ADDITIONAL INFORMATION: Letters from the applicant's neighbors were received by the Board voicing no concern and in support of the proposed improvements. The applicant agent submitted documentation on other r properties in the surrounding neighborhood that have benefited from prior ZBA side yard variance relief specifically ZBA File s 44843,#7266 and#7072. In ZBA File#e 7072 side yard setback relief of 6.8%was granted as well as lot coverage of 29.7%. During the public hearing,the applicant testified that the accessory structure located on the property is not habitable,not conditioned,and is used for storage only without any plumbing. In the application,the applicant's representative outlined the following improvements: 1. The existing southerly side yard setback of 9 feet will remain unchanged and the second-floor deck and most of the southerly portion of the first-floor deck will be replaced within the same footprint, 2. The most northerly portion of the first-floor deck would be increased by 23 6 square feet,reducing the existing northerly side yard setback by 3.5 feet, from 10.5 feet to 7 feet (where 10 feet is 'required); reducing the existing total side yard setback by 3.5 feet,from 19.5 feet to 16 feet(where 25 feet is required);and increasing the existing lot coverage by 247 square feet from 23.1 to 25.1 percent of buildable land. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5,2021at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The reconstructed second- floor deck will have a drain and downspout to be tied into the existing drainage system and the backwash from the proposed swim spa will also be piped in to the existing drainage system. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law &267-b. We are replacing the windows on the back fagade of the main house, upstairs and downstairs in the same layout of existing windows. Backyard deck is to be replaced in the same current span of 26' W (width of house)x 16' D.The deck,will wrap around the left side of the house 33' L x 6' D to replace existing deck and sheds for a much more streamline, and clean visual character(some side decking, sheds, roofing already removed due to deterioration &safety). The current broken hot tub is to be replaced with a hot tub of 14' L x 8' W in the left corner of the deck.
