Maresca Associates, dated March 12, 2020 and stamped approved on October 14, 2020. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. the anticipated dredging would be conducted to a depth of-6 feet below the plan of Mean Low Water (-6' MLW NAVD, 1988 datum) and would not include over depth dredging; removal of approximately 1,690 linear feet of existing timber bulkhead and 290 linear feet of vinyl bulkhead which would be replaced by approximately 2,005 linear feet of new vinyl bulkhead within the basin and removal of approximately 282 linear feet of steel bulkhead and replacement with 282 linear feet of new steel bulkhead along the southern portion of the property directly abutting Gardiners Bay; the new vinyl bulkhead will consist of vinyl sheets, 11" diameter lumber piles, 6"x8" lumber wales, to deadmen and backing pilings; the bulkhead would be expanded in the northeast corner by approximately 13' of the basin to square off the corner which would create approximately 230sq.ft. of new basin area; the bulkhead would be expanded in the southwest corner by approximately 17' of the basin to square off the corner which would create approximately 500 sq.ft. of new basin area; removal of the center main "T" shaped fixed pier which is approximately 197 feet long and 1,175sq.ft. in area; removal of eight (8) finger piers in the basin totaling approximately 225sq.ft.; reconstruction of approximately 15 finger piers in the basin totaling approximately 1,250sq.ft.; two proposed finger piers will contain wave protection boards; where existing wave protection boards will be removed from current piers; installation of a new dinghy tie-off floating dock at 4'x60' (t250sq.ft.) located along the south edge of the restaurant deck; installation, removal and replacement of pilings within the basin (approximately 111 existing pilings will be removed, 45 new 11" diameter pilings to be installed and 78 existing pilings to remain or be replaced as necessary with new 11" diameter pilings); repairs to existing boat ramp as necessary; installation of a new pump out facility located along the new expanded area of the bulkhead in the northeast corner of the basin; the pump out facility will consist of an Edson pump (model to be determined) to a 500 gallon holding tank; new electrical and water lines to the boat slips will be installed; the installation of debris booms will be erected across the channel to contain in water construction debris; the immediate areas of construction and dredging will be conducted behind a turbidity curtain; and the proposed pilings will be installed with jetting and/or pile hammers; with the condition of a 115 gallon mobile pump-out unit and a minimum of a 1,500 gallon storage tank for the pump out station; and as depicted on the site plan prepared by S.L. FINDINGS OF FACT PROPERTY FACTS: A site plan prepared by Architechnologies, dated October 19, 2000, shows the subject property to be a parcel of 4.55 acres lying between Main Road and Gardiner's Bay in Orient. It is improved with a restaurant and a marina for commercial and recreational fishing boats. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated November 21, 2000, denying a permit to construct an accessory building because it would be 3 feet from the property line whereas Code section 121C(1) requires a minimum setback of 20 feet. RELIEF REQUESTED: Applicant requests a variance authorizing the location of the accessory building as proposed, with a 3-foot setback from the westerly lot line. REASONS FOR BOARD ACTION DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal Inspection, the Board makes the following findings: (1) Applicant wants to provide adequate restrooms for marina patrons, as well as some cold storage for patrons' fish and ordinary storage space for his business. He proposes to build a 20 x 40 foot structure containing these facilities. (2) The property is deep from Main Road to the Bay, but narrow, and the entire center is a boat basin. The relatively narrow strip of land between the westerly lot line and the boat basin is paved and provides vehicular access with parking spaces abutting the westerly lot line. The rational location for the proposed building is on this paved strip. Although there is open land near Gardiner's Bay, that would be a very inconvenient location for the proposed building. (3) In order to minimize interference with vehicular traffic moving through the property and using the parking spots on the westerly edge of the property, applicant wants to place the proposed building only 3 feet from the westerly lot line. The Board believes this location is desirable for vehicular and pedestrian safety. Since the land to the west is open parkland owned by New York State, construction in the proposed location will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2,2012 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding area is of mixed uses containing a marina,a restaurant,an office building and parking lot used by Plum Island employees,a large interstate ferry terminal and a residential development.Any detriment is mitigated by the placement of the tower at the southernmost end of the property which is the farthest distance from the existing buildings and residences in the area. 2. Town Law 4267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance because any proposal to construct a cellular tower to fill in the gap in coverage that is proposed by this request in this area of Southold Town would require similar or larger variances. 3. Town Law 4267-b(30)(3). The variances granted herein are mathematically substantial. The code required minimum distance of all wireless equipment adjacent to residential property lines is no less than 500 feet, the applicant is proposing a 7.1 foot setback, representing a greater than ninety eight percent (98%) relief from the code. Also the requirement of a 25 foot minimum side yard setback is proposed to be reduced to 7.1 feet; this represents a seventy percent(70%)relief from the code, However,the residential property in question is owned by Long Island State Park Commission(Orient State Park)and has no residential structures located within the required fall zone and is the access roadway to the park with no access to the beach within the area of the monopole site. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. With respect to the.physical impact on the neighborhood,the Board finds,based on the report submitted by the applicant titled "Proposed Public Utility Wireless Communications Facility Orient By the Sea" Prepared by VHB Engineering surveying and Landscape Architecture,PC,that the location is the least obtrusive,given the uses in the surrounding area and the limited choice of locations for siting such a structure. As for the environmental conditions with respect to the radio frequency emissions,the total amount emitted will be more than 48 times below the limit established as safe for continuous human exposure as set by the FCC and stated on page 12 (Compliance Conclusion) of the report titled "Antenna Site FCC RF Compliance assessment and Report submitted by the applicant's expert consultant 5. Town Law ¢267-b(3)(b)(Q, The difficulty has been self-created. The applicant choose the-parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to choosing this location. However,the difficulty is actually caused by the lack of any parcel within the proposed effective range of the proposed tower that would not need even more extreme variances. RELIEF REQUESTED: The applicant requests variance relief to install a wireless telecommunications equipment compound with a side yard setback of 7.25 feet from the subject property line, adjacent to an R400 Zoned NYS State Park,where 25 feet is the minimum permitted by code. The Notice of Disapproval was amended on August 24,2016 to address the need for a variance from the Zoning Board of Appeals and further amended on October 18, 2016 to correct errors. ADDITIONAL INFORMATION: The Chief of Police of Southold Town submitted comments by email,to the Chairperson of the Zoning Board of Appeals,on January 31,2017,addressing this application. He indicated that it was critically important that the proposed Verizon Wireless equipment be approved by the Board of Appeals.-He stated that the local police participate in counter terrorism drills with other local, state and federal agencies; and that current spotty communications from Orient Point and Plum Island both by radio and cell phones would be greatly improved with the installation of this proposed cellular equipment.The Suffolk County Police Department indicated in their letter of December 2,2016 submitted by the applicant,that they fully support the application due to the need for communications coverage for police and public safety. The applicant also submitted several reports including three engineering reports and an FCC Compliance Assessment Report which will all be forwarded to the Planning Department for their review of the site plan application. On February 15,2012 in ZBA#6533,the Zoning Board granted MGH Enterprises Inc./New Cingular Wireless, LLC variance relief to install a new wireless communications tower and equipment compound having a 7.1 foot side yard setback from the property line,which was subject to a condition that they return to the Zoning Board if, in future,they wish to increase the height of the monopole. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2,2017 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding area is of mixed uses containing a marina, a restaurant, an office building and parking used by Plum Island employees, a large interstate ferry terminal with parking area, an R-400 zoned protected NYS State Park which cannot be subdivided and two large residential developments across NYS Route 25,to the north. Any detriment is mitigated by the placement of the proposed cellular equipment compound at the southernmost end of the property which is the farthest distance from existing buildings and residences in the area. Additionally dense screening exists on site and is proposed for the new equipment compound to further mitigate visual impacts. 2. Town Law 5267-b(3)(b)(2), The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. To function properly, the proposed equipment compound must be located next to the existing equipment compound which was previously granted a 7 ft. 1 in.side yard setback 3. Town Law 5267-b(3)(b)(3). Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Thd adjacent residential property is owned by Long Island State Park Commission(Orient State Park)and has no residential structures located within the required fall zone and is the access roadway to the park with no access to the beach within the area of the monopole site. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created.However,the original site chosen for the existing tower has not caused any physical or environmental problems for either the surrounding residentiahcommunity or the commercial community. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new wireless telecommunications equipment while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP provided the following is required to further Policy 6: 1. An acceptable upland dredge spoil disposal site is secured and identified. The composition of the dredge material has not been identified and it is unknown if the material is suitable for on-site disposal near Gardiners Bay. It is recommended that the applicant have the material identified and analyzed for contaminants. 2. If the dredge material will be trucked off-site, the impacts of truck traffic transporting material on the quality of life of residents should be considered to further Policy 1. A truck route plan is recommended.
