Under Chapter 111 of the Town 14 Code, Coastal Hazard Erosion Area, a dock is 15 defined as a structure. A dock that exceeds 16 200 square feet in order to meet with 17 regulations and policies of the Board of , 18 Trustees, with the Wetlands Code, the DEC, 19 Department of State Coastal Management and 20 the Army Corp of Engineers. This is a dock 21 reconstruction proposal not -- which is "not 22 under regulated and has to conform with 23 Coastal Hazard Erosion Regulations. One of 24 the factors being the dock being removable. 25 It is a requested of a variance under 4 1 Chapter 111 be granted due to the history 2 and nature of the site. Similar structures 3 is located in West Harbor, and I have 4 submitted an aerial photograph showing that . 5 those are all the docks in the area. This 6 dock has -- the proposed dock has been 7 designed to be structural stable, with 8 environmental condition that are in West 9 Harbor (inaudible) exceed all the 10 requirements of the aforementioned agencies . 11 The proposed reconstructed dock exceeds the 12 200 square foot limitation therefore by 13 code, must be removable. This requirement 14 is contrary to proper construction 15 (inaudible) negative impacts on West Harbor. 16 I have reviewed Article 34 of the DEC ' s 17 Conservation Law, which the Town -- the 18 Town ' s Coastal Erosion Hazard Law is based 19 on. It is felt that a 200 square foot dock 20 design is more suitable to mainland portions 21 of Southold, not Fishers Island, which 22 creates part of the hardship. The hardship 23 under Chapter 111-D, requires that dock 24 construction must be less than 200 square 25 feet or removable (inaudible ) . The dock 5 1 less than 200 square feet could not be used 2 for dock in this location. This is not long 3 enough to reach the depths to safely dock a 4 boat due to water depths . In this 5 particular case, a dock of 200 square feet 6 would be located landward ( inaudible) water 7 and basically be unusable. The annual 8 removal and reinstallation of a dock could , 9 cause scouring, sedimentation, where 10 permanent dock is a one-time necessary -- 11 one-time -- ( inaudible) . What I am trying, 12 to say, removing all the piles each year 13 will create, what I think will ( inaudible ) . 14 Chapter 111-C, near shore areas, is 15 prohibited near shore areas unless it ' s 16 simply provided for by the Chapter. It ' s, my 17 feeling that all docks can be located near 18 shore areas. Also reviewing Chapter 111 19 findings, the Long Island Sound, Gardiner ' s 20 Bay, Long Beach Bay and no mention of 21 Fishers Island or West Harbor. In 22 conclusion, Chapter 111 , which creates a 23 regulated activities, set standards to 24 prevent, if possible, or minimize adverse 25 impacts on nature protective ( inaudible ) as 6 1 well as erosion to structures. The Coastal 2 Erosion ( inaudible) findings -- proposed 3 activity A, it' s reasonable and necessary 4 considering reasonable alternatives to a 5 proposed activity and to the extent which a 6 proposed activity requires a shoreline 7 location. B, it ' s not likely to cause an 8 increase in erosion at the site or other 9 location. C, it prevents, if possible or 10 minimizes adverse impacts and natural 11 protective features from its protected 12 values. ( Inaudible) erosion control 13 ( inaudible) natural resources . My feelings 14 are, that under A, post dock reconstruction 15 is reasonable and necessary for boating 16 access for proper boat depths, proper 17 shoreline location. B, it ' s not likely that 18 the reconstruction of the dock, which was 19 originally constructed greater than 60 years 20 ago, even constructed 25 years ago, will 21 cause increase in erosion at this site . 22 This site contains an existing stone 23 seawall, which is existing erosion control 24 structure . C, post-dock construction will 25 have no negative impacts on the natural and 7 1 protective features and their functions and 1 2 protected values. (Inaudible) . Sorry. A 3 little bit nervous this morning, but if 4 there is any questions about this? I think 5 it ' s pretty straight forward. 6 SUPERVISOR SCOTT RUSSELL: How far 7 are you extending the existing? 8 GLEN JUST: 20 feet. And that is 9 just to get an increase in water depth. 10 It ' s pretty shallow where the dock is now. 11 SUPERVISOR SCOTT RUSSELL: It ' s in a 12 fairly protected area. 13 GLEN JUST: It ' s also noted -- I 14 didn't put in my little spiel, but in ' 94 , 15 according to the Town records, a permit was 16 previously issued to the previous owner 17 Catherine Hale (phonetic ) . Reconstruction 18 of a dock. A wetlands permit was applied 19 for, but not a coastal erosion. 20 COUNCILWOMAN JILL DOHERTY: I think 21 that was (inaudible) ' 89 or ' 90 it was. 22 SUPERVISOR SCOTT RUSSELL: 23 ( Inaudible) did they get a chance to review 24 it? 25 GLEN JUST: I ( inaudible ) about those 8 1 folks. They are pretty thorough. I was 2 there with Mr. Readimeyer -- 3 JUSTICE LOUISA EVANS: I did forward 4 it to the administrator eelgrass coalition. 5 So they had a copy of the application. 6 SUPERVISOR SCOTT RUSSELL: And they 7 had no -- 8 JUSTICE LOUISA EVANS: I saw no 9 comments coming back. It ' s not an area that 10 they ' re looking to preserve the eelgrass . 11 GLEN JUST: We did take a close look 12 too. We didn ' t notice the presence of any 13 eelgrass. 14 JUSTICE LOUISA EVANS : I just had a 15 general question and maybe not necessarily 16 for Glen, but when you get a permit back -- 17 Mrs. Hale got a permit back, you said in 18 19 -- I forgot what the date was. Did the 19 Trustees re-look at having issued the permit 20 to see -- to make sure that the same 21 standards are being used and everything? 22 Once you get a permit, even if you haven ' t 23 built it, it lasts forever? 24 COUNCILWOMAN JILL DOHERTY: Back then 25 it didn 't. Now it doesn 't. Once you build 9 1 it, it lasts forever. If you don ' t build 2 it, it has a four year. life. A reversal of the Board of Trustees July 14, 2021 determination preventing the issuance of a coastal erosion permit in accordance with Chapter 111 of the Town Code. FACTUAL BACKGROUND AND PROCEDURAL HISTORY A. Description of the property and applicants: The property that is the subject of this application is located at SCTM 4 1000- 10- 9- 6. 1, 520 Sterling Street, Fishers Island,NY. The property is currently improved with a single family home, decks and foundation. The property is located in the residential zone. As confirmed by the Board of Trustees, and acknowledged by the applicant, the property where the proposed work is to be performed is located within the Coastal Erosion Hazard Area as established by New York State in 1991. The applicant submitted an application to the Trustees to remove an existing 3' x 11. 5' ramp, 8' x 15. 5' float and piles as necessary, all of which were approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. Trustees Procedural History: I. Application The applicant filed an application with the Board of Trustees on April 16, 2021 to remove an existing 3' x 11. 5' ramp, 8'x 15. 5' float and piles as necessary, all of which were approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. Under Section 6 Definitions - Unregulated Activities, the proposed reconstructed dock exceeds the 200 sf limitation, and therefore by code, must be removable. Public Hearing: The Trustees held a public hearing on this application on June 16, 2021 and July 14, 2021 at which times all those interested were given the opportunity to speak. III. Trustees Determination and Certificate of Compliance. On July 14, 2021 the Trustees issued a determination stating that the proposed construction fell outside the jurisdiction of the Board of Trustees due to the proposed application being located within the designated Coastal Erosion Hazard Area and therefore the Trustees could not issue a permit under the tidal wetlands act denied the application without prejudice, and as such further application would need to be made to the Town Board. IV.The Town Board Proceeding On August 11, 2021, the property owners timely filed an appeal of the Trustee's determination pursuant to Town Code Chapterl 11 with the Coastal Erosion Hazard Board of Review (the Board) seeking the reversal of the Trustees denial. The Board held a duly noticed public hearing on October 5, 2021, at which time all interested parties were given the opportunity to present testimony on the application. Glenn Just of JMO Environmental Consulting Services on behalf of the applicant addressed the Town Board's concerns with regards to the application to remove an existing 3' x 11. 5' ramp, 8' x 15. 5' float and piles as necessary, all of which were 2 approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. Under Section 6 Definitions - Unregulated Activities, the proposed reconstructed dock exceeds the 200 sf limitation, and therefore by code, must be removable. A dock of less than 200 sf could not be used for docking as it would not be long enough to reach the depths needed to safely dock a boat due to water depths. The proposed work is within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 10- 9- 6. 1, 520 Sterling Street, Fishers Island,New York. This initial application being made within the Costal Erosion Act as well as the Tidal Wetlands Act. Members of the public had the opportunity to appear and the record was closed on October 5, 2021. APPEAL OF THE TRUSTEE'S DETERMINATION Pursuant to §111-24 the Town Board is designated as the Coastal Erosion Hazard Board of Review and has the authority to "[h]ear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Administrator in the enforcement of this chapter."See, Town Code §111-24 (B). Furthermore, the Coastal Erosion Hazard Board of Review has the authority to "reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination of the Administrator, including stop or cease-and-desist orders." See, Town Code §111-25. When considering appeals pursuant to §§ 111-24 & 25, the Board is limited to the record on appeal and the arguments made before the Board of Trustees. In this instance, this Board finds, based upon the record before it, that the applicant has supplied the sufficient information regarding the criteria set forth in §111-9(A-C) of the Town Code to support the granting of a Coastal Erosion Management Permit. CONCLUSION Therefore, in the interests of justice and for the reasons set forth herein, this Board grants the appeal of the Applicant pursuant to Chapter 111 of the Town Code to authorize applicant to remove an existing 3' x 11. 5' ramp, 8' x 15. 5' float and piles as necessary, all of which were approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. The applicant is proposing to remove an existing 3'x11.5' ramp, 8'x15.5' float and piles as necessary all of which were approved under a previous wetlands permit; construct a 6'x20' extension onto the seaward end of a 6'x59' fixed dock which was approved under a previous wetlands permit and install a 4'x16' aluminum ramp, 12 new piles and an 8'x18.5' float. According to Town records on May 26, 1994 Permit No. 4316 was issued to Katherine Hale for'the reconstruction of an existing docking facility which was constructed in the 1960's. Wetland permit applications for the Harbor View Cottages, LLC were submitted to the Board of Town Trustees (Wetlands and Coastal Erosion Hazard), the New York State Department of Environmental Conservation (Wetlands), the New York State Department of State Department of State Coastal Management Program and the Army Corps of Engineers. As of this time permits have been issued by the Board of Town Trustees (Wetlands), the New York State department of Environmental Conservation (Wetlands) and the New York State Department of State Coastal Management Program (General Concurrence) and due to Covid 19 restrictions the Army Corps of Engineers still has their application under review. Variance Request: Under Chapter 111 of the Town of Southold Code, Coastal Hazard Erosion Areas the dock is defined as a structure. The proposed area of the docking facility exceeds 200 SF in order to meet the with the regulations and policies of the Board of Town Trustees (Wetlands), the New York State Department of Environmental Conservation (Wetlands), the New York State Department of State and the Army Corps of Engineers. With this the dock reconstruction proposal is not unregulated and has to conform to the Coastal Erosion Hazard area regulations with one of the factors being that the dock being removable. It is requested that a variance to Chapter 111 be granted because of the history and nature of the site and similar structures located within West Harbor (see enclosed aerial photograph). The proposed dock has been designed to be structurally stable for the environmental conditions in West Harbor and to meet and or exceed all of the requirements of the aforementioned agencies. The proposed reconstructed dock exceeds the 200 SF limitation and therefore by code, it must be removable, This requirement is contrary to proper construction and design and could have negative impacts on West Harbor. I have reviewed Article 34 of the New York State Environmental Conservation Law, which the town of Southold Coastal Erosion Hazard program is based upon. It is felt that 200 SF dock design standard is more suited to the waters of mainland Southold and not Fishers Island which creates the hardship with this project. Hardship: Chapter 111-6 (Definitions) requires that a docking structures must be less than 200 SF or removed in the fall of each year. A dock of less than 200 SF could not be used for docking since it would not be long enough to reach the depths needed to safely dock a boat due to water depths. In this particular case a dock of 200 SF or less would be located landward of the Mean Low Water Line and therefore would make it unusable. The annual removal and reinstallation of the docking facility could cause scouring and sedimentation, where a permanent dock is a one time temporary disturbance to the substrate. Chapter 111-11 C (Nearshore areas) notes that all development is prohibited in near shore areas unless specifically provided for in the Chapter. It is felt that all docks are located in near shore areas. Also, in reviewing Chapter 111-5A (Findings) the water bodies noted are the Long Island Sound, Gardiners Bay, Long Beach Bay and Orient Harbor with no mention of the Fishers Island Sound or West Harbor. To have the private recreational docking facility removed and reinstalled annually would not be environmentally "friendly" and physically or economically appropriate. With this, it is the basis for the requested waiver. Conclusion: Chapter 111 was created to regulate development activities and set standards to help prevent, if possible, or minimize adverse effects on natural protective features as well as existing erosion protection structures and natural resources. Chapter 111-9 (Issuance Of Permit) states that "A Coastal Erosion Management Permit will ne issued only with a finding by the Administrator that the proposed activity: A. Is reasonable and necessary, considering reasonable alternatives to the proposed activity and the extent to which the proposed activity requires a shoreline location. B. It is not likely to cause a measurable increase in erosion at the site and other locations. C. Prevents, if possible, or minimizes adverse effects on natural protective features and their functions and protective values, existing erosion protection structures and natural resources." A. The proposed dock reconstruction is reasonable and necessary for boating access to proper water depths and docks do require a "shoreline location". B. It is not likely that the reconstruction of this dock which was originally constructed greater than 60 years ago and reconstructed 25 years ago will cause an increase of erosion at this site or others. This site has an existing stone seawall (existing erosion protection structure). C. The proposed dock reconstruction will have no negative impacts upon natural protective features and their functions and protective values, existing erosion protective structures and natural resources. Environmental Consulting on behalf of HARBOR VIEW COTTAGES LLC c/o THOMAS SHILLO applied to the Southold Town Trustees for a permit under the provisions of Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated April 16,,2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 4.1 - Minimize losses of human life and structures from flooding and erosion hazards, Policy 6.3—Protect and restore tidal and freshwater wetlands, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 16; 2021 and July 14, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposed structure, as applied for, is located in a nearshore area as per Definitions in Chapter 111 Coastal Erosion Hazard Areas of the Town Code and governed by Section 111-11 C.
