area with Mr.Grimes. The position of Mr.Grimes was that the area is a typical wetland community based on vegetation alone. Staff concurs with this assessment based upon hydric vegetation,soils and signs of hydrology. Remaining areas of the property: Following the discussion with the applicant and applicant agents,Scott Hilary and I delineated the wetlands based upon field data collected in October. The flags used to delineate the wetlands are pink and labeled Wetland Area,TOS with sequential numbering. The starting point(flag number one)occurs in the southeast comer of the property west of a large boulder Note that the NYSDEC flagged wetland areas are marked with a string and pink flags. These areas occur to the southwest and west on the property. Jim King indicated that the flags will be verified in the field on Tuesday. The purpose of the determination was to determine if wetlands occur onsite exclusive of the New York State Departnnent of Environmental Conservation's (NYSDEC) delineated freshwater wetlands found to the west and south of property. Note, that the NYSDEC does not regulate freshwater wetlands less than 12.4 acres pursuant to the New York State Freshwater Wetlands Act. Therefore, it is necessary for the Town to protect and regulate wetlands under 12.4 acres pursuant to Chapter 275 Wetlands and Shorelines of the Southold Town Code. The methodology and findings are summarized below: Method: A total of four random plots were sampled to determine the presence or absence of a wetland. Plot 1. Eastern boundary of property Plot 2. Southern boundary of property(Disturbed—normal vegetative conditions do not exist). Plot 3 Northeastern corner of property within proposed access road as indicated on site plan Plot 4. North boundary of property near single family structure. Each strata was sampled at differing radii from a established center point. Trees were sampled within a 30' radius, shrubs within a 15' radius and herbs within a 5' radius. Dominant vegetative species were calculated using stem count for the tree/sapling strata and percent cover for the shrub and herb strata. Soils samples were taken at each plot and described. Hydrologic indicators (saturated soils, depth to standing water) were also assessed and recorded. Field data sheets are available upon request. r l r Results: A. Vegetation: The site has been cleared of deciduous hardwood, shrub and herb species in the interior of the property and along the western and southern parcel boundaries. Fill comprising of wood ships, dredge spoil and recycled concrete aggregate has been placed in the interior of the parcel. Along the eastern property boundary the area has been selectively cleared of most saplings and the remaining mature trees have been pruned along the trunks. The vegetation within the northern parcel boundary remains uncleared to achieve a buffer along State Route 25 with one exception. The applicant has begun constructing a road within this area by placing fill for a roadbed. The dominant remaining vegetation consists of hydrophytes; defined as any vegetation that grows in water or substrate that is periodically deficient in oxygen due to excessive water content. Dominant species include wetland indicator tree species; pin oak(Quercus palustris), swamp white oak(Quercus bicolor) and green ash (Fraxinus pennsylvanica). Dominant wetland shrubs consist of arrowwood(Viburnum recognitum) in the north of the parcel. In the same area the herb strata was dominated by an unknown rush and unknown grass. Due to the dense tree canopy layers in the eastern sample plot the herb layer was dominated by moss (Sphagnum spp) Individual specimens of Black locusts (Robinia psuedoacacia) occur in the west and south of the parcel area intermittently at localized higher elevations near an old road that once traversed the property along the southern property boundary. Note, that in areas cleared of vegetation wetland herb species are re-establishing. In addition, the swamp white oak is re-sprouting from trunks. B. Soils: The dominant soil series on site is Canadice comprising 100 percent of the parcel area(Soil Survey of Suffolk County 1972) Soil texture is a silty loam,poorly drained with seasonally high water tables within 6 to 18 inches of the surface The soil is a listed Suffolk County hydric (wetland soil) that is unique to this and the surrounding Moores Drain area. All sample plots exhibited hydric soil characteristics including; frequent mottles and redox concentrations, low chroma colors in the upper horizons, standing water in the soil pit and soil saturation. All of these characteristics indicate hydric (wetland) conditions. C. Hydrology: Site observations indicate that site is periodically flooded for long durations during the growing season. These conditions were apparent within the western, eastern and southern areas of the parcel which remained largely uncleared. Standing water was observed within these areas. Correspondingly, all soil samples were saturated within the 12 inches of the surface. Water stained leaves indicative of ponding occurred within Plots 1, 3, and 4. The grade within Plot 2 was disturbed. Determination: The wetland areas located within the Plots 1 and 3 are palustrme hardwood forested wetlands dominated by pin oak, swamp white oak and green ash tree species and subject to periodic flooding and ponding. The area within and surrounding Plot 2 is disturbed which altered surface hydrology and species composition, however, casual observation revealed that remaining un- cleared tree species include swamp white oak and pin oak; both hydrophytic (wetland) indicator species. Black locusts occur in this area intermittently at higher elevations near an old road that once traversed the southern property boundary. The area surrounding Plot 4 (closest to State Route 25)is a palustrme shrub community dominated by the shrub arrow-wood. i Recommendation: It is recommended that a meeting be arranged to flag the wetlands with the Southold Town Trustees. Once flagged, the areas and jurisdictional setbacks should be mapped and identified on the site plan. The preliminary site plan will require revisions and/or permits to minimize and/or avoid any further disturbances to wetland areas on site. East property area: After much discussion in this area,no agreeable wetland line was reached. The position of Mr.Grimes in this area is that the area has been disturbed and that the dominant tree species(pin oak and swamp white oak,both indicator species)was not enough to determine that the area in question was a wetland. His position was based upon lack of the herb strata. Town staff disagreed with this assessment,explaining that the areas were delineated using dominant tree,shrub and herb species,Chapter 275 Wetlands and Shorelines methods and ACOE three parameter wetland protocols(hydric vegetation,soils and hydrology). Staff pointed out that the entire area contains hydric soils,and exhibits hydric indicators(ponding,water stained trunks and reduced leaves). The argument that the area has been disturbed was discounted by staff as it has no legal influence in determining that the area is not a jurisdictional wetland. The area was flagged and included by the Town as a jurisdictional wetland Southeast comer of the property: Staff walked this area with the applicant,Jim King and Jill Doherty. The southeast comer of the property contains a jurisdictional wetland. The area has been filled with dredge spoil over the last few months,however,large hydric species(pin oak and swamp white oak)still exist. Staff pointed out that the hydric indicators within this area. Towards the west,an old fence and a rock wall was observed,the grade changes and the area does not contain dominant hydric vegetation. The applicant explained that an old road occurs in this area which has raised the grade. Staff agreed with this assessment due to the grade change and occurrence of black locust(dominant)and cherry trees within this area. Northeast comer of the property: Staff walked this area with Mr.Grimes. The position of Mr.Grimes was that the area is a typical wetland community based on vegetation alone. Staff concurs with this assessment based upon hydric vegetation,soils and signs of hydrology. Remaining areas of the property: Following the discussion with the applicant and applicant agents,Scott Hilary and I delineated the wetlands based upon field data collected in October. The flags used to delineate the wetlands are pink and labeled Wetland Area,TOS with sequential numbering. The starting point(flag number one)occurs in the southeast comer of the property west of a large boulder. Note that the NYSDEC flagged wetland areas are marked with a string and pink flags. These areas occur to the southwest and west on the property. Jim King indicated that the flags will be verged in the field on Tuesday.
